APPLICANT'S APPEAL
The Land Development Code Section 20- 6.2(A) provides that a decision or recommendation
made by the ERPB may be appealed to the City Commission by the City administration, the
applicant, or an interested citizen. Attached is an appeal filed by the applicant, MR Properties,
• Inc., dated April 8, 2008. The City Commission has 60 days from the filing date to hear the
appeal and enter a decision (reverse, affirm or modify the ERPB decision). The filing of the
appeal stays all actions or proceedings related to the development of the property.
BACKGROUND
At its March 4, 2008 meeting, the Environmental Review and Preservation Board (ERPB)
disapproved the applicant's request for the installation of two flat signs for the respective
restaurant storefronts located at 5829 SW 73 Street (Item No. ERPB -08 -015). The permanent
signage request is located in the Specialty Retail "SR" zoning district, which permits that
additional signage, not expressly permitted under the regular signage code, to be approved by the
ERPB. Pursuant to Section 20- 4.3(L) of the Land Development Code, additional signage for this
zoning district is permitted as follows:
(L) Additional Signage: Other types of signs, not expressly permitted by regulations stated in
Section (20- 4.3(1), may be approved by the Environmental Review and Preservation Board
(ERPB) when the following condition are met:
1. That the proposed sign is not prohibited by Section 20- 4.3(E);
2. That the proposed sign conforms to the South Florida Building Code and other code
regulations, as applicable;
3. That the proposed additional sign on the building does not occupy more than 30% of the
fagade on -which it is proposed to be installed or more than 20% of any window area;
4. Detached signs may be permitted on any commercial property with the approval o the
Environmental Review and Preservation Board, including detached signs that exceed the
permitted location and height standards set forth in Section 20- 4.3(1).

• ERPB ACTIONS:
The ERPB reviewed the Signage Master Plan for the South Miami Municipal Parking Garage on
July 18, 2007 and approved it with conditions. The ERPB approved the sign locations as well as
signage relating to parking, elevator, exit, and enter. The Board however, disapproved the
"CARSIDE CARRY -OUT" and "TAKE- AWAY" sign because the ERPB agreed the two signs
were excessive and redundant and not aesthetically pleasing. On February 19, 2008 the
applicant's request for two specific takeaway flat signs was reviewed by the ERPB and deferred
in order to allow the applicant the opportunity to reconsider the signage location, and design. The
applicant resubmitted the proposed signs on March 4, 2008 and was denied by the ERPB.
SPECIFIC APPEAL ITEMS:
The appellant has claimed that the ERPB recommendation of March 4, 2008, will adversely affect
the business potential for both " Carrabbas Italian Grill" and "Outback Steakhouse" due to the
lack of inadequate signage. Furthermore, the appellant feels that the building is not aesthetically
pleasing without the signs.
STAFF OBSERVATIONS:
1. In order to properly review the appeal, attached to this report is the ERPB disapproval
letter, application, staff report, meeting minutes, sign details, and photographs presented
to the ERPB on March 4, 2008 for Item No. ERPB-08-015. The applicant requested one
"CARSIDE CARRY -OUT" flat sign for Carrabba's restaurant measuring 1' -67 x 3' -11"
in length, which equal a total of 5.9 square feet. The other request was for one "TAKE-
AWAY" flat sign for Outback Steakhouse, measuring 8" x 50" in length, which equal 2.8
• square feet. The ERPB ruled that although both signs do not exceed the flat sign
regulations as guided under Section 204.3(I), limiting to 20% or no more than 200
square feet of any fagade, the signs are in excess and are not aesthetically pleasing for the
existing wall space above the storefront eyebrow.
2. Enclosed is additional documentation pertaining to the proposed sign application dated
February 19, 2008 (ERPB -08 -015). It includes the ERPB letter of denial, minutes,
application, sign details and photographs. The Planning Department did observe that the
two proposed flat signs do not exceed the dimensional guidelines pursuant Section 20-
4.3(I) of the Land Development Code and therefore on both the February 19, 2008 and
the March 4, 2008 staff reports, recommended that the ERPB decide the issue.
RECOMMENDATION
It is recommended that the City Commission affirm the ERPB decision and deny the application.

The applicant is requesting final approval for the exterior "Carry-Out" and "Take- Away"
signage installation for Carrabba's Italian Grill and Outback Steakhouse restaurants.
STATUS UPDATE:
With the intent to allow the applicant the opportunity to propose additional signage
which will be in character with the Hometown District, the Board deferred the signage
• installation at its February 19, 2008. The applicant has opted 'not to redesign the
proposed signage and is requesting that the Board provide him a final recommendation.
BACKGROUND STATUS:
•
At its July 3, 2007 meeting the Board deferred the signage installation request with the
recommendation that the applicant provide a signage Master Plan for the South Miami
Municipal Parking Facility. Preceding the request, the Board reviewed the Signage
Master Plan on July 18, 2007, and approved the request with conditions. The Board
approved the signage relating to the parking facility as well as the location for each sign
as presented. Note that the flat signs for the restaurants ( Carrabba's and Outback
Steakhouse) were approved, however, the Board agreed not to approve the "Carry-out
and Take - away" signs because they felt the signs were redundant and abundant.
Pursuant to section 20- 4.3 -(5) All Other Zoning, the Board has set precedence for the
purpose of regulation, that there shall be considered to be only four (4) facades to any
building where one flat sign per fagade shall be permitted.
STAFF ANALYSIS:
The applicant is requesting to install two additional flat signs to the restaurants
Carrabba's Italian Grill which will read "CARSIDE CARRY -OUT" and Outback
Steakhouse which will read "TAKE- AWAY ", located at the ground floor of the South
Miami Municipal Parking Facility, facing SW 73 Street. Pursuant to Section 20- 4.3(L),
Land Development Code, signage is permitted as follows:

Signage Installation

The applicant's signage proposal includes one illuminated flat sign per restaurant (two
signs in total) that will be flush with the fagade. The first proposal labeled "A" measures
1' -6" in height and 3' -11" in length. The second proposal labeled "B" will also be an
illuminated flat sign measuring 8" in height and 50" in length. Please refer to the
signage set of plans for location, elevations, and specifications of the proposed signs.
Note that the Board has previously ruled that these signs are not in character with the
Hometown District leading to their disapproval during its July 18, 2007 Board meeting.
Under the current circumstances it is staffs position to also acknowledge the Board's
previous decision and make no recommendation, therefore providing the Board the
opportunity to exercise their expert knowledge.
Contingent upon the Board's approval, staff will require the applicant to meet the
following conditions:
1. No electrical wiring /conduit exposed; and,
2. Any comments and concerns from the Board.

that the applicant should consider either the Paurotis Palm or McArthur Palm because a single
trunk tree would not be sufficient to provide additional screening. In response to whether the
application was submitted prior to the two -story ordinance, Ms. Cabrera - Hernandez responded
that the application was not submitted prior to the ordinance.

Ms. Mark noted that the proposed signage is not in character with the South Miami Downtown
District. She recommended that the applicant consider another alternative.
Ms. Mark informed the Board that a Fire Department representative advised her that the
restaurant required a third exit for fire hazard purposes. She further added that the inclusion of
the additional "Take- Away" signage could confuse patrons should an emergency present itself.
Ms. Mark was concerned that should the proposed signs be placed on its proposed location,
patrons may consider the restaurant as a separate establishment and therefore, not use that door
as an exit under an emergency. The Board agreed that additional signage on the door would
suffice as a point of reference to the takeaway restaurant.

Mr. Trautman suggested that the letter length shall be reduced in order for the sign to equally
accommodate both sides. He also recommended changing the height in order make both sides
proportional. Mr. Fernandez suggested that the letter size should be reduced from 15 inches to
12 inches in height and the length from 17' -6" inches to 14 feet.
Mr. Bedell recommended that the proposed sign "South Miami Municipal Garage" should be
changed to "South Miami Parking." He was concerned that the word Municipal could be
• deceptive and may cause confusion. The Board however further discussed the proposed sign and
agreed that once "Municipal Garage" is replaced with "Parking" the change in height and length
will not be necessary, thus making the signs proportional.
Motion: Mr. Bedell moved to grant final approval for the proposed signage installation with the
condition that the wording "South Miami Municipal Garage" be changed to read "South Miami
Parking." He further added that the letter size shall remain the same. Mr. Trautman seconded.

Ms. Mark questioned if the wall is consistent with the previously approved physical barrier

12' live oak specimen instead of a Black Olive.
Ms. Morales- Fernandez questioned whether or not the tree permit sets height requirements
based on the size of the tree which is being removed. Mr. Lightfoot responded that the City
Arborist usually recommends a height of twelve feet or more of a hardwood native as
replacement standards.
Motion: Mr. Bedell moved to approve the application with the conditions that the applicant
incorporate staff's conditions and the Board's recommendation that the live oak tree must have a
minimum height of 12 feet in height and shall be located along the side walk (just north of the

for the Board to take final action. Based on the final decision the applicant will evaluate the
decision and decide which step to proceed with.
Ms. Morales- Fernandez suggested deferring the application.
Mr. Trautman commented that the previous application was deferred in the last meeting so that
the applicant can resubmit the application with different signage proposals suitable with the
character of the neighborhood.
Motion: Ms. Mark moved to disapprove the application as presented. Mr. Trautman seconded.

REMARKS:
Ms. Mark advised that in the previous meeting she questioned the applicant, MR Properties Inc.,
if he will be using a free standing sign regarding the free standing sign and the applicant
indicated that the free standing sign was not going to be used. It was brought to the Board's
. attention that a free standing sign is now located in an empty tenant space that is 8 feet tall by 2
to 2 1/2 feet wide with five signs.

Applicant present: George McArdle
Mrs. Cabrera read the item into the record.
Action: Mr. McArdle stated that when this item first came before the board, we were asked to
come back and present an overall signage program that the tenants would fit within as well as
modify the actual signage for the garage. The tenants were notified that they would have to
comply with the terms of the building signage, and that if they would like to install any
additional signage, they would have to come back individually to the Board. Mr. McArdle then
mentioned that when this item previously came before the Board, there was a concern regarding
the uniformity, the subtly of the signs. The Board was also concerned with the distance of how
the parking signs projected from the building. Mr. McArdle introduced Lou Fenkell from Art
Sign Company to answer any questions that the Board might have.
Mr. McArdle described the sample of push through letters that Mr. Fenkell brought to the
meeting. He stated that the lettering is lighting from behind, creating a silhouette of lighting
behind the letters. In an effort to make the entry and exit signs more subtle, Mr. McArdle said,
instead of making the whole sign either red or green, we decided to go with the overall program
of making just the letters red and green.
• Mr. Trautman asked the question of whether there are too many � . signs on the building.
To answer Mr. Trautman's question, Mrs. Cabrera stated that this signage master plan is more
specific that what was requested by the Board. There is also a concern regarding the service and
function from each restaurant that may or may not require the carryout and takeaway signs. Mrs.
Cabrera concluded by questioning who would be using the benches by the storefront along the
sidewalk outside of each restaurant.
Mr. McArdle clarified that the benches are for patrons waiting to be seated at the respective
restaurant. There are parking spaces in the front of each restaurant that are allocated for both the
valet and carryout service. Mr. McArdle then went on to explain the specifics behind' the
carryout service.
Mr. McArdle stated that that they wanted to show the Board that they are giving the tenants some
individuality in the letters while complying with the Board's overall recommendation for a sign
program.
Mr. Balli stated that while the selection of materials for the signs and awnings are appropriate,
there is a problem with Carrabba's and Outback Steakhouse's carryout signs i.n terms of the
structure of the sign. The signs are at the edge of the cantilever canopy, allowing the braces from
the backings to be visible to the public.
• Agreeing with Mr. Balli's comments, Mr. Trautman asked for clarification on what Mrs. Cabrera

• thought was excessive about the carryout signs. Mrs. Cabrera questioned if the function of the
carryout and takeaway signs are necessary because the main entrances to the restaurants and the
carryout service function are in close proximity to one another. Mr. McArdle stated that there is a
second door that would be used for the carryout and takeaway service and explained the carryout
and takeaway service. He then went on to say that there would be spaces in front of the
restaurants allocated specifically for the carryout and takeaway service. Mr. Trautman stated that
there should be a lower amount of signage on the building and suggested that letters be placed on
the door in lieu of the carryout and takeaway signs.
Mrs. Cabrera mentioned that there are two (2) retail stores that face SW 73`d Street on the east
end of the street and only one of the two stores has an eyebrow. She inquired as to how signage
would be installed on the storefront that is missing the necessary eyebrow.
Mr. McArdle stated that those two retail locations are going to be combined into one storefront,
which would only require one sign. The sigh would either be mounted on the canopy or directly
on to the building.
Mr. Trautman asked the question of how far the canopy extends from the building. Mr. Fenkell
answered by stating that the canopies would extend about three to four feet from the building
approximately. Mr. Trautman then asked if the sign were pushed back to the face of the building,
would it still be visible.
• After Mrs. Cabrera offered the possible solution of hanging the sign from the canopy, it was
decided that it would be hang to low. Mr. Fenkell then stated that the idea of the canopy is to
provide a form of articulation at the street level while the sign would provide a lighting element
above the canopy.
Mr. Bedell stated that as a master plan, it really does not address the signage of the retail spaces.
Mrs. Cabrera referred the Board to the first page of the proposed master signage plan which
consists of the retail /tenant signage information. Mr. Fenkell then stated that the type of signage
will be uniform for all tenants. Afterwards, Mr. Bedell then stated that he would prefer to see a
visual representation of the locations of the signage that the tenants will use. Mr. McArdle then
-pointed out the locations of the tenant signage.
Mr. McArdle stated that they geared the sign size to the size of the canopy. Mr. Trautman then
stated that we could approve the largest size for the signs which would be the signs for Outback
Steakhouse, Carrabba's and RA Sushi.
Mr. McArdle asked Mr. Fenkell to address the concern regarding the visibility of the brackets.
Mr. Fenkell responded by saying that a possible solution would be to place a solid anodized
aluminum cover over the sides of the sign. Another solution would be to wield upright pipes to
the canopy overhangs and slide the cabinet down the pipes. Mr. McArdle then stated that the
solution of placing the cover on the sides of the sign would be better as it would avoid any
possible structural issues if they were to use the second possible solution.
• Mr. Trautman asked whether the 48 square feet that is proposed for the largest of the signs is ok.

• Mrs. Cabrera responded by saying that the sign exceeds the regulations as set forth in the Land
Development Code and cannot be classified as a flat sign. Mr. Trautman asked if this sign could
be classified as a marquee sign. Mrs. Cabrera stated that the signs fall under Section 20- 4.3(H)(4)
from the Land Development Code. She then read the section into the record. Mr. Trautman asked
if there are any renderings that show the signs on them. Mr. McArdle stated that at this time,
there aren't any renderings that show the signage on the building.

Mr. Balli recommended that the application should be divided into two separate parts. Mrs.
Cabrera then mentioned that the locations would be approved, and that the specifications of the
signs would come before the Board at later meetings.
Motion: Mr. Trautman made a motion to approve the application for signage that approves the
location and the sign type for the following signs: parking and the elevator sign, the enter and
exit sign, the do not enter sign, the exit only sign, the park and valet signs and the location of the
signs for the tenants. However, the actual shape and nature of the tenants' signs will need further
study and will have to come back before the board. Also, the carryout/takeaway signs are to be
deleted from the application. Mr. Balli seconded the motion.
After the motion and approval, Mr. McArdle asked whether there will be one uniform type of
tenant sign and if the Board would like to see the specifics of those signs at a future meeting
meeting. The Board agreed.
Mr. Fenkell spoke about the use of the carryout and takeaway signs. Mr. Trautman stated that the
restaurant should be able to direct the patron to the correct location of the carryout service. Mr.
Rivera then stated that the cover on the meters could specify either carryout/takeaway or valet.
Mr. McArdle stated that he is going to have to contact Outback Steakhouse and Carrabba's to see
how they accommodate the issue of not having a carryout/takeaway sign. Mr. Bedell stated that
normally there is a door on the side of the building that is meant for the carryout/takeaway
service. In this case, the two entrances are on the same fagade.
