07-21-09 Item 11r' I I ORDINANCE NO. 2 3 AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY 4 OF SOUTH MIAMI, FLORIDA, RELATING TO THE CITY'S CODE OF 5 ORDINANCES, CREATING SECTION 2 -22 ENTITLED "TERMS LIMITS" 6 LIMITING TERMS OF OFFICE FOR COMMITTEE OR BOARD MEMBERS 7 SERVING ON A PARTICULAR BOARD OR COMMITTEE TO TWO 8 CONSECUTIVE TERMS; PROVIDING FOR CODIFICATION, ORDINANCES 9 IN CONFLICT AND AN EFFECTIVE DATE. 10 11 12 WHEREAS, the Mayor and City Commission desires to establish two (2) consecutive 13 terms as a limit for all City Boards and Committees; and, 14 15 WHEREAS, the Mayor and City Commission recognize the valuable contributions made 16 by all members serving on City Boards and Committees; and, 17' 18 WHEREAS, the Mayor and City Commission recognize that the City of South Miami 19 has many qualified citizens willing to serve on City Boards and Committees; and, 20 21 WHEREAS, in order to provide opportunities to all citizens willing and able to serve on 22 City Boards and Committees the Mayor and City Commission desire to create term limits in 23 order to ensure participation by the many qualified members of the City in various appointed 24 boards, commissions, and committees. 25 26 NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION: 27 28 Section 1. Section 2 -22 of the City of South Miami Code of Ordinances is amended, 29 provided below: 30 31 32 33 2 -2.2 Resen,ed. Term Limits. 34 35 36 Appointees are limited to two (2) consecutive two -year terms of membership on a specific 37 commission board or committee An appointee may not be reappointed to the same 38 commission board or committee after completion of two (2) consecutive terms. After serving a 39 maximum of two (2) consecutive year terms an appointee shall not be reappointed to the same 40 commission board or committee unless at least one year has elapsed between the term limited 41 position and the effective date of commencement of the proposed appointment for a new term. 42 Notwithstanding any provision to the contrary an appointee shall not be precluded at anytime 43 following completion of service on a commission without being required to comply with the 44 lapse of time between ppointments Term limits will be applied protectively, commencing 45 with 4ppointments made after January 1, 2009. 46 47 Page 1 of 2 .f. . f !�`E �: �m, � F� 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 Section 2. If any section, clause, sentence, or phrase of this ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this ordinance. Section 3. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are repealed. Section 4. This ordinance shall be codified and included in the Code of Ordinances.
