Resolution: A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE

MANAGER TO PURCHASE 45 TASER ELECTRONIC CONTROL
DEVICES AS APROVED IN THE 2007 -2008 BUDGET FOR THE
TOTAL AMOUNT NOT TO EXCEED $42,738.75 TO BE CHARGED TO
THE FEDERAL FORFEITURE ACCOUNT PROVIDING FOR AN
EFFECTIVE DATE.
Request: Authorizing the City Manager to execute a purchase agreement with DGG Taser
for the acquisition of forty -five (45) Taser electronic control devices in an amount
not to exceed $42,738.75
Reason /Need: In order to enhance officer safety and reduce potential
incidents of injuries to both officers and combative subjects, the Police
Department wishes to implement the use of the Taser electronic control
device as a defensive tool.
Cost: $42,738.75
Funding Source: Funds will be expended from the Federal Forfeiture Fund accounts # 615-
1910- 521 -6430, with a balance of $42,738.75.
Backup Documentation: Draft Resolution, Copy of Quote from DGG Taser, Police Reports
highlighting recent incidents where injury/potential injury may have been reduced with the use of
an electronic control device and Dade Chiefs Association model Policy.

11 WHEREAS, the police department currently has no tool fitting the void between physical altercation
12 with combative subjects and the use of a more aggressive weapon, and
13
14 WHEREAS, due to their proven ability to stop combative subjects while reducing residual negative
15 effects, electronic control devices are dependable, less than lethal tools, and
16
17 WHEREAS, in order to reduce incidents of potential injury to police officers and potential injury of
18 arrested subjects, the electronic control device can be used in place of more aggravating defensive
19 weapons, and
20
21 WHEREAS, DGG Taser has a proven history as the only reliable and safe electronic control device
22 available for law enforcement use, and
23
24 WHEREAS, the funding for this purchase was allocated and approved in the Federal Forfeiture
25 account.

27 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF
28 THE CITY OF SOUTH MIAMI, FLORIDA:

31 Section 1. The City Manager be, and hereby is authorized to issue a purchase order to
32 DGG Taser for the acquisition of forty-five (45) Electronic Control Devices
33 as approved in the, 2007 -2008 budget in an amount not to exceed
34 $42,738.75. That the disbursement be charged to The Federal Forfeiture
35 accounts # 615- 1910 - 521 -6430 with current balance of $ 48,514.52.

37 Section 2. That the Mayor and City Commission authorize the City Manager to execute
38 the expenditure through the Federal Forfeiture account.

Electronic Control Device
5.1.1. Electronic Control Device
An electronic control device (ECD) is a device that uses a powerful
electrical signal to temporarily override the central nervous system
and directly control skeletal muscles. This causes an uncontrollable
contraction of the muscle tissue, allowing the ECD to physically
debilitate a subject regardless of pain tolerance or mental focus.
The ECD is classified as less than lethal force technology and
equipment. By definition, these devices are not likely to result in
death or serious physical injury.
The ECD is deployed as an additional Law Enforcement tool, and it is
not intended to replace firearms or self- defense techniques. The ECD
may be used to control a dangerous or violent subject when deadly
force does not appear to be justified and/or necessary; or attempts
to subdue the suspect by other conventional tactics have been, or
will likely be ineffective in the situation at hand; or there is
reasonable expectation that it will be unsafe for officers to approach
within the contact range of the subject.
The ECD has a records storage function where it stores the time and
date when it is fired. This data provides a complete and accurate
documentation on each firing. These records provide invaluable
information in the event of an allegation of the misuse of the device.
The sergeant's office computer will have the ECD download program
located on its hard drive. Supervisors shall when conducting
monthly inspections have each officer download each ECD, these
ECD monthly downloads will then be printed on a report and
forwarded to the Administrative Section Commander. The
Administrative Section Commander shall be responsible to maintain
all records pertaining to use and monthly inspection reports along
with maintaining a backup to the program located on the sergeant's
computer.
USE OF FORCE APPLICABILITY:
The use of the ECD is addressed at the same level of force
consistent with the use of OC Chemical Agent (Level 3). It may be
used when suspects, through their words and body language,
communicate that they are resisting, opposing, or attempting to flee
from an officer who is making a lawful arrest or detention. In
addition, an Officer may deploy the ECD on an individual who may be
experiencing a mental health crisis, if the officer feels it is unsafe to
approach a person with a mental health issue and may be a danger
to himself, the officer, and/or others.

The ECD is not intended to be used as a tool of coercion to
intimidate an individual into compliance with simple requests or
directions from an officer.
A. The decision for an officer to deploy an ECD will ultimately rest on
the officer's judgment and application of departmental policies. A
suspect's actions, including verbal statements and body language,
should be taken into account before the deployment of an ECD.
B. The ECD may be used at distances up to 21 feet when:
1. The suspect is punching, kicking, or physically resisting,
obstructing or opposing an officer;
2. The suspect is threatening to punch, kick, or physically harm a
police officer;
3. Lesser force options are ineffective;
4. The officer reasonably believes that the suspect poses a credible
threat to himself /herself or others;
5. The suspect poses a threat from a distance and the officer is at
risk of injury if he/she attempts to close the gap.
C. Other considerations on deployment of the ECD include:
1. Imminent threat of the suspect to the officer or others;
2. Suspect actively resisting arrest;
3. Severity of the crime at issue;
4. Attempt by the suspect to evade apprehension by flight.
D. Officer /suspect factors that may be considered:
1. Age;
2. Gender;
3. Pregnancy (avoid use on later term women. as the ECD could
cause complications from a secondary injury fall and contractions);
4. Children (avoid use);
5. Skill levels;
6. Numbers of suspects and numbers of officers;
7. Relative strength of officers and suspects.
E. Special Considerations:
1. Closeness or possession of a weapon by the suspect;
2. Injury or exhaustion of an officer;
3. Officer on the ground;
4. Distance between the officer and the suspect;
5. Special knowledge relative to the suspect;
6. Availability of other options.

ELECTRONIC CONTROL DEVICE. DEPLOYMENT /DISCHARGE
PROCEDURE:
Departmentally issued ECD's shall be the only ECD's authorized for
use by SMPD personnel. ECD's will be issued to and used only by
officers who have completed the ECD Training Program. Only
properly functioning and charged ECD's will be carried in the field.
Each discharge, including accidental discharges, of an ECD will be
investigated and documented utilizing a Use of Force Report (Officer
Response to Subject Resistance Report).
A. The ECD is programmed to give a 5- second "electrical current.
Any extension of this time period should be justified and
documented appropriately. The probes should not be touched during
this time period as anyone coming in contact with the probes will
also receive the same "electrical current." Officers should avoid
stepping on or tripping over the wires.
B. The ECD should never be aimed at the eyes or face of a suspect.
The ECD is' laser-sighted. The top probe will follow the front and rear
sights. For the laser sight, the bottom probe will travel at an 8- degree
downward angle below the aim point/laser sighted area. The rule of
thumb for the bottom probe is that it drops one (1) foot for every
seven (7) feet that it travels.
1. Officers should keep their hands away from the front of the unit at
all times unless the safety slide is forward and the ECD is
deactivated.
2. Officers shall always replace air cartridges by their expiration date.
Outdated cartridges will be used for training only.
C. The ECD should not be fired near flammable liquids and fumes.
The ECD can ignite gasoline or other flammables. Some self- defense
sprays are flammable and would be extremely dangerous to use in
conjunction with the ECD. Officers should not deploy the ECD in
highly flammable "meth" labs.
D. All uses of the ECD will be documented on a Use of Force Report
and reviewed by the officer's immediate supervisor, and the Chief of
Police through the chain of command.
Officers discharging an ECD will:
1. Request the response of a supervisor if a supervisor is not on-
scene.
2. Prior to the use of the ECD, if practical, broadcast "ECD" or
"Clear" indicating the use of the ECD is imminent.

3. Persons who have been subjected to the ECD and /or probes will
be treated as follows:
a. Once in. custody, officer(s) will advise the supervisor that the
person has been subjected to the ECD and relate the approximate
time the action occurred. If the probes penetrate the skin, the trained
officer will determine if the probes can be removed by the officer or if
further medical treatment is necessary.
b. Officers will not remove the probe if the barb shaft is imbedded so
deep as to prevent the probe form hanging Ioosely..Note: the probes
are #8 straightened fish hooks that can only penetrate a maximum of
'/4 inch. The officer will Request Miami -Dade Fire /Rescue to examine
the person if the probes cannot be removed because of depth of
penetration or hit to head, groin, or women's breast. Officers should
not perform the probe removal if the probes are located in sensitive
areas (i.e. groin or breasts).
c. Most probes can be removed immediately on the scene by trained
officers, without the need for transport to any medical facility for
removal, and without any need to call a Fire /Rescue crew to the
scene. The person can then be transported directly to a jail facility or
mental health facility by the officer(s). Probes that are lodged in the
face or groin should be removed by medical personnel, not the
officer, and those cases will need to. be transported to Ward D or an
emergency hospital for probe removal. Unless there are other
injuries or apparent medical problems that would warrant calling
Miami -Dade Fire /Rescue, the officer will remove the probes
themselves and transport the subject to the appropriate jail or mental
health facility.
d. If the subject needs to be taken to a local medical facility other
than Ward D for removal of probes lodged in high risk body parts,
then any hospital emergency room will be able to do this rapidly.
e. Officers are to wear rubber gloves when removing probes from
skin. Officers will use the two (2) finger method for removing probes.
f. After examining the affected person, the officer will make the
determination if the person should or should not be transported to
Ward D for further evaluation. Officers should keep in mind that
extreme, violent behavior may be the result of drugs or alcohol, and
Miami -Dade Fire /Rescue may be necessary to treat the drug
overdose immediately.
g. Officers must be aware that one easily overlooked aspect of injury
in applying an ECD to a person is that of falling from a standing
position. If other injuries occur to the subject as a result of the ECD,
the officer will request Miami -Dade Fire /Rescue to respond to the
scene for treatment.
h. Officers will complete the Use of Force Report narrative,
describing where the ECD probes hit and how they were removed.

Officers will document the ECD use in the Offense Report and/or
Arrest Affidavit as well.
L The air cartridge and probes used will be impounded into evidence.
Since the probes will probably have blood on them (biohazard) the
officer(s) will wear protective latex gloves when handling. The wires
will be wound around the cartridge.
The probes will be inverted into the portals they originally were
deployed from (this will prevent the sharp ends from penetrating the
envelope and bag). Tape will then be placed over the portals to
secure the probes in the cartridge. The cartridge will then be sealed
into a plastic evidence bag, to be secured in an evidence locker. As
in all property/evidence impounds, the officer will fill out a property
receipt and attach it to the evidence bag.
J. After each ECD deployment the on duty supervisor shall download
the records from the ECD storage device and print a report. That
report shall be attached to the subject resistance report prior to its
submission.

EXECUTIVE SUMMARY
A Conductive Energy Device (CED) is a device designed to deploy
electricity throughout the body of the target to temporarily cause loss of
muscle control. TASER® International, the company best known today
for producing CEDs, claims it provides an advanced non - lethal option for
the use in law enforcement, private security and personal defense.
However, recent competition by StingerTm Systems, Inc. in the once
limited field of CEDs has led many agencies to question the advantages
and disadvantages of the competing products.
As a less - lethal weapon, a CED with projectile probes can be very
effective. These devices can incapacitate a subject through the use of
electrical shock, generally allowing the user enough time to apprehend a
subject, or retreat from confrontation. It has been hypothesized that the
voltage produced overwhelms the attacker's nervous system, forcing
their muscles to contract, causing temporary incapacitation. However,
reliability is a major concern when dealing with any type of weapon
system. A significant problem for law enforcement agencies that are
preparing to deploy CEDs into the field is, that they are required to rely
on factory data, specification sheets, and company marketing in order to
make the critical decision as to which system to adopt. An independent
study of this electronic weapons technology was necessary to determine
each product's performance and operational safety.

This report provides both a qualitative and quantitative analysis of
the two weapon systems. The researchers tested both the TASER X26
and Stinger S200 weapon systems repeatedly, and documented variables
including: distance to target, probe spread, probe distance to aim point,
probe contact with target, and cartridge and weapon systems
malfunctions. A qualitative review of. the shocks received from both the
TASER and Stinger weapons was conducted using fifteen volunteers.
Using alligator clips to deliver the weapon's shock, the majority of people
reported a much lower level of incapacitation when hit with the Stinger
S200 in comparison to the TASER X26. In comparison, one individual
that took a probe/barb hit claimed that the Stinger S200 was much
stronger than the TASER X26 shock.
A quantitative review of the weapon systems shows greater
reliability of the TASER X26 over its Stinger S200 counterpart. One
concern with the Stinger weapon system was that the Stinger S200 probes
frequently broke free from their barbs in the target. The Stinger S200
system also had problems with tangled lead xvire, and although the probe
spread was smaller in the Stinger S200 (allowing for greater accuracy at
greater distances than the TASER X26), the probes had a problem
reaching the target. The Stinger S200 probe penetrates deeply at close
distances, but lost ability to penetrate targets over greater. distances.
The TASER X26 weapon system also had problems. While probe
spread is important in a projectile CED to insure electrical current is

traveling through a large amount of muscle mass, the TASER missed the
target frequently at 20 feet, even though the tether wire was 2 S feet long,
due to the probe's spread angle.
Both products were also tested for durability. The TASER X26 and
the Stinger S200 had similar tensile strength in the tether wires leading
from the weapon to the probes. In a separate test, a number of
cartridges were dropped from a height of four feet to determine their
survivability. None of the TASER cartridges broke during this test; .
however, fourteen out of the twenty Stinger cartridges were damaged
upon impact with a carpeted floor.

LEFT THE ROOM, NEALY SUDDENLY JUMPED OUT OF BED AND ON TOP OF PAREDES AND BEGAN TO ATTACK HIM. THE TWO
STRUGGLED FOR A SHORT TIME UNTIL BATSON ENTERED AND SAW THE FIGHT. SHE THEN SUMMONED ASSISTANCE AND
SUAREZ CAME IN AND ATTEMPTED TO SEPARATE NEALY FROM PAREDES- JIMENEZ ALSO ENTERED THE ROOM AND
WITNESSED THE INCIDENT. AFTER A SHORT TIME SUAREZ WAS ABLE TO PULL NEALY OFF OF PAREDES, BUT IN THE
PROCESS NEALY PUNCHED SUAREZ SEVERAL TIMES IN THE BACK OF THE HEAD AND TORSO. NEALY WAS RESTRAINED AND
PAREDES WENT TO THE EMERGENCY ROOM AND WAS TREATED FOR INJURIES CAUSED BY THE FIGHT. HE HAD A DEEP
LACERATION ABOVE HIS LEFT EYE WHICH REQUIRED INTERIOR AS WELL AS EXTERIOR STITCHES AND HIS LEFT EYELID
WAS SEVERELY SWOLLEN AND BRUISED. HE ALSO SUSTAINED SWELLING AND MINOR BRUISING TO HIS RIGHT EYE, CUTS
ON HIS LEG, AND ABRASIONS ON HIS BACK. AFTER BEING TREATED PAREDES WENT HOME. AT APPROXIMATELY 0806
HRS ON 1/11/08 SMPD WAS CALLED TO THE HOSPITAL TO MAKE A REPORT OF THE INCIDENT. NEALY WAS ARRESTED
AND TAKED TO WARD D. AFTER REFUSING TREATMENT BY DR. HERNANDEZ, NEALY WAS TAKEN TO THE DADE COUNTY
JAIL. AT APPROXIMATELY 1245 HRS PAREDES CAME TO LARKIN HOSPITAL AND SGT. GRIFFIN TOOK PICTURES OF HIS

MARTINEZ CALLED POLICE ADVISING OF TWO W /M'S BEHIND 5830 SW 73 ST.BREAKING INTO VEHICLE WINDOWS.
I MADE CONTACT WITH HIM AT 73 ST AND SW 59 AVE WHERE HE BRIEFLY EXPLAINED THE FOLLOWING.
HE AND HIS WIFE (W #2,DIAZ- PORRAS)ARRIVED AT THE REAR OF THE SOUTH MIAMI CONSERVATORY AT 5830 SW 73 ST.
AND PARKED IN THE REAR PKG.LOT.THEY HEARD GLASS BREAKING AND THEN OBSERVED ELVIS AND EDDIE BESTEIRO
INSIDE VEH #2 RANSACKING SAME.BOTH WITNESSES THEN WENT UPSTAIRS INSIDE THE BLDG.AND CALLED POLICE WHILE
STILL WATCHING THE PARKING LOT.
BOTH BESTEIRO BROTHERS NOW WERE ATTEMPTING TO SMASH THE WINDOWS OF THE ADJACENT VEH #3.
MARTINEZ LEFT THROUGH THE FRONT OF THE BUSINESS WHERE HE FLAGGED ME DOWN.
AS I ENTERED THE LOT I OBSERVED BOTH BESTEIRO BROTHERS STANDING BETWEEN A WHT.FORD TAURUS(VEH #2)AND A
RED TOYO.CELICA(VEH #3) THERE WAS GLASS ON THE GROUND AND THE LISTED RECOVERED PROPERTY(KENWOOD CD
PLAYER)ALSO.I ORDERED BOTH BESTERIOS TO STOP,GET ON THE GROUND, THEY WERE UNDER ARREST.EDDIE BESTERIO
RAN TO CONCEAL HIMSELF UNDER VEH #2 WHER HE DROPPED THE LISTED BURGLARY TOOLS.HE WAS THEN TAKEN INTO
CUSTODY BY OFC.D.WAGNER.
ELVIS BESTEIRO REFUSED TO COMPLY WITH MY ORDERS AND ATTEMPTED TO ENTER HIS AWAITING VEH #1 WHICH WAS
BACKED INTO THE PKG.SPACE ADJACENT TO VEH #2. A BRIEF STRUGGLE ENSUED AS I ATTEMPTED TO EXTRACT HIM
FROM THE FRONT SEAT.HE STARTED THE VEHICLE #1 AND REVVED THE ENGINE AT WHICH TIME I OBSERVED OFC.J.
AGUTAR RUNNING TOWARDS ME THROUGH THE NARROW ALLEYWAY TO ASSIST WITH TAKING BESTEIRO INTO CUSTODY.
VEH #1 THEN STARTED MOVING AWAY AT AT A HIGH RATE OF SPEED IN OFC.AGUTARS DIRECTION REQUIRING ME TO LET
GO OF BESTEIRO AND MOVE AWAY FROM THE OPEN DRIVERS DOOR TO AVOID PERSONAL INJURY TO MYSELF FROM THE
NOW MOVING VEH #1.OFC.AGUTAR RAN NEXT TO VEH #1 ORDERING BESTERIO TO STOP. INSTEAD, BESTEIRO LOOKED AT
OFC.AGUTAR AND ATTEMPTED TO SWERVE TO THE LEFT IN AN ATTEMPT TO PIN AGUTAR TO THE WALL OF THE NARROW
ALLEY -WAY WHERE VEH #1 STRUCK THE WALL OF THE ALLEY.BESTEIRO FLED EASTBND.ON SW 73 ST.TO 57 AVE.WITH
OFC.AGUTAR IN MARKED POLICE VEH.PURSUIT, LIGHTS AND SIREN.BESTEIRO THEN TURNED N.ON 57 AVE.THEN EAST
ON 72 ST.AT SPEEDS REACHING 60MPH.AT 72 ST.-SW 52 AVE.BESTEIRO ATTEMPTED TO TURN LEFT AT A HIGH SPEED
AT SW 52 AVE( TRIUNFO STREET) AND STRUCK A CONCRETE CORAL GABLES STREET MARKER..
OFC AGUTAR WAS UNABLE TO GET BESTEIRO TO VOLUNTARILY EXIT HIS VEHICLE AND HAD TO USE HIS "ASP "TO BREAK
THE DRIVERS WINDOW TO EXTRACT HIM.BESTEIRO THEN PUT HIS VEH.IN REVERSE IN AN ATTEMPT TO FLEE BUT WAS
REMOVED FROM THE VEH.AND TAKEN INTO CUSTODY.OFC.AGUTAR SUSTAINED MINOR SCRATCHES TO HIS LEFT WRIST
CAUSED BY BESTEIRO STRUGGLING ON THE GROUND IN AN ATTEMPT TO AVOID ARREST.BESTEIRO SUSTAINED MINOR
SCRATCHES TO HIS FACE FROM THE BREAKING OF THE VEH.GLASS WINDOW.MDPD FIRE RESCUE ENG. #14 RESPONDED AND
TREATED BESTEIRO ASKING HIM SPECIFICALLY IF HE HAD ANY OTHER INJURIES TO WHICH HE STATED "NO ".
(RESCUE CAPT. RIVERON,ALARM #FD022704).PHOTOS OF HIS FACIAL INJURIES,PHOTOS OF THE CRIME SCENE,ACCIDENT
SCENE,AND OFC.AGUTARS INJURY WERE TAKEN BY SGT.BARZOLA AND THE CD CONTAINING 27 PHOTOS WAS IMPOUNDED
AT SMPD PROPERTY LOCKER #3, PROPERTY RECEIPT ISSUED.BURGLARY TOOLS WERE ALSO IMPOUNDED SMPD PROPERTY
LOCKER# 3,RECEIPT ISSUED.CORAL GABLES PD RESPONDED TO HANDLE THE ACCIDENT INVOLVING BESTEIROS VEHICLE
WHICH WAS TOWED TO WESTBROOK IMPOUND,TOW SLIP ISSUED. CGPD ACCIDENT C #2008008270,OFC.COLEMAN ID #8420.
EDDIE BESTEIRO WAS TRANSPORTED TO.SMPD BY OFC .WAGNER. ELVIS TRANSPORTED TO SMPD BY OFC.AGUTAR..THE
OWNERS OF VEH. #2 AND #3 RESPONDED TO THE SCENE AND THE CD PLAYER WAS RECOVERED OWNER /VICTIM DALYS

TO, EDWARDS ADVISED THAT IT BELONGED TO HIS GRANDMOTHER. SERGEANT AGUTAR ASKED EDWARDS FOR CONSENT TO
SEARCH THE VEHICLE AND EDWARDS TOSSED THE KEYS TO HIM. AS SERGEANT AGUTAR BEGAN TO OPEN THE VEHICLE'S
FRONT DOOR, EDWARDS SPONTANEOUSLY UTTERED, "I DO GOT SOME WEED IN THE CAR THAT I WAS BRINGING FOR MY
FRIENDS." EDWARDS BEGAN ACTING VERY NERVOUS AND LOOKING AROUND IN ALL DIRECTIONS. WHILE SEARCHING THE
VEHICLE'S CENTER CONSOLE, SERGEANT AGUTAR DISCOVERED A CLEAR PLASTIC BAG CONTAINING NINE(9)
INDIVIDUALLY PACKAGED MARIJUANA BAGGIES (APPROXIMATELY 34.5 GRAMS). SERGEANT AGUTAR ADVISED OFFICER
WEISSBERG TO TAKE EDWARDS INTO CUSTODY, AT WHICH POINT EDWARDS TURNED AROUND AND FLED ON FOOT OVER AN
ADJACENT BACKYARD FENCE. A SEARCH OF THE VEHICLE ALSO REVEALED ONE(1) AK MAGAZINE
(7.62 X 39MM) , WITH EIGHT LIVE ROUNDS, UNDER THE DRIVER'S SEAT; ONE (1) SMITH & WESSON SIGMA PISTOL
MAGAZINE (.40 CAL) WITH 14 LIVE ROUNDS INSIDE, ON THE FRONT PASSENGER SEAT FLOOR BOARD; AND ONE (1)
CENTURY INTERNATIONAL ARMS MODEL "AK PISTOL" (7.62 X 39MM) , IN THE VEHICLE'S TRUNK, WITH ONE LIVE ROUND
IN THE CHAMBER.
A RECORDS CHECK OF THE VEHICLE'S TAG REVEALED THE REGISTERED OWNER'S ADDRESS OF BEING 6600 SW 64 AVE.
SERGEANT AGUTAR RESPONDED TO THAT ADDRESS AND MADE CONTACT.WITH EDWARD'S GRANDMOTHER, HARRELL. SHE
PROVIDED SERGEANT AGUTAR WITH EDWARD'S INFORMATION, WHICH WE ATTESTED OF BEING TRUE THROUGH HIS DHSMV
D.A.V.I.D. PICTURE. THE REMAINING THREE MALES, STOKES, HOLMES, AND JOHNSON WERE FIELD INTERVIEWED AND
RELEASED ON SCENE. PROPERTY RECEIPTS WERE COMPLETED AND THE MARIJUANA WAS PLACED INTO EVIDENCE LOCKER
#3 BY SERGEANT AGUTAR. THE FIREARM, MAGAZINES, AND BULLETS WERE PLACED INTO PROPERTY FOR SAFE KEEPING.

TO STOP. AT THIS TIME WRIGHT LOOKED UP AT ME, MAKING EYE CONTACT AND BEGAN RUNNING SOUTHBOUND

AVE, TOWARDS SW 66 ST. I ORDER WRIGHT SEVERAL TIMES TO STOP RUNNING, BUT WRIGHT REFUSED AND KEPT ON
RUNNING TOWARDS SW 66 ST.' I GOT IN MY VEHICLE AND HEADED IN THE DIRECTION THAT WRIGHT RAN. I OBSERVED "`..
WRIGHT RUNNING EASTBOUND TOWARDS SW 58 PL, WHERE HE MADE A RIGHT TURN AND KEPT ON RUNNING SOUTHBOUND
TOWARDS SW 68 ST, THROUGH A PARKING LOT OF A HOUSING DEVELOPMENT. AT WHICH TIME I EXITED MY VEHICLE
AND BEGAN A SHORT FOOT CHASE WITH WRIGHT. I CAUGHT UP TO WRIGHT WHERE I WAS ABLE TO REDIRECT HIM TO
THE GROUND. WHILE I WAS TRYING TO GIVE MY LOCATION, WRIGHT SLAPPED THE RADIO OUT OF MY HAND, CAUSING
THE RADIO TO FALL AND BREAK, (DEPRIVING ME THE MEANS OF COMMUNICATION). AT WHICH TIME WRIGHT KEPT ON
RESISTING ME BY ATTEMPTING TO STRIKE ME IN ORDER TO GET ME OFF OF HIM. I WAS FINALLY ABLE TO CONTROL
WRIGHT IN ORDER TO PLACE HIM INTO CUSTODY. PICTURES OF THE RADIO WERE TAKEN BY SGT. JAMES. THE BROKEN
RADIO BATTERY AND PICTURES WERE IMPOUNDED AND PLACED INTO LOCKER #8 BY SGT. JAMES, PROPERTY RECEIPT
COMPLETED. I TRANSPORTED WRIGHT TO SMPD TO FOR PROCESSING AND THEN TO T.G.K. THE DAMAGE TO RADIO
BATTERY IS APPROXIMATELY $150.00.
NOTE: A PRE —FILE WAS SET ON MAY 13, 2008 AT 0600 HOURS WITH ASA BETTENDORF.

CASTELLANOS TO STEP BACK. CASTELLANOS THEN PLACED HIS RIGHT HAND ON OFC. RODRIGUEZrS LEFT SHOULDER AND
PUSHED HIM BACK. AT THIS TIME OFC. RODRIGUEZ AND I REDIRECTED RODRIGUEZ TO THE GROUND. WHILE I WAS
ATTEMPTING TO PLACE HANDCUFFS ON CASTELLANOS HE KEPT ON BEING COMBATIVE, ATTEMPTING TO PUSH ME OFF OF
HIM AND REFUSING TO ALLOW ME TO PLACE THE HANDCUFFS ON HIM. WHILE ATTEMPTING TO PLACE CASTELLANOS
UNDER ARREST HE GOT UP ON HIS HANDS AND KNEES ON SEVERAL OCCASIONS, PREVENTING OFC. RODRIGUEZ AND ME
FROM CONTROLLING HIS ARMS. CASTELLANOS KEPT ON FLAILING HIS ARMS AND ATTEMPTING TO GET UP, AND
ATTEMPTING TO GET OFC. RODRIGUEZ AND ME OFF OF HIM. AS OFC. RODRIGUEZ AND I ATTEMPTED TO CONTROL
CASTELLANOS, SGT JAMES (ID #246) WHO RESPONDED AS A BACK -UP OFFICER, WAS ABLE TO CONTROL HIS LEGS. AT
THIS TIME OFC. RODRIGUEZ AND I WERE ABLE TO CONTROL HIS ARMS AND PLACED HIM UNDER ARREST. DURING THE
STRUGGLE CASTELLANOS RECEIVED A BRUISE AND A SMALL LACERATION UNDER HIS RIGHT EYE. CASTELLANOS WAS
TRANSPORTED TO SMPD FOR PROCESSING. WHILE AT SMPD CASTELLANOS REQUESTED FIRE RESCUE. ENGINE 14 (LT.
GONZAT Z) RESPONDED TO TREAT HIM. CASTELLANOS WAS CLEARED OF THE INJURY BY LT. GONZALEZ. A ROUTINE
CHECK REVEALED THAT CASTELLANOS, PULSE WAS HIGH. CASTELLANOS WAS TRANSPORTED TO SOUTH MIAMI HOSPITAL
BY RESCUE 14 (CPT. GONZALEZ) . CASTELLANOS WAS RECEIVED AT THE HOSPITAL BY R.N. YANETTE DAVIS. AFTER
CASTELLANOS RECEIVED A MEDICAL CLEARANCE HE WAS TRANSPORTED TO TGK BY OFC. WEISSBERG.

WHILE ON THE GROUND VALENCIA STARTED TO KICK AND ATTEMPTED TO PUNCH ME AND OFC. CUBELA. VALENCIA ALSO
ATTEMPTED TO BITE ME ON MY HAND AND FOREARM AREA. HE MADE NUMEROUS ATTEMPTS TO FLIP ME AND OFC. CUBELA
OVER, WHICH CAUSED MY LEFT ANKLE TO BE PINNED UNDER HIS BODY, CAUSING IT TO BE INJURED.I ADDITIONALLY
SUSTAINED ABRASIONS TO MY LEFT HAND AND RIGHT FOREARM. OFC. CUBELA SUSTAINED AN INJURY TO HIS RIGHT
KNEE AND RIGHT SHOULDER WHILE RYING TO PREVENT VALENCIA FROM KICKING US. THROUGHOUT THE ENTIRE r
INCIDENT VALENCIA CONTINUED SAYING THAT HE HAD AIDS AND THAT WE WERE GOING TO DIE. HE WAS EVENTUALLY
HANDCUFFED AND PLACED IN OFC. ROJAS' POLICE VEHICLE, AND HE WAS SUBSEQUENTLY TAKEN TO LARKIN HOSPITAL.
SGT. GRIFFIN RESPONDED TO LARKIN HOSPITAL AND TOOK PHOTOGRAPHS OF VALENCIA AND ME AND THEY WERE PUT
INTO LOCKER #3 BY SGT. AGUTAR. SILVA ADVISED ME THAT FELLOWSHIP HOUSE WAS IN POSSESSION OF VALENCIA'S
MEDICAL RECORDS AND VERIFIED THAT HE IS HIV POSITIVE.
INJURY LOG ENTRIES FOR THE INJURIES TO OFC. CUBELA AND ME WERE DONE BY SGT. GRIFFIN AND HUMAN
RESOURCES WAS CONTACTED BY'HIM AS WELL. AN EXPOSURE INCIDENT REPORT WAS COMPLETED AS WELL.
STAFF NOTIFICATIONS WERE MADE.

DADE COUNTY ASSOCIATION OF CHIEFS OF POLICE
ELECTRONIC CONTROL DEVICE MODEL POLICY
PHILOSOPHY:
Electronic Control Devices (ECD). are issued to officers for utilization to neutralize potentially
combative subjects, as an alternative to physical control in arrest or custodial situations. Only
those employees who have completed the approved electronic control device user certification
course may utilize the electronic control device.
TRAINING:
Electronic Control Device Certification
-Basic certification for the use of an ECD shall consist of no less than the manufacturer's
minimum recommendation.
- Re- certification shall be conducted once a year.
- Training topics for both the basic certification and annual re- certification should consist of,
but are not limited to, the following topics:
A) Manufacturer's Recommendations / Maintenance
B) Deployment /Use / Documentation
C) Response to Resistance Matrix Levels and other Tactical Options
D) Electronic Control Device Retention and Transition Drills
E) Scenario Based Training
F) Recognition of Symptoms: Excited Delirium
- Only current Manufacturer Certified Instructors are eligible to instruct officers in the use of
an ECD.
DEPLOYMENT:
- An officer's response level to subject resistance should always depend upon subject/officer
factors such as age, size, weight, and the subject's apparent ability to physically challenge the
officer or do harm to himself or others, balanced against the seriousness of the incident.
- An officer's decision to deploy the ECD shall involve an arrest or custodial situation wherein
the subject is escalating resistance from passive physical resistance towards active physical
resistance.
- The primary purpose in the decision to deploy the ECD is to prevent a continuing escalating
subject resistance or violence and to minimize injury to both the officer(s) and subject(s). The
ECD shall not be used as a tool of coercion to intimidate an individual into compliance with
simple requests or directives by an officer.
-Prior to deployment of the ECD, officers must take into consideration environmental factors
which may contribute to serious injury. These factors, include but are not limited to; subjects
standing on or near the edge of a roof, stairwells, next to a window or body of water.
- No policy or guideline can anticipate every situation that officers might face, but in general
terms, the following deployment procedures are established. An ECD can be utilized under the
following circumstances:
- When the subject is exhibiting threatening body language associated with verbal threats or
refusing to comply with the officer's instructions, and the subject has the apparent ability to
physically challenge the officer. Threatening body language includes, but is not limited to:
a. blading the body
b. assuming a "boxer stance"
c. circling the officer
d. moving the hands from open to closed, forming a fist, etc.
-When a subject makes physically evasive movements to defeat an officer's attempt to control.
This may be in the form of:
a. bracing or tensing of the body
b. attempts to kick, push, or pull away
c: not allowing the officer to get close to him /her
- When a subject makes overt, hostile, attacking movements, which may cause injury, but are
not likely to cause death or great bodily harm to the officer or others.
- When subject makes overt, hostile, attacking movements with or without a weapon with the
intent and apparent ability to cause death or great bodily harm to the officer or others.
- When lesser force options may be ineffective.
SPECIAL CONSIDERATIONS:
- Flammable Liquids: Officers shall not discharge an ECD near flammable liquids or fumes.
The ECD shall not be discharged if flammable self- defense spray has been deployed.
- Pregnancy: The ECD should not be used .on women who are known to be pregnant and /or
women who appear to be pregnant unless exigent circumstances are present.
- Handcuffed Subjects: An officer should not utilize an ECD on an in- custody handcuffed
subject unless exigent circumstances exist.
- Fleeing Subjects: An officer's decision to deploy the ECD on fleeing person(s) who are
subject to arrest, should be predicated upon the totality of the circumstance and the
considerations outlined above.
- Baker Act: An officer's decision to deploy the ECD on a subject whom officers are attempting
to take into custody pursuant to the Baker Act, should be ' predicated upon the subject clearly
exhibiting behavior that would cause harm to themselves or others and who has the apparent
ability to carry out those intentions.

- Vehicles: The ECD should not be deployed on subjects in physical control of a motor vehicle
while the engine is running.
- Animals: ECD's can be used on animals in circumstances where the use of such device, is
necessary for the safety of the officer, public or the animal.
TREATMENT:
Aftercare Procedures:
- Officers shall adhere to the following procedures when deploying an ECD, where probes or
drive stun impacts a subject.
A. If there is a secondary injury or complaint of injury or other medical necessity (i.e.; alcohol
/ drug induced state) Fire Rescue will be requested and advised that the subject has been
impacted by an ECD.
B. If an officer is uncomfortable removing probes anywhere on the body the officer may
request Fire Rescue to respond and medically assess the situation. (Note: It may be Fire
Rescue's policy not to remove any probes, but they should assess the patient and assist in
getting transportataion to a medical facility for removal. If transported to a medical facility an
officer shall remain with the prisoner.
1. Only certified ECD user officers will remove probes, using department issued safety
gloves. An adhesive bandage will be applied to the affected area if necessary.
2. Any adult prisoner impacted by an ECD shall be transported to a detention facility via
Ward "D" of Jackson Medical Center. Upon written medical release the prisoner will be
transported to a detention facility.
3. Any juvenile prisoner impacted by an ECD shall be transported to a hospital emergency
room for evaluation. Upon written release from the medical facility the juvenile prisoner
shall be transported to the JAC. Note: Juvenile Prisoner Protocol is currently being
researched by the Miami -Dade Police Department.
DOCUMENTATION:
- ECD's that have a record storage function which maintain records of the time and date
the ECD is fired are recommended. This data provides complete and accurate
documentation on each firing. These records provide invaluable information in the event
of an allegation of the misuse of the device.
- Officers discharging an ECD shall notify.the supervisor that the device was deployed.
The officer shall document the incident pursuant to their department's policy. This
documentation should clearly articulate the circumstances surrounding the ECD
deployment as well as any additional discharges. Supervisors should also document the
incident pursuant to departmental policy. The specific minimum information to be
contained in the ECD documentation will be left with the individual agency.

- Photographs should be taken of the probe penetration sites and any secondary
injuries. The photos should be marked and included with the ECD documentation
packet. The officer will request Fire - Rescue to examine the person if the probes cannot
be removed. because of an unusual penetration, or if penetration is made to the area
above the clavicle, groin, or sensitive area of the breast. Fire - Rescue shall also be
notified if any secondary injuries that require examination. If practicable, photographs
should be taken of those areas.
- Officers shall not remove the probe(s) if the probes are located in the sensitive areas
mentioned above. If Fire - Rescue is called to the scene, they will make the determination
if the person should be transported to a medical facility for further evaluation. If this is
necessary, appropriate medical clearance procedures will be utilized prior to transporting
the subject to a detention facility.
- Officers removing the probe(s) will wear protective gloves to protect against any
biohazard transference.
- The cartridge will be collected from the scene and impounded in accordance with
individual agency policy. When collecting the cartridge, the wires shall be wrapped
around the cartridge. The probes shall be inverted into the portals they originally were
deployed from (this will prevent the sharp ends from penetrating the packaging). Tape
shall be placed over the portals to secure the probes. If practical, the coded material
shall be collected from the scene and impounded.
- Officers who have deployed the ECD will submit their device in accordance with
agency policy for downloading the information from the ECD program. This report will
-be printed and included with the ECD documentation packet. When more than one
officer is on a ECD deployment scene, consideration should be given to downloading all
officer's ECD. Further, monthly or random data port downloads, should be considered
for review.
- The officer's and supervisor's ECD documentation packet will be forwarded and
reviewed'by the chain of command. Consideration' should be given to these reports also
being reviewed by ECD instructors and /or ECD supervisors. A process for semi - annual
or annual reviews of ECD documentation packets should also be considered.
ADMINISTRATIVE FUNCTIONS:
ECD Program Supervisor (s):
-An ECD Program Supervisor (s) should be appointed to handle ECD related functions. These
duties may include, issuing the ECD units / cartridges, record keeping, training, documentation
review, etc.
Issuing / Replacement of Cartridges:
- The Program Supervisor (s) shall be responsible for logging in all cartridges purchased by the
department via the bar coded serial number listed on each cartridge.
- Each officer should be issued two (2) cartridges upon the successful completion of their ECD
training. Upon receipt of the ECD cartridges, the assigned officer shall write their police
department ID number and initials on the cartridge.

ensure it is in working order. Officers shall not use any equipment related to the ECD that has
not been issued or approved by the department.
- If at any time an officer or supervisor determines that an electronic control device, battery or
cartridge is defective and /or damaged, that unit or part shall be taken out of service
immediately. The ECD, or part, shall not be used until such time as it has been repaired and /or
replaced by the Program Supervisor or an ECD Instructor. In the event the unit, or part, cannot
be repaired or replaced immediately, the affected officer shall be issued a spare unit or part if
possible.
-Any officer with a defective or damaged ECD, or part, shall notify his /her supervisor
immediately. The supervisor shall take possession of the electronic control device, or part, and
retain possession of it until such time as they can turn it into the Program Supervisor, or an
Electronic Control Device Instructor, to have the equipment repaired or replaced. Once
repaired, or replaced, the officer will return any spare equipment.
- Prior to any ECD being sent for repairs, a final download of the data shall be made for record
purposes.
Testing:
-Only a properly functioning and charged ECD shall be carried in the field. In order to insure the .
ECD is functioning properly, officers will conduct a routine test / inspection of their ECD based
on the manufactures' recommendations and individual department policy. All tests will be
documented at the time of the test based of the department's policies.
-These tests will be conducted in a safe location out of public view according to manufacturer
specifications.
-In the event an officer has to test their ECD, other than the routine test, the officer shall first
notify the on -duty supervisor. In the presence.. of the supervisor, the appropriate testing
procedure will be followed and documented by the supervisor according to the department's
policy.
Review:
- If an ECD has been deployed against a subject, the ECD Supervisor ('s) should review the
documentation to determine if all procedures have been followed, and that the date and time of
deployment from the ECD correlate with the information contained in the reports and /or
documents. Once reviewed, the Program Supervisor ('s) should issue documentation that
supports his / her findings. This documentation shall be reviewed and forwarded by the Chain
of Command, based on departmental policies.
