ORDINANCE NO.
AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY
OF SOUTH MIAMI, FLORIDA, RELATING TO THE CITY'S CODE OF
ORDINANCES, CREATING SECTION 2 -22 ENTITLED "TERMS LIMITS"
LIMITING TERMS OF OFFICE FOR COMMITTEE OR BOARD MEMBERS
SERVING ON A PARTICULAR BOARD OR COMMITTEE TO TWO
CONSECUTIVE TERMS; PROVIDING FOR CODIFICATION, ORDINANCES
IN CONFLICT AND AN EFFECTIVE DATE.
WHEREAS, the Mayor and City Commission desires to establish two (2) consecutive
terms as a limit for all City Boards and Committees, and,
WHEREAS, the Mayor and City Commission recognize the valuable contributions made
by all members serving on City Boards and Committees; and,
WHEREAS, the Mayor and City .Commission recognize that the City of South Miami
has many qualified citizens willing to serve on City Boards and Committees; and,
WHEREAS, in order to provide opportunities to all citizens willing and able to serve on
City Boards and Committees the Mayor and City Commission desire to create term limits in
order to ensure participation by the many qualified members of the City in various appointed
boards, commissions, and committees.
NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION:
Section 1. Section 2 -22 of the City of South Miami Code of Ordinances is amended,
provided below:

2 -2.2 sir Term Limits.
Appointees are limited to two (2) consecutive two -year terms of membership on a specific
commission board or committee An appointee may not be reappointed to the same
commission board or committee after completion of two (2) consecutive terms. After serving a
maximum of two (2) consecutive year terms an appointee shall not be reappointed to the same
commission board or committee unless at least one year has elapsed between the term limited
position and the effective date of commencement of the proposed appointment for a new term.
Notwithstanding any provision to the contrary, an appointee shall not be precluded, at anytime
following completion of service on a commission without being required to comply with the
1_pse of time between appointments Term limits will be applied prospectively, commencing
with appointments made after January 1, 2009.

Section 2. If any section, clause, sentence, or phrase of this ordinance is for any reason
held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect
the validity of the remaining portions of this ordinance.
Section 3. All ordinances or parts of ordinances in conflict with the provisions of this
ordinance are repealed.
Section 4. This ordinance shall be codified and included in the Code of Ordinances.
Section 5. This ordinance shall take effect immediately upon enactment.
