A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY
OF SOUTH MIAMI, FLORIDA, RELATING TO PERMIT FEES;
ESTABLISHING POLICY WAIVING BUILDING PERMIT FEES AND OTHER
CITY FEES FOR PROJECTS IN THE SOUTH MIAMI COMMUNITY
REDEVELOPMENT AGENCY ( SMCRA) AREA; PROVIDING AN EFFECTIVE
DATE.
BACKGROUND AND ANALYSIS
The attached Resolution, sponsored by Commissioner Palmer establishes a Policy
waiving building permit fees and other City fees by the City of South Miami for projects
actually funded and /or operated by the South Miami Community Redevelopment Agency
( SMCRA).
Our own SMCRA will be able to go further with their limited budget if the City waives
building permit fees and other City fees. It is totally inconsistent to the goals of South
Miami to seek to provide affordable housing or other projects for the CRA area, while at
the same time unduly burdening our own SMCRA with the costs and expenses of
building permit fees and other fees.
Moreover, the Resolution urged by Commissioner Palmer does not at all depart from
existing City Policy. As early as August 15, 2000, then Vice Mayor Feliu sponsored a
similar Resolution, #160 -00 -11053 establishing a policy waiving Code Enforcement

Liens in an amount not to exceed $5,000.00 for those properties identified suitable for the
CRA Infill Housing Program.
Thus, the suggested Resolution follows the previous established City policy, giving the
CRA all possible help to provide affordable housing or other worthwhile SMCRA
proj ects.

11 WHEREAS, the Mayor and City Commission of the City of South Miami
12 recognizes the importance of paving the way to provide incentives towards the
13 revitalization in the SMCRA area; and

15 WHEREAS, the South Miami Community Redevelopment Agency ( SMCRA) was
16 created to redevelop and revitalize a certain portion of the City of South Miami; and
17
18 WHEREAS, the Mayor and City Commission desire to establish a policy waiving
19 all building permit fees, and other City fees, under limited circumstances, pertaining to
20 projects within the SMCRA area, which projects are actually funded and/or operated by
21 the South Miami Community Redevelopment Agency ( SMCRA).

23 NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY
24 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA;

26 Section 1. A policy is established waiving City of South Miami building permit
27 fees, and other City fees, under limited circumstances, pertaining to projects within the
28 SMCRA area, which projects are actually funded and /or operated by the South Miami
29 Community Redevelopment Agency ( SMCRA).

31 Section 2. . This policy shall be retroactive and apply to any period from
32 September 30, 2009.

34 Section 3. Any permit or fee waiver exceeding $5,000 shall be presented to the
35 City Commission for approval.

37 Section 4. This resolution shall take effect immediately upon approval.

SOUTH MIAMI COMMUNITY REDEVELOPMENT AGENCY FOR THE
INFILL HOUSING PROGRAM; PROVIDING AN EFFECTIVE DATE.
BACKGROUND
The attached resolution sponsored by Vice Mayor Feliu and co- sponsored by Mayor
Robaina, Commissioners Bethel and Wiscombe establishes a policy waiving code
enforcement liens in an amount not to exceed $5,000.00 for those properties identified
suitable for the CRA Infill Housing program.
The South Miami Community Redevelopment Agency was created to redevelop and
revitalize a certain portion of the City of South Miami. The City Commission recognizes
the importance of providing affordable housing for the residents in the CRA Area. One
of the key elements identified to accomplish this, in the CRA Plan, is the Infill Housing
program. The adoption of this resolution would allow those entities interested in
providing affordable housing for the CRA area residents to accomplish this goal in a
most advantageous and expedient manner.
