PROVIDING FOR AN EFFECTIVE DATE.
Request: Pursuant to section 20- 3.3(D) and Section 20- 3.4(B)(22) of the Land Development Code (LDC) the
applicant, Bryan Guarch, Exotic Collections Car Rental, is requesting a Special Use Approval to operate an
automobile rental agency at the above referenced location. The proposed use is located in the "GR" General Retail
Zoning Use District. An automobile rental agency is permitted with Special Use Approval. The proposed use must
meet the requirements for special uses contained under Section 20 -5.8 Special Use Approval and Section 20 -3.4
(B) (22), Special Conditions for an automobile rental agency.
Staff Analysis:
The applicant is requesting a special use permit to use a. one story building (1035 sq. ft ) at 6136 S. Dixie Highway
as an automobile rental agency. The site faces S. Dixie Highway and the only access to the site is from S. Dixie
Highway. In the GR zone to the south of the site is a retail mattress store, to the north is a physical fitness facility.
The property to the rear is also zoned GR and includes a salon and spa and a personal skills instruction studio. A
total of four parking spaces are required for the automobile rental agency. (one space for 300sq.ft.) The applicant's
submitted site plan indicates that there are five spaces provided in the front of the building.
Planning Board Action:
The Planning Board at its March 11, 2008 meeting adopted a motion by a vote of 5 ayes 0 nays recommending
approval of the special use request with four conditions.
Recommendation:
The placement of an automobile rental agency at this location is compatible with current uses in the GR zoning use
district along S. Dixie Highway. In addition the requested use complies with the LDC requirements set forth for
special uses in Section 20 -5.8. Approval of the application with the following conditions is recommended:
(1) No ingress or egress to the automobile rental agency shall be permitted through abutting residentially zoned
parcels.
(2) Required parking spaces are to be designated for customers and employees only, and not to be used for the
storage of vehicles.

(3) Maintenance, mechanical repair or washing of cars on site is prohibited.
(4) If the subject use is, in the future, determined by the Director of Planning , to be adversely affecting
the health or safety of persons residing or working in the vicinity of the proposed use, to be detrimental
to the public welfare or property or improvements in the neighborhood, or to be not in compliance with
other applicable Code provisions, the special use approval may be modified or revoked by the City
Commission upon notification and public hearing.

WHEREAS, pursuant to section 20- 3.3(D) and Section 20- 3.4(B)(22) of the Land Development
Code (LDC), applicant, Bryan Guarch of Exotic Collections Car Rental has submitted Planning Board
Application No. PB -08 -008 requesting a Special Use Approval to operate an automobile rental agency at
6136 S. Dixie Highway located in the "GR" General Retail zoning use District; and
WHEREAS, an automobile rental agency is allowed as a special use in the "GR" General Retail
zoning use district subject to meeting general conditions specified in LDC Section 20 -5.8 and subject to
meeting special requirements set forth in LDC Section 20- 3.4(B)(22); and
WHEREAS, the approval of a special use requires a recommendation from the Planning Board
and the approval of the City Commission after a public hearing; and
WHEREAS, at its March 11, 2008 meeting the Planning Board, after public hearing, voted 5
ayes 0 nays to recommend approval with conditions of the special use request; and
WHEREAS, the Mayor and City Commission of the City of South Miami desire to accept the
recommendation of the Planning Board.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA THAT:
Section 1: The Special Use Application submitted by Bryan Guarch of Exotic Collections Car
Rental requesting a Special Use Approval to operate an automobile rental agency at 6136 S.
Dixie Highway located in the "GR" General Retail zoning use District is hereby approved subject
to the following conditions:
(1) No ingress or egress to the automobile rental agency shall be permitted through abutting
residentially zoned parcels;
(2) Required parking spaces are to be designated for customers and employees only, and not
to be used for the storage of vehicles;
(3) Maintenance, mechanical repair or washing of cars on site is prohibited;
(4) If the subject use is, in the future, determined by the Director of Planning , to be adversely
affecting the health or safety of persons residing or working in the vicinity of the proposed use, to
be detrimental to the public welfare or property or improvements in the neighborhood, or to be
not in compliance with other applicable Code provisions, the special use approval may be

The purpose of this letter is to apply for a special use

This property is zoned in the general retail area and the city of
South Miami has granted permits to several other car rental
agencies in the same zone. Exotic Collection Rental is an
luxury car rental agency in Miami, Fl and would like to
expand. We would like to open an agency at the above
mentioned property.

SPECIAL CONDITIONS APPLICABLE:
The LDC provides that special uses must be approved by the City Commission after a public hearing and
receipt of a recommendation from the Planning Board. The overall purpose is to determine the
compatibility of the proposed use with the surrounding neighborhood. A special use must comply with
the conditions set forth in Section 20- 5.8(B) in that the use:
a) Will not adversely affect the health or safety of persons residing or working in the vicinity of
the proposed use,
b) Will not be detrimental to the public welfare or property or improvements in the

neighborhood; and,
(c) Complies with all other applicable Code provisions.
In addition to the general conditions applicable to special uses an automobile rental agency must comply
with the following pre - determined conditions set forth in Section 20- 3.4(B)(22) of the Land Development
Code:
"(22) AUTOMOBILE RENTAL AGENCY. The following requirements shall be applicable to all
automobile rental agencies allowed as a as special use:
(a) No ingress or egress to the automobile rental agency shall be permitted through
abutting residentially zoned parcels.
(b) When adjacent to a residential district, a landscape buffer acceptable to the city's
ERPB shall be constructed along dividing property lines.
(c) Required parking spaces are to be designated for customers and employees only,
and not to be used for the storage of vehicles.
(d) Maintenance, mechanical repair or washing of cars on site is prohibited.
RECOMMENDATION

Action: Mr. Morton read the item into the record.
Mr. Youkilis advised on the location where the applicant is proposing the special use
request. He added that the applicant has a building of 1035 square feet. The number of
parking spaces required is calculated at one space per 300 square feet. Based on the
building size the total required spaces are four and the applicant has provided 5. The

special use application required that the conditions are met as mentioned on the report.
Staff recommended approval with the conditions as indicated on the report.
Mr. Guarch, applicant, advised that he has a rental agency located on 3550 Biscayne
Boulevard and was interested in opening a satellite office in South Miami. The agency
would be operating only as a satellite office. He advised that staff's conditions were
acceptable.
Mr. Morton questioned the vehicle transferring process from the Biscayne office to South
Miami. He also expressed concerns regarding the handicap space against the building to
the front door. He was concerned the fifth space used as handicap parking would have
traffic control issues. The on -site parking does not illustrate sufficient space for
automobiles to maneuver in and out of the parking space. Mr. Gaurch replied that there is
enough space to maneuver and exit the building facing US -1. He also noted that when the
vehicles are transferred from the Biscayne office the cars are parked on the fifth space
temporarily until the contract is completed. Mr. Gaurch further added that the vehicles
may be either transferred or an employee will pick -up the patron and transport them to
either the Biscayne location or South Miami. Mr. Morton advised that the logistics will be
tight.
Motion: Ms. Young moved to approve the special use application as presented and Mr.
Farfan seconded the motion with the following conditions:
1. No ingress or egress to the automobile rental agency shall be permitted through
abutt ing residentially zoned parcels.
2. Required parking spaces are to be designated for customers and employees only,
and not to be used for the storage of vehicles.
3. Maintenance, mechanical repair or washing of cars on site is prohibited.
