REPORT APPLICATION WITH THE FLORIDA DEPARTMENT OF
ENVIRONMENTAL PROTECTION (FDEP) IN AN AMOUNT OF $86,000.00 TO
BE CHARGED TO THE PROFESSIONAL ENGINEERING SERVICES
ACCOUNT NUMBER 001 -1790- 519 -3100; PROVIDING FOR AN EFFECTIVE
DATE.
Request: Authorizing the City Manager to approve professional service work order for
engineering consulting services for the preparation and evaluation of an alternate
FPL transmission line corridor study for application with FDEP in accordance with
F.S. 403.5271.
Reason/Need: The residents of the City of South Miami and City Commission have
objected to the East Route proposed by FPL for the installation of an
overhead transmission line that would run along the U.S. 1 corridor.
Back in December 2008, at the request of the City Manager, the Public
Works- Engineering Department developed three (3) alternate FPL
transmission line corridor routes that would lessen the impact on health,
safety and quality of life for densely populated areas and basic elements
encompassing a working community such as hospitals, schools,
businesses, infrastructure improvements, etc.
The (3) three alternate transmission line corridor routes developed were
as follows:
Alternate no. 1: begins at FPL's Davis substation located at 13701 SW
127th Ave, and runs east adjacent to S.R. 874, then northeast along S.R.
874 to S.R. 826, then north along S.R. 826 to S.R. 836, then east along
S.R. 836 to the downtown Miami Substation
Alternate No. 2: Begins near U.S. 1 and S.W. 100th Street, and then runs
north on S.R. 826, then east on S.W. 56th Street and then north on S.W.
72nd Street
Alternate No. 3: Begins near U.S. 1 and S.W. 100th Street, then north on
S.R. 826, then northeast along C.S.X. R.R. and then north on S.W. 72nd
Street.
All three (3) proposed alternate transmission line corridor routes Were
then presented to FPL for their review and consideration, after which FFL
rendered the alternate routes as "not practical ".
Since then, on June 30t'', 2009, FPL filed a Site Certification Application
with FDEP for a new 230 KV overhead transmission in accordance with
Florida Statutes (F.S.) Chapter 403. in which FPL shows the preferred
corridor routes along U.S. 1 from S.W. 131St Street to FPL's downtown
substation. The proposed FPL corridor route runs through the Village of
Pinecrest, City of South Miami and City of Coral Gables.
As a result, on August 24, 2009 a meeting was held with the Vice - Mayor,
City Manager, Planning Director, and Public Works- Engineering Director
where it was agreed to move forward with the following (see attached
meeting minutes):
City will file a notice of Proposed Alternate Corridor for a
Transmission Line with FDEP by October 8th, 2009 in accordance
with Chapter 403.5271, F.S.
The City's proposed alternate corridors will be Alternate No. 1 and
Alternate No. 4 as shown in the attached Exhibit "A ". Alternate
No.1 begins at FPL's Davis substation located at 13701 SW ' 127 Ih
Ave, and runs east adjacent to S.R. 874, then northeast along
S.R. 874 to SR 826, then north along S.R. 826 to S.R. 836, then
east along S.R. 836 to the downtown Miami Substation. Alternate
No. 1 is consistent with what the City Commission approved via
Resolution No. 67 -09 -12876 on April 7th, 2009 (see attached).
New Alternate No. 4 discussed at the meeting is basically the
same U.S. 1 corridor route proposed by FPL, except constructed
underground within the City of South Miami limits from S.W. 800
Street to S.W. 57" Ave.
Retain the services of Kimley -Horn and Associates (city approved
engineering consultant) to evaluate the City's two (2) alternate
route corridors based on the qualitative and quantitative criteria as
established by FPL. The alternate corridor study would then be
filed with FDEP by October 8th, 2009 as part of the application
process to meet the proposed initial timeline schedule filed with
the State of Florida Division of Administrative Hearings (see
attached)

14 WHEREAS, Florida Power and Light (FPL) has filed a Site Certification Application with FDEP for a new

27 the preparation and evaluation of an alternate FPL corridor report application with FDEP; and

29 WHEREAS, the total cost of the professional services will be $86,000.00 funded from the City's
30 undesignated contingency cash reserve fund; and
31
32 WHEREAS, the City Commission has not budgeted any amount in the fiscal year 2008 -2009 for these
33 expenses.

35 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OT THE CITY OF

38 Section 1: The City Manager is authorized to utilize up to $86,000.00 of the City's Undesignated
39 Contingency Cash Reserve Fund to pay for expenses associated with the preparation and evaluation of an
40 alternate FPL transmission line corridor report application to be filed with FDEP as a notice of Proposed Alternate
41 Corridors for a Transmission Line with FDEP in accordance with F.S. 403.5271

43 Section 2: The City Commission authorizes the City Manager to execute a professional service work order
44 with KHA in an amount of $86,000.00 for the evaluation of an alternate FPL transmission line corridor report
45 application to be filed with FDEP to be charged to the professional engineering services account number 001 -1790-
46 519 -3100.

48 Section 3: The total cost of the professional services will be $86,000.00 funded from the City's
49 Undesignated Contingency Cash Reserve Fund.

RESOLUTION NO. 67-09-12876
A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF
THE CITY OF SOUTH MIAMI, FLORIDA, RELATING TO
OPPOSING THE PROPOSED ROUTES ALONG THE LUDLUM
TRAIL OR ALONG US HIGHWAY 1, FOR THE FPL
TRANSMISSION LINE: AND PROPOSING THE EVALUATION OF
AN ALTERNATE ROUTE ALONG SR 826, SR 836 OR SR 874;
PROVIDING FOR TRANSMITTAL TO THE STATE, AGENCIES,
AND OTHER COMMUNITIES; PROVIDING AN EFFECTIVE DATE.
WHEREAS, Florida Power and Light (FPL) is considering the construction of a
transmission line in order to increase capacity and connect the turkey point power station
to downtown Miami and points North; and,
WHEREAS, one proposed FPL route 'is along US Highway 1 and a second
potential route is the railroad corridor along the Ludlum Trail through the City of South
Miami; and,
WHEREAS, the Ludlum Trail proposed route runs adjacent to and in close
proximity to established residential neighborhoods and two existing schools; and,
WHEREAS, the proposed US Highway 1 route runs adjacent to and in close
proximity to an established residential neighborhood, hospitals, schools and other
occupied commercial buildings; and,
WHEREAS, locating transmission lines through densely populated areas imposes
an unreasonable burden on the affected community due to exposure to EMF, audible
noise, visual impact and danger of collapsed lines; and,
WHEREAS, the siting of electric transmission power lines along public highway
right -of -ways and other corridors with relatively small right-of-ways poses significant, . .
health and safety concerns; and,
WHEREAS, the siting of electric transmission power lines along public highway
right-of-ways with larger buffers and wider right -of -ways such as State Road 826, State
Road 836, and State Road 874 for example, minimizes impacts on residential
communities, businesses, hospitals and schools; and,

WHEREAS, the Mayor and City Commission seek to lobby the State Legislature
relating to same.
NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA;
Section I. That the Mayor and City Commission does hereby state its
opposition to the Ludlam Trail route and the U.S. Highway 1 route for the proposed
transmission line proposed by FPL, and propose the relocation of the FPL transmission
lines along larger public highway rights -of -way, including, but not limited to SR 826, 836
and 874.
Section 2. In the event that one of the routes through the City of South Miami
is ultimately selected that the Mayor and Commission formally request FPL to place the
transmission lines running through the City under ground to reduce the adverse impacts
of electric magnetic fields on the citizens and visitors to South Miami.
Section 3. The Mayor and City Commission encourage FPL to work with the
Department of Transportation to identify transmission line routes that minimize exposure
to population centers.
Section 4. The Mayor and City Commission directs the City Clerk to transmit
a certified copy of this resolution to the Governor, Senate President, House Speaker, the
Chair and Members of the Miami -Dade County State Legislative Delegation, the
Presiding Officer and Members of the municipalities in Miami -Dade County and the
Executive Director of the Miami- League of Cities, and the Florida Department of
Environmental Protection and FPL.
Section S. This resolution shall take effect immediately upon approval.

Subject: Coordination of City Efforts as Related to the FPL Proposed Transmission
Line Corridor
1. There was a discussion of the timeline for the application submitted by FPL
for the requested approval of the transmission line corridor proposal. The
dates for the optional informational meetings have been set as August 31,
2009 for the Power Plant portion of the application and September 2, 2009 for
the Transmission Line portion of the application.
2. There is an announcement on the City web -page and on Channel 77 to allow
citizens to be aware of these dates for the meetings.
3. City staff will be attending the September 2, 2009 meeting.
4. Pursuant to the timeline for the application processing, City to file notice of
proposed alternate corridor(s) for the transmission line.
5. The proposed City alternate corridor sub mission will require significant
technical work. Presently there are 3 alternative corridors (See attached
Exhibits) and the under grounding of the US 1 (Dixie Highway), within the
limits of the City of South Miami, portion of the line to be studied by the City.
A consultant will be required to address the technical work required.
6. It was decided to narrow the number of alternate corridors the City would
proposed to one. This would be the SR 874 NE to SR 826 N to SR 836 E.
This would keep the transmission line along the expressways for the length of
the route needed in keeping with the approved resolution no. 67 -09 -12876
adopted on April 11, 2009.
7. The consultant will be asked to provide a proposed scope of work for the
alternate corridor selected and the under grounding study for US 1 (Dixie
Highway) within the limits of the City of South Miami.
8. All 3 alternative corridors and the under grounding of the transmission line
along US 1 (Dixie Highway) within the limits of the City of South Miami to
be presented to the City Commission for discussion.
9. The draft letter from the Vice Mayor to DEP regarding the issues the City has
with the FPL application was discussed and finalized.

Dear Mr. Olivo:
Kimley -Horn and Associates, Inc., (hereinafter referred to as "Consultant" or
"KHA ") is pleased to submit this letter agreement to The City of South Miami
(hereinafter referred to as "City" or the "Client ") for professional consulting
services relating to the project known as "Alternate Corridor Evaluation for
Proposed FPL Transmission. Lines ". Except as specified below, the terms of this
agreement shall be in accordance with the "Professional Service Agreement —
General Engineering Services" (the' "Agreement ") between the City of South
Miami and Kimley -Ho.rn and. Associates, Inc., as approved by the City
Commission on March 17, 2009. Our project understanding, assumptions, scope
of services and fees follow.
PROJECT UNDERSTANDING
On June 30, 2009, FPL filed a Site Certification Application with FDEP for new
230 -kV overhead transmission lines as part of the proposed Turkey Pointnuclear
expansion in accordance with Florida Statutes (F. S.) Chapter 403. One of the
corridors preferred by FPL for the proposed power lines, referred to as "East
Route "; would run. along U.S. 1 from about SW 131" Street to FPL's downtown
Miami Substation, which is located .NE of where. 1-95 and Metrorail. diverge. This
"East Route" crosses portions of the Cities of South Miami; Pinecrest, Coral
Gables and Miami. Most of these municipalities have expressed objections to the
"East Route" for different reasons. More detailed information about the "East

It is our understanding that the City of South Miami objects to the "East Route'
proposed by FPL and wishes to file a notice of "Proposed Alternate Corridors for
a Transmission Lure" for consideration of two (2) alternate corridors in
accordance with Chapter 403.5271, F.S. The two alternate corridors are as
follows:
I) Beginning at FPL's Davis Substation, located at 13701 SW 127th Avenue,
overhead transmission lines running east along an existing FPL easement
to S.R.874, then northeast along S.R.874 to S.R.826 (Palmetto
.Expressway), then north along S.R.826 to S.R.836, then east along S.R.836
to the. downtown Miami Substation located at 1.22 SW P Street.
'2) Essentially the same U.S.1 "East Route" proposed by FPL, except that the
system would be installed underground within the City of South Miami,
between SW 80th Street (Davis Road) and SW 57th Avenue (Red Road).
As part of this filing, the City is requesting that KHA prepare an alternate
corridor study in order to evaluate the two (2) alternate corridors described
above. It is our understanding that this study will be based on a specific set of
quantitative and qualitative criteria developed by FPL and included herein as
"Exhibit B ". This alternate corridor study would be file. d with the FDEP as part
of the certification proceeding.
KHA does not guarantee that the alternate corridors proposed by the City of
South Miami will be found to be feasible or acceptable by FDEP or FPL. During
the course of this study, if it is determined by the City or KHA that any portions)
of these corridors should change; KHA will submit a supplemental scope of
services and fee for the additional work associated with the revised alignment.
ASSUMPTIONS
1) The deadline for filing the notice of proposed alternate corridors is October
8, 2009.
2) If FPL and FDEP accept the alternate corridors, the deadline for submitting
additional data in support of the alternate corridor is November 5, 2009.
3) The City will be responsible for publishing the newspaper notice of
alternate corridor in accordance with Chapter 403.5363(2), F.S.
4) The City will prepare mailing labels and send mail notifications to all
owners of properties within' /4 -mile of the proposed alternate corridors.
5) Due to the short turn - around time for delivery of this project, it may not be
possible to obtain records of all existing underground utilities within the
alternate corridors in time to incorporate in the deliverables. KHA will
request and try to obtain readily- available utility records.
6) It .is assumed that most the information necessary for this evaluation will be
readily available and obtained through the City of South Miami, FPL
(through City staff) and Miami -Dade County. Additional efforts needed to
produce this information from other sources will be considered additional
services.

SCOPE OF SERVICES
Task 1.0 — Field Reconnaissance and Data Collection:
During this phase; KHA,w.ill perform the following services:
1) Attend one "kick -off' meeting with City of South Miami Public Works
Department staff.
2) Review all information provided by the City pertaining to FPL's Electrical
Transmission. Line Siting Application.
3) Request from FPL (through City staff) specific information on the types of
transmission facilities being proposed and types of existing FPL utilities
along the two proposed. alternate corridors.
4) Drive each proposed alternate corridor to take photographs and make notes
of existing conditions
5) Submit requests to the following agencies for the information below along
the two proposed alternate corridors:
(a) USES - 1:24,000 Quadrangle Maps
(b) Miami -Dade County - Right -of -way maps
(c) Miami -Dade County — All available GIS layer information
(d) Miami -Dade County Planning. Department - planned developments
(e) MDX / F.DOT / Miami -Dade County - Planned roadway construction
projects
(f) Miami -Dade County— Database of archaeological sites
(g) Miami -Dade County Historic Preservation Officer - Historic districts
(h) Miami -Dade County Park and Recreation Department Locations of
parks, trails, greenways and conservation lands
6) Solicit unit costs from FPL contractors for different materials and
construction methods (overhead and underground)
7) Perform glide slope analysis as required by FAA where corridor alignment
is in close proximity to Miami International Airport.
At the end of this task, KHA will. provide the City with a report of existing
conditions and an aerial. map showing the proposed alternate corridors and the
information collected during Task 1.
Task 2.0 — Alternate: Corridor Study Report
During this phase, KHA will perform the following services:
1) Evaluate the two (2) alternate corridors described in the Project
Understand u>g based on a specific set of quantitative and qualitative
criteria developed by FPL and included herein as "Lxhibif B ".
2) Provide Engineer's preliminary opinion of probable costs for construction

3) Perform a constructability review of the alternate corridors
4) Rank each alternate corridor based on the above criteria.
5) Prepare an Alternate Corridor Study Report containing the findings from
Task 1, analysis and rankings from Task 2, and highest ranking alternate
corridor.
At the end of this task; KHA will provide the City with three copies of the
Alternate Corridor Study Report and updated aerial map.
Task 3.0 —Assistance with Filing of Proposed Alternate Corridor
KHA will assist the City of South Miami with the filing of the Notice of
Proposed Alternate Corridor in accordance with Chapter 403.5271(1)(a); F.S.
by providing the following services:
1) Delineate the alternate corridor boundaries on USGS 1:24,000 quadrangle
map
2) Provide a description of the proposed alternate corridor
3) Assist the City in preparing a statement of reasons the proposed alternate
corridor should be certified
KHA does not make any guarantees that any of the alternate corridors proposed
by the City will be accepted by FDEP and FPL. If one of the alternate corridors is
accepted by FDEP and FPL, KHA will remain available to perform the following
as additional services:
1) Submit additional information that may be requested by FDEP through a
determination of incompleteness if the information requested is in addition
to what was prepared as part of Tasks 1.0 and 2.0 above.
2) Assist the City by sending mailings to owners whose properties are located
within, ' /4 -mile from the proposed alternate corridor, and assist with filing
the list of landowners with FDEP.
Task 4.0 - Additional Services
Any services not specifically provided for in the above scope will be considered
additional services. If additional services are requested by the City, KHA will
submit a supplemental scope and fee for the additional services requested.
Additional services we can provide include; but are not limited to, the following:
1. Preparing mailing labels and sending mass mailings
2. Assisting the City in preparing newspaper advertisements
3. Site planning
4. Environmental engineering
5. Traffic engineering and design
6. Roadway design
7. Design of public infrastructure improvements

8. Landscape architecture
9. Revisions to the two alternate corridors described in the Project
Understanding
10. Services required by additional governmental regulations, which might be
put into effect after the date of this agreement

12. Plans for maintenance of traffic (MOT) during construction
13. Erosion control plans and NPDES permitting
14. Dewatering plans
15. Attendance to meetings, hearings, presentations in addition to those
described in the tasks above
16. Deliverables not specifically outlined in the above tasks
17. Any other service not specifically listed in "Scope of Services
TO BE PROVIDED BY CLIENT
The following items are to be provided to KHA by the Client:
1. Scheduled dates established by FDEP_ for all. submittals of FPL's
Transmission. Line Siting application process
2. Copies of FPL's Electrical Transmission Line Siting Application
3. The City will request the .following from FPL and provide to KHA:
a) Details and specifications of the transmission facilities proposed by FPL
b) Types of existing FPL utilities along the proposed alternate corridors.
4. Alignments proposed by the City for the two alternate corridors
5. Payment of all application fees
6. Newspaper advertisements required by the application process
7. Prepare mailing labels and send mail notifications to all owners of properties
within t/4 -mile of the proposed alternate corridors.
8. Any information requested by KHA from FPL to perform this analysis
SCHEDULE
KHA will provide its services in order to meet the following schedule established
by FDEP for FPL's Transmission Line Siting application process:
10/8/09- Deadline for filing Notice of Proposed Alternate Corridors.
11/5/09- Deadline for submitting additional data in support of the alternate
corridors.
11/23/69- File with FDEP a list of landowners whose properties are located
within t/4 -mile of the proposed alternate corridor.
12/14/09- Submit corrective data to FDEP in response to determination of
incompleteness.
2/5/10- Deadline for publishing newspaper notice of alternate corridor.

FEE AND BILLING
The consultant will accomplish the services outlined in Tasks 1.0 through 3.0 of
the Scope of Services for the lump sum fee of $86;000.00 and as shown in the
table below. Office expenses have been included within the lump sum amount
and would include in -house duplicating, facsimile, local mileage, telephone,
postage, in -house blueprinting, word processing, and cellular telephone use.
The services under Task 4.0, "Additional Services ", may be performed hourly
based on actual time worked times the Contract hourly "rates, or a supplemental
scope of services may be provided for these services if requested by the City. As
'to this task, office expenses will be invoiced as 5.85% of the labor fee, and would
include in -house duplicating, facsimile, ,local mileage, telephone, postage, in-
house blueprinting, word processing, and cellular telephone use.
For all tasks, other direct and reimbursable expenses such as large -scale
reproductions, board- mounts, long distance travel; mass mailings, etc., the City
will pay the Consultant the direct costs as per Section 4.0, "Basis of
Compensation ", of the Agreement.

CLOSURE
The terms and conditions of the "Professional Set-vice Agreement — General
Engineering Services" (the "Agreement ") between the City of South .Miami
(Client) and Kimley -Horn and Associates, Inc., (Consultant) as approved by the
City Commission on March. 17, 2009, shall govern. this scope of services.
If you concur with the foregoing and wish to direct us to proceed with the
aforementioned services, please issue a written Work. Authorization to the .
consultant referencing this document as Exhibit "A ". Fees and time stated in
this agreement are valid for sixty (60) days after the date of issuance by the
consultant.
