PROVIDING AN EFFECTIVE DATE.
APPLICANT'S PROPOSAL
The applicant, Maria Barcena (Maria- Maria Skin /Body) is requesting a Certificate of
Appropriateness for the installation of a wall sign located at 5851 Sunset Drive (Shelley
Building), which is a designated historic site. The applicant's specific proposal was to place a
wall sign in the center of the building at the second floor level. The sign would contain the name
and logo of Maria -Maria Skin & Body, a new business occupying the entire second floor of the
building. Attached is a drawing of the sign and two location photographs. The sign area is 30" x
36" (7.5 sq. ft.) which is well below the maximum permitted size of a "flat" wall sign (20% of the
facade or max. of 200 sq. ft.).
HISTORIC BOARD ACTION
The Historic Preservation Board reviewed the applicant's proposed sign at its March 31, 2008
meeting. It is the policy of the Planning Department and the Historic Preservation Board that
signage shall be kept to a minimum on historic buildings. The Board felt that the location of this
sign in the middle of the upper facade would degrade the appearance of the shaped parapet which
is a key design element of the historic building. At the Board's request, the applicant agreed to
place the wall sign either on the facade at the first floor level or on the west facade of the first or
second floor level.
The Board then adopted a motion by a vote of 7 ayes 0 nays recommending approval of the
requested Certificate of Appropriateness for a wall sign with the limitation that it be located the
on the facade at the first floor. level or on west facade of the first or second floor level.
RECOMMENDATION
It is recommended that the City Commission approve
recommended by the Historic Preservation Board.

10 WHEREAS, applicant Maria Barcena (Maria -Maria Skin/Body) Dubey has submitted Historic
11 Preservation Board Application No. HPB -08 -015 requesting a Certificate of Appropriateness approving
12 the installation of a wall sign in the center of the building at the second floor level on a designated
13 historic site at 5851 Sunset Drive (Shelley Building 5837 Sunset Dr.).; and

15 WHEREAS, pursuant to Section 20- 5 -19(E) (3) of the Land Development Code, a "Certificate
16 of Appropriateness" is required for applications affecting the exterior (renovation, repair, painting,
17 demolition or landscaping); and

19 WHEREAS, Section 20- 5.19(E)(3) of the South Miami Land Development Code requires the
20 City Commission to conduct a public hearing on certificates of appropriateness and to approve, deny,
21 approve in modified form, or defer a subject application; and
22 WHEREAS, the Historic Preservation Board at its March 31, 2008 meeting felt that the location
23 of this sign in the middle of the upper facade would degrade the appearance of the shaped parapet which
24 is a key design element of the historic building; and
25 WHEREAS, the applicant agreed to place the wall sign either on the front facade at the first

WHEREAS, the Mayor and City Commission of the City of South Miami desire to accept the
recommendation of the Historic Preservation Board.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA THAT:
Section 1. Historic Preservation Board Application No. HPB -08 -015 requesting a Certificate of
Appropriateness to allow the installation of a wall sign on a designated historic site at 5851 Sunset Drive
(Shelley Building 5837 Sunset Dr.) is hereby approved as shown on the applicant's plans marked
"Exhibit A" attached to this resolution with the limitation that it be located the on the first floor west
facade or on the available front facade first floor arch and that the sign size be appropriately scaled to the
location.
Section 2. This resolution shall be effective immediately after the adoption hereof.

APPLICANT'S REQUEST
The applicant is requesting a Certificate of Appropriateness for the installation of a wall sign on a
designated historic site at 5851 Sunset Drive (Shelley Building 5837 Sunset Dr.). The recommendation of
the Historic Preservation Board will be transmitted to the City Commission for final approval.
PROPOSED SIGNAGE
The applicant is proposing to place a wall sign in the center of the building at the second floor level. The
sign will contain the name and logo of Maria -Maria Skin & Body, a new business occupying the entire
second floor of the building. Attached is a drawing of the sign and two location photographs. The sign
area is 30" x 36" (7.5 sq. ft.) which is well below the maximum permitted size of a "flat" wall sign (20%
of the facade or max. of 200 sq. ft.). The LDC regulation governing wall signs read as follows:
FLAT SIGNS with a total aggregate sign area, not to exceed twenty (20) percent of the area of any building face; for
the purposes of sign regulation, there shall be considered to be only four (4) facades to any building; no single sign
shall exceed two hundred (200) square feet in area. Direct illumination is permitted.
RECOMMENDATION
It is the policy of the Planning Department that signage shall be kept to a minimum on historic buildings.
The location of this proposed sign in the middle of the upper facade degrades the appearance of the
shaped parapet which is a key design element of the historic building. Staff recommends that the request
to place this sign be denied.

II. Roll Call: Roll call was performed. Board members present constituting a quorum: Ms.
Clyatt, Ms. Dison, Ms. Lahiff, Mr. Ruiz de Castilla, Ms. Shelley, Mr. Hochstim, and Mr.
Kurtzman.

Action: Mr. Youkilis advised that the applicant is requesting a wall sign to be installed on a

& Body, a new business occupying the entire second floor of the building. The sign area is 30" x

fagade or max. of 200 sq. ft.). It is the policy of the Planning Department that signage shall be
kept to a minimum on historic buildings. The location of this proposed sign in the middle of the
upper fagade degrades the appearance of the shaped parapet which is a key design element of the
historic building. Staff recommended that the request to place this sign be denied.
Mr. Hochstim stated that a sign on the proposed parapet should be the name of the building and
not the name of a business occupying the building. He recommended that the sign be placed on
one of the arches above the first floor or on the west side of the arcade. Mr. Youkilis advised
that there is a window on the second level of the west fagade. The applicant replied that a sign on
the west side of the arcade will require the owner's approval. She advised that the lease
indicates that the owner has the right to reject a sign if he doesn't approve it. Therefore, if the
Board approves the sign on the west side and the owner does not approve it she runs the risk of
not being approved for any sign. She added that she would not like to compromise the historical

value of the building. The applicant was in favor of cordially working with the Board and their
recommendations. Mr. Kurtzman recommended placing the sign on a first floor open arch. The
applicant replied that there is an open space however there is a conflict because the current tenant
has a similar business.
The Board recessed in order to provide staff the opportunity to provide additional photographs.
Motion: Mr. Hochstim moved to approve the signage installation with the conditions that the
sign be located on the first floor west fagade or on an ach on the first floor frontage not presently
with a sign and that the size be appropriately scaled to the location and Mr. Kurtzman seconded.
