Please note that the following amendments to the above ordinance are being made
as per the advice of the Miami -Dade County Elections Department: (1) page 1, lines 23
and 41; and (2) the format of the sample ballot.

14 WHEREAS, Section 2, Article V, of the City of South Miami Charter provides
15 that the City Commission of the City of South Miami shall schedule a general election for
16 February of each even year, and that the Mayor shall be elected for a term of two (2)
17 years and commissioners shall be elected for terms of four (4) years at the general
18 election; and
19
20 WHEREAS, the Charter requires the City Commission of the City of South Miami
21 to schedule the day, place and time of the general election by ordinance; and
22
23 WHEREAS, state law requires election books to close thiAy(30) twenty -nine (29)
24 days prior to the election.

26 NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
27 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:

29 Section 1. The 2010 General and Special Elections will be held on Tuesday,
30 February 9, 2010. On that date, a mayor will be elected to serve a term of two (2) years,
31 and two (2) Commissioners, one from Group I and one from Group IV, will be elected to
32 serve a term of four (4) years.
33 Section 2. The qualifying period for this election shall open Monday, January
34 4, 2010 at 9:00 a.m. and close Friday, January 8, 2010, precisely at 5:00 p.m. Candidates
35 shall qualify at the office of the City Clerk, 6130 Sunset Drive, South Miami, Florida.

37 Section 3. Voting shall be conducted at City Hall in the City Commission
38 Chamber, 6130 Sunset Drive, South Miami, Florida. The polls shall open precisely at
39 7:00 a.m., and close precisely at 7:00 p.m.

41 Section 4. The effieial sample ballot for the 2010 general election is annexed to
42 this ordinance.

Section 5. The election books shall close. Monday, January 11, 2010.
Section 6. The City Clerk shall publish notice of such general election once a
week for four consecutive weeks next preceding the General and Special Elections in a
newspaper of general circulation in South Miami. The notice shall contain the date, time,
and place of the General and Special Elections and identify the Commission Groups.
Section 7. If any section, clause, sentence, or phrase of this ordinance is for any
reason held invalid or unconstitutional by a court of competent jurisdiction, the holding
shall not affect the validity of the remaining portions of this ordinance.
Section 8. All ordinances or parts of ordinances in conflict with the provisions
of this ordinance are repealed.
Section 9. This ordinance shall take effect immediately upon approval.
