03-18-08 Item 92 II RESOLUTION NO. 3 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE 4 CITY OF SOUTH MIAMI, FLORIDA, RELATING TO THE CITY OF 5 SOUTH MIAMI CHARTER; CREATING A CHARTER REVIEW 6 COMMITTEE; PROVIDING AN EFFECTIVE DATE. 7 WHEREAS, the Mayor and City Commission of the City of South Miami recognize 8 that the City of South Miami Charter is in need of revision; and, 9 WHEREAS, an undertaking to revise the charter skill, judgment, wisdom and 10 substantial commitment by volunteers; and, 11 WHEREAS, the Mayor and City Commission desire to establish a Charter Review 12 Committee to evaluate and to make specific recommendations for revision to the charter. 13 NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY 14 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, that: 15 Section 1. The City of South Miami Charter Review Committee is hereby 16 created. The committee shall consist of five members, who shall be appointed by the 17 mayor with the advice and consent of the city commission. The city commission states its 18 desire that the membership of the commission shall consist of at least one attorney who is 19 licensed to practice law in the State of Florida and who has expertise in the area of 20 municipal law. The mayor is requested, in appointing members to the commission, to give 21 due consideration to selecting members based upon principles of ethnic and gender 22 inclusion, and leadership and professional capability. The city manager shall serve as a 23 non - voting ex officio member of the commission. 24 Section 2. The City of South Miami Charter Review Committee shall be 25 charged with the responsibilities of preparing a work plan and schedule for accomplishing 26 its work in a period not to exceed one year, unless that time is extended by the city 27 commission; studying and making recommendations to the city commission regarding 28 necessary or useful revisions to the charter; holding public workshops upon approval by 29 the city commission; and, preparing drafts of the recommended revisions to the charter. 30 Section 3. The city manager will provide for staff and logistic support. 31 Support may include, but not be limited to, publishing the amended charter, as finally 32 adopted by the city commission and by referendum. The city attorney shall be responsible 33 for reviewing proposed revisions to the charter for legal sufficiency. The city clerk will 34 provide support in research, retrieving and indexing prior revisions to the charter. The city 35 manager may present a budget to the city commission which will include the anticipated 36 cost of logistic support, and other cost items. Page 1 of 2 I Section 4. Pursuant to the requirements of Section 166.031, Florida Statutes, 2 and Section 5.03, Miami -Dade County Charter, the city commission shall, by ordinance, 3 submit to the electors of the city the proposed amendments to the charter. The proposed n 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 amendments shall be submitted not less than 60 days, nor more than 120 days, before the next scheduled general election. Upon the approval by the electors of any amendments to the charter, the amended charter shall be filed with the Florida Secretary of State and with the Circuit Court, in and for the Eleventh Judicial Circuit, Florida.
