11111HREAS - In the opinion of the City Council of the City of South
Miami Florida, grave injury and lose threatens, and unjust discrim-
- ination has already resulted and will continue to be sustained by
the Marohants and Shippers of this locality of the Florida East
.Coast Railway be, by the Railroad Commission, permitted to close .
and abandon 1') \s Station in South',Viami and thereby discriminate
against local shippers and others in do'nying depot facilities and
Agency aeoomodations,-as per Station ';losing Order effective My
3rd, 1931, without public Notice or-hearings
AND &MBEAS = The Ugrcluuits of South Miami, and various steady
year -round Shippers have made formal protest to this Council and
made known, by concerted action that, in their oi)inion, the franchise
and privileges which the State of 1'lorida permits the F.E.C. Ry.
to use in rendering public service, carries with it the duty imposed,
to re".4er an adequate service suited to the needs of this public,
as well as the duty to observe lawful regulations both of Statute
and Rules of the CoTranission covering usual requisites for public
Notice and Hearing, prior to unannounced discontinuance of depot
facilities - -- further stating to this Council that in the opinion
of the Shippers protesting, the burden to the F.E.C. Ry. of furnish -
-ing such facilities does not invade the carrier's property rights
a -- and 'further stating that there is need for performance by the
Barrie:-, and likewise for due regards for the various rights of
this public, and that in the opinion of the protesting 11orehants
and Shippers the mere fact that the performance of the Railway'a
duty la (or has been claimed to be) unremunerative does not excuse
non- performar:oe on the part of the F. '.C.Rys

6703 (defininf; the duties and powers of the Railroad Commission) and
