Request:
For directive on $12,100 Pension Attorney's invoice submitted by the Pension Board
Chairman (Mr. Bradley Cassel).
Action Taken:
Last month, a copy of the attached $12,100 invoice was delivered to my office by Mr.
Cassel with a request to pay the Pension Board attorney, Sugarman & Susskind, for
the work performed in preparing the ordinance to qualify the pension. Following my
review of available records and the invoice, I have determined that:
• Prior approval was not secured through the City Commission for the services;
• The former City Manager did not approve the services;
• The expense was not budgeted; and
• The invoice is addressed to the Pension Fund.
However, according to the attached e-mail dated Wednesday, June 11, 2008, Mr.
Cassel stated that the City Commission instructed the Pension Attorney to do the
work doing the February 6, 2007 City Commission meeting. I have reviewed that tape
of the February 6, 2007 City Commission meeting and I could not conclude that the
City Commission approved/ directed the work. I have attached a copy of the Summary
Agenda for the February 6, 2007 meeting and video CD of the meeting for your review.
In addition, I have secured the attached memorandum from Jeanette Enrizo, Human
Resources Manager, to clarify the allegation that the City negotiated a $300 per hour
fee for the service. It is my understanding (and confirmed by Mr. Ken Harrison), that
the hour rate negotiated with the City was for General Services (whenever the City
Commission needs the Pension attorney to attend the Commission meeting to
clarify /address Pension issue(s)) and not for qualifying the pension.

Re: Invoice from Sugarman and Susskind addressed to the Pension Fund
I have reviewed the invoice that was addressed directly to the Pension Fund. Please note that at
no time did I direct the pension attorney — Ken Harrison to do any work for the city in the last
year. Whenever I have directed Mr. Harrison to come to the City to speak with the City
Commission it has been upon direction of the Commission and they have been made fully
aware. The invoice reflects almost a year and a half of work that I never approved or the City
Commission never approved or was made aware from anyone from the Board as to what was
being incurred.
Almost two (2) years ago the City Commission requested that the Pension attorney provide
information regarding possible pension alternatives. At that time, because the Pension attorney
worked for the Pension not the City he indicated that a separate agreement had to be made to
cover for him attending Commission meetings and/or any miscellaneous function (i.e. Merrick
issue). At no time did I ever direct or agree to have the Pension attorney do any work regarding.
the Restatement of the Pension Plan. It was clearly understood that any improvements to the
Plan had to be billed through the Pension Fund.
Mr. Harrison, directed the invoice (attached hereto) to the Pension Fund not the City. He clearly
understood that this work was done through the direction of the Board and therefore it should be
paid through the Pension Fund. I am not sure why they are submitting payment to the City
when at no time did I or the City Commission were advised of the hours spent or money
incurred for services rendered during this whole process of the Restatement.
Please advise should you need additional information in this regard.

The work was for qualifying the pension.
Please review the video of the Feb 6th 2007 commission meeting where the commission instructed the
attorney to do the work. I negotiated with Ken to honor the Pension Board retainer letter and the City saved
33 %.
If you would like I can have him cancel the current bill, re -issue one to the city at the $300.00 per hour that
you personally negotiated with him. (Do you want Ken to provide you with a copy of the fee letter that YOU
signed ?) Thereafter, he can sue the City if you refuse to pay his fees.
Kindly make sure this is on the next agenda and let's dispose of this invoice properly.

To provide update on the progress of Aquatic Complex and funding assistance offered by
the Alliance for Youth.
Action Taken:
Since receiving the Miami -Dade County Office of Community & Economic Development's
(OCED) environmental clearance for the design of our Aquatic Complex, we have begun
soliciting information from a group of municipal pools and water playgrounds in Palm
Beach, Broward, Dade, and Monroe Counties. See Exhibit "A ". The attached
spreadsheet (working copy) shows the pools to which we are comparing our potential
project and the costs associated with construction and operation of the sites. In
comparing the projects listed in Exhibit "A ", we noticed a glaring consistency that two
companies have designed and /or built a large majority of them. Attached are examples
of both of the companies' previous projects - See Exhibit "C ". Also attached herein,
please find a copy of the operating costs of three of the Aquatic Facilities that we are
comparing our project to. See Exhibit "D".
Our proposed Aquatic Complex remains consistent with Option (1) of the Murray Park
Master Plan Update that the Commission approved in 2004 which includes an 8 -lane
competitive pool and the relocation of the two outdoor basketball courts. See Exhibit "B"
The only glaring addition to the current project involves a highly solicited water
playground to be located in the area vacated by the basketball courts.
Our next step is to select the company which will provide the design of our aquatic
complex with the allocated OCED grant funds, with the intent to complete the design by
December, 2008. In addition, the Alliance for Youth has offered to assist the City with
fundraising for the construction of the aquatic complex and to solicit an endowment that
will cover the full or partial operating costs for the life of the pool. According to the
Alliance for Youth's representative (Mr. Dick Ward), they intend to create a foundation
that would perform the fundraising functions. As a result, the Alliance for Youth is
requesting for a formal acceptance of their fundraising assistance.

RDC designs, builds and renovates everything from
wading pools to themed aquatic complexes to Olympic -
size Myrtha pools. Myrtha pools are prefabricated,
stainless steel swimming pool systems that represent
the very latest in aquatic technology. RDC designed,
constructed and installed the first one ever in the
United States in Coral Springs, Florida in 1995.
RDC provides a long list of services to aquatic
complexes, including:

Teaching Pool
City of Coral Springs
The City of Coral Springs through a Design /Build
competition selected RDC to design and construct its
newest addition to their aquatic complex. This state -of-
the art learn -to -swim pool was made possible by a
Swim Central Grant from the Broward County "Safe
Parks and Land Preservation" bond issue, The learn -to-
swim pool is the first Myrtha Ceramic2 pool in Florida
and the first in the nation to incorporate "soft walk ".
The "soft walk" floor allows water aerobic and learn -to-
swim participants a more comfortable surface to play
and learn on.

Plantation Pool Repair
City of Plantation
The City of Plantation awarded RDC an emergency
contract to refurbish their existing 50 meter pool
and dive well. The project included the renovation of
the filter system to high rate sand, replacement of
all water carrying lines and the installation of the

RenovAction System is a state -of- the -art process
for refurbishing old pools. The renovation process

Since it's opening in February 2007, the new pool
at the Community Park Aquatic Center has made a
big splash with the swimming community! Accord-
ing to Mark Beaudreau, Recreation Manager for
Aquatics, "our citizens and staff are ecstatic over
our new pool. We are able to expand our learn to
swim program for school children, meet the training
and competition needs of our swim team and
provide a broad range of aquatic activities for the
entire community."
Thanks to a Broward County Swim Central Grant,
the City of Pompano Beach expanded the 52 year
old Aquatic Center with a new state of the art 50
meter x 25 yard Myrtha Pool built by Recreational
Design and Construction. The pool includes a state -
of- the -art filtration system, geothermal pool heating
and cooling, decking, 2 one meter diving boards,
electronic ADA lift and most important a 15 year
warranty for labor and materials for any leaks. The
pool is designed to allow multiple programming in
the facility;

As a result of the community's satisfaction with

The City of Pompano Beach was so pleased with
the Myrtha Pool system for the Pompano Beach
Aquatic Center, they selected it for their next
aquatic facility the Mitchell Moore Pool.
Mitchell Moore Pool is the recipient of a Broward
County Swim Central Grant.
The Aquatic Center has a competition pool, dive
well and learn -to -swim pool all in one multi - purpose
body of water, allowing for better programming and
it fits in a smaller footprint.
The pool contains a 25 -yard, 9 lane short course
high school competition pool, two (2) 1 meter diving
boards and the 13' -6" water depth make for an
excellent training competition dive pool.
The extended length of 112'of the pool allow for
excellent shallow water learn -to -swim pool. The
30'x 75', 3' -0" deep area is designed exclusively
for learn -to -swim having a tile bench and over sized
step for easy access into the pool for the young
swimmers just learning to swim.
The pool is designed for multiple programs in the
facility:
• Short course competition (25Y)
• 1 meter springboard competition diving
• Learn -to -swim class
• Leisure swim time
• Water polo
• Synchronized swim
• Scuba diving classes
The pools filtration and treatment are state- of -the-

Wellington Aquatic Complex
Village of Wellington
The Village of Wellington negotiated the Design/
Build contract for the renovation of the Wellington
Aquatic Complex. The project includes: the existing
50 meter pool to be completely renovated utilizing
the Myrtha RenovAction System, the filtration and
chemical controllers were also replaced, ADA
improvements to the existing restroom facility,
minor facelift to the pumphouse and restroom
buildings. This contract also provided for the design
and future construction of a water playground &

Grapeland Heights Park Phase I & II
City of Miami
This 13 -acre active park located just south of the
Miami Airport will be transformed in three phases.
Phase I includes a baseball complex with four fields
and a two -story restroom /concession building that acts
as a central hub to the fields. Perimeter parking with
convenient walkways provides easy access. Phase I
was completed in July 2007.
Phase II is a water park containing four different
pools: First, there's a large activity pool with themed
water playground equipment ideal for kids 5 and older.
Pool number two is a smaller water playground
designed especially for kids 5 and under. Next, a 600 -
foot wacky waterway meanders around the site
dumping, spraying and splashing riders as they drift by.
And finally, for the adults, there's a resort style pool
setting complete with beach entry to a depth of 5'
deep where they can sit, relax and float in cool,
refreshing water. Phase II was completed May 2008
Phase III is a 26,680 sq. ft. Community Recreational
Center. This two -story facility is reminiscent of a
structure found in our national park system and holds
center stage over the entire park. Phase III was
completed June 2008.

Jacob's Aquatic Center of Key Largo
Upper Keys
Tourists view the Keys as a tropical paradise, but for
kids who live there year- round, it can get pretty boring.
That's why a group of concerned parents came up with
the idea of building an aquatic center that could host a
variety of public swim programs. Their primary
challenges: "Where will we get the money ?" and
"Who can we trust to build it ?"
The money —$3.5 million —came from a member of the
community, Barbara Jacobs. Ms. Jacobs, then -owner
of the Cleveland Indians, was searching for a way to
replace the revenue the community lost when her ball
team had to relocate their Spring Training Camp after
Hurricane Andrew.
The builder — Recreational Design & Construction —met
the "experience and vision" criteria. RDC installed the
first Myrtha pool system in the U.S. and is recognized
as the premiere design -build firm for innovative aquatic
facilities.
RDC's experience was paramount in overcoming the
project's many challenges: low sea level, porous coral
and EPA restrictions. By continuously dewatering, at
the rate of 27,000 gallons a minute through a series of
11 on -site injection wells, we preserved the environ-
mentally sensitive landscape. And by working closely
with subcontractors and using state -of- the -art account-
ing software, we were able to determine that the
existing self- contained sanitary system was large

Today, the Jacobs Aquatic Complex is teeming with
Keys' kids. It includes two stainless steel Myrtha Pool
Systems —a competition pool with attached dive well
and a 20' X 40' learn -to -swim pool. A zero -entry ramp
for disabled swimmers and a 2,800 sq. ft. themed
water playground, decking, outdoor lighting and
multi - purpose concession /equipment/restroom building
complete the venue.

funds at Key Largo Community Park and is privately
operated and funded for public use. As planned, the
facility opened in time for the summer program and

• The Pompano. Beach Piranhas Swim Team won the 2006 League Championship in the large
