Action Taken: As an update to our appeal to the Environmental Review & Preservation Board (ERPB) for the installation of awning at City Hall, on July 1, 2008 we presented our appeal to the board and requested for the board's re-consideration of the original proposed awning installation plan. After much discussion by the board, our request was unanimously approved. Attached is a copy of ERPB's meeting minutes for July 1, 2008. Some safety issues were discussed regarding the "L configuration." The issues include water being dumped right on j the handicap ramp in front of City Hall which may cause accidents. He also addressed that no shelter area will be provided with the approved awning. He added that during a previous meeting the Board deferred option "A" so that the City may revisit the proposal. Mr. De la Torre I advised that he addressed the Board's concerns and modified option "A," thus presenting "L" and "T" configurations. The adjustment that was made consisted of lowering and creating a border where the water will be dumped onto the green space therefore eliminating safety hazard concerns. Mr. Ajibola Balogun also commented that the City Commission saw the need to provide the courtesy to the Board therefore remanded the request back for the Board's review. Mr. Balogun added that the awning installation heavily discussed during the budget process. During the discussion there was consideration of the services that the City provides to its residents and how the awning will compliment the needs to the services provided by the City Clerk's, Human Resources, and Central Services. This covered area as proposed with option "A" will help provide an area for individuals to stand while they wait for a service to be rendered. For that matter the City Commission saw the need to approve the project during the budget process. With the condition previously approved (L configuration) the commission saw it proper to explain the awning needs as well as safety concerns to the Board. Mr. Balogun advised that the "L" configuration approval will create more safety concerns due to the fact that the water will run onto brick paved area as opposed to the landscape area. The City Commission has remanded the request back so that the Board may reconsider their decision while looking at the safety elements, services provided to the residents, and how it will provide a safer and better environment to the citizen and employees. Mr. Balogun added that the City Commission requested that the City administration forward a report that echoes the project will be completed before the summer. i Mr. Trautman questioned if the'services that the city provides were split between the main building and the old library. He also questioned if the east side of the City Hall there is a handicap ramp. Mr. Balogun replied that the services he identified included Central Service which is located behind the Silva Martin Building, City Clerk's office, and Human Resources; all three which are directly in front of office located in this building. A second phase consists of going through the front of City Hall and improves the front that will bring the sidewalk and the ramp all the way around to the north side of the building. In addition the parking lot on the north side will be improved. Mr. Chandler suggested that a permanent structure be constructed instead of a temporary structure. Mr. Balogun responded that the funds for a permanent structure must be secured. The next process is to include it in the five years Capital Improvement Plan. Mr. Balogun added that the awning is a temporary structure that could be removed during a hurricane and can be easily replaced. Mr. Fernandez questioned when the permanent structure will occur and if there was assurance that the permanent structure would be included into the Capital Improvement Plan. Mr. Balogun replied that there is no expected date because that is based on the budget. Mr. Trautman questioned if the color is going to be the same green. Mr. Balogun replied in the affirmative. This Board acted on the request and approved three of the four proposed awnings (B, C, and D). The Board however deferred the awning proposal labeled "A" (north entrance). At that Board's April 15, 2008 meeting the applicant resubmitted two different proposals ("L" and "T" configurations) which addressed the Board's recommendations made at the April 1, 2008 meeting. At that meeting the Board granted the applicant final approval, as presented, for the "L" shaped awning. STAFF ANALYSIS: On June 3, 2008 the applicant filed an appeal with the City Clerk to the decision made by the ERPB on April 15, 2008 regarding the "L" shaped awning installation which was proposed to be affixed to the north entrance of City Hall. On June 10, 2008 the appeal request was reviewed by the City Commission. At such time the Commission unanimously passed a motion that the awning request be remanded back to the ERPB with specific instructions for further action to be taken. Also, a connection is feasible from the beginning of the steps to Central Services. Mr. Fernandez asked if there were any other options explored for the. covered walkway such as a concrete roof or another structure. The applicant commented that the idea was not to provide a permanent construction, but rather a canopy type. Do not extend beyond eighteen (18) inches from any curb line, b. Do not exceed fifteen (15) feet in width or twelve (12) feet in height, c. Are not screened or enclosed in any manner, and d. Provide a minimum unobstructed, clear space of seven and one-half (7.5) feet between grade and bottom of valance. APPLICANT'S APPEAL The Land Development Code Section 20-6.2(A) provides that a decision or recommendation made by the ERPB may be appealed to the City Commission by the City administration, the applicant, or an interested citizen. Attached is an appeal filed by the applicant, City of South Miami Public Works Department, dated June 3, 2008. The City Commission has 60 days from the filing date to hear the appeal and enter a decision (reverse, affirm or modify the ERPB decision). At its April 15, 2008 meeting, the Environmental Review and Preservation Board (ERPB) approved the applicant's request for the installation of the awning with the "L" configuration located at the north fagade of 6130 Sunset Drive (ERPB-08-030). The applicant is contending that an alternative design for the awning (rejected by the ERPB) is preferred thereby resulting in the subject appeal. ERPB ACTION: The ERPB first reviewed the proposal for awning installation on April 1, 2008 and approved three of the four ("B, C, and D") awnings with conditions. The Board however, disapproved the awning labeled "A," which was proposed to be installed from entrance to Central Services to the north entrance of City Hall, including all of the brick patio in front of the building. At that time the ERPB expressed its opinion that the proposed awning labeled "A" was not only overwhelming and excessive but-also not in character with the design of the building. It was recommended that the proposal be redesigned to an "L" shaped configuration, connecting the entrance to Central services with the north entrance to City Hall. The Board felt that this limited design would be more compatible with the architectural design of the building. At the ERPB's April 15, 2008 meeting the applicant implemented the Board's recommendation and resubmitted two different awning proposals ("T" and "L") The ERPB approved the proposed configuration labeled "Alternative L." SPECIFIC APPEAL ITEMS: The appellant has claimed that the Board's recommendation of April 15, 2008 to approve only the "Alternative L" design failed to consider safety issues related to the weather elements and the adequate customer service that it will provide to the residents seeking services from both City Hall and Central Services. Therefore, the appellant requests that the City Commission reverse the decision made by the ERPB and approve the previously denied awning design "A" which was proposed on April 1, 2008. STAFF OBSERVATIONS: I. In order to properly review the appeal, attached to this report is the ERPB approval letter, application, staff report, meeting minutes, awning details, and photographs presented to the ERPB on April 15, 2008 for Item No. ERPB-08-030. The applicant requested that the awning cover the north entrance of City Hall however, the ERPB ruled that the awning with the "L" configuration will serve the function that the applicant desires. 2. The Planning Department did observe that the applicant's proposal is within the canopy guidelines pursuant Section 20-3.6(B)(5) of the Land Development Code and therefore staff supported approving any one of the four alternatives submitted. RECOMMENDATIONS (1) The City Commission may wish to affirm the ERPB decision; this action denies the application submitted by the Public Works Department. The awning would then be constructed in the limited"L" shaped design. (2) The City Commission may wish to reverse the ERPB decision; this action is essentially a modification of the ERPB decision allowing the applicant to construct the more extensive awning design "A"which was proposed at the April 1, 2008 meeting of the ERPB. STATUS UPDATE: At its April 1, 2008, Environmental Review and Preservation Board (ERPB), the Board granted approval of three of the four proposed awnings, "B, C and D" The awning located on the north fagade of City Hall, previously labeled on the-site plan as "A," was suggested by the Board to be restudied. The Board raised concern and questioned if different awning alternatives had been considered. It is important to note, that concerns about the awning design is justified because the existing City Hall building will be designated an historic site in the near future (fifty years old / designed by the most famous architect in South Florida). It is the Planning's Department observation that for the proposed awning to appear as a part of the building is difficult task. However, as indicated on the attached plans, Option Number One reflects the Boards' comments and concerns. The proposed awning design illustrates horizontal lines, which are best suitable with the architectural vocabulary of the existing building design. Furthermore, two additional configurations, "T and L," are attached for consideration and review if necessary. STAFF ANALYSIS: The subject property, City of South Miami Government offices consist of several detached buildings; City Hall, Sylva Martin, and the Police Department. It is proposed that one awning will be installed on the north side of City Hall leading to the Central Services Department at the Sylva Martin Building. The proposed awning will have new structural framework and will be consistent in color and material as the other three awnings previously approved by the ERPB on April 1, 2008. The awning color will be a solid Glade Green CP2711-62. The awnings as proposed, comply with the regulations as set forth in the Supplemental Regulations. Pursuant to Section 20-3.6(B)(5) of the Land Development Code, canopies are permitted as follows: 6130 SW 72 Street ERPB-06-030 presented on April 15, 2008 Awning Installation Page 2 of 2 CANOPIES may extend from the main entrance of a principal building to the street line in multi-family or nonresidential districts provided that they. a. Provide a minimum unobstructed, clear space of seven and one-half (7.5) feet between grade and bottom of valance. RECOMMENDATION: Approval with the following conditions: 1. STATUS UPDATE: At its April 1, 2008, Environmental Review and Preservation Board (ERPB), the Board granted approval of three of the four proposed awnings, "B, C and D" The awning located on the north fagade of City Hall, previously labeled on the site plan as "A," was suggested by the Board to be restudied. The Board raised concern and questioned if different awning alternatives had been considered. It is important to note, that concerns about the awning design is justified because the existing City Hall building will be designated an historic site in the near future (fifty years old / designed by the most famous architect in South Florida). It is the Planning's Department observation that for the proposed awning to appear as a part of the building is difficult task. However, as indicated on the attached plans, Option Number One reflects the Boards' comments and concerns. The proposed awning design illustrates horizontal lines, which are best suitable with the architectural vocabulary of the existing building design. Furthermore, two additional configurations, "T and L," are attached for consideration and review if necessary. STAFF ANALYSIS: The subject property, City of South Miami Government offices consist of several detached buildings; City Hall, Sylva Martin, and the Police Department. It is proposed that one awning will be installed on the north side of City Hall leading to the Central Services Department at the Sylva Martin Building, The proposed awning will have new structural framework and will be consistent in color and material as the other three awnings previously approved by the ERPB on April 1, 2008. The awning color will be a solid Glade Green CP2711-62. The awnings as proposed, comply with the regulations as set forth in the Supplemental Regulations. Pursuant to Section 20-3.6(B)(5) of the Land Development Code, canopies are permitted as follows: 6130 SW 72 Street ERPB-08-030 presented on April 15, 2008 Awning Installation Page 2 of 2 CANOPIES may extend from the main entrance of a principal building to the street line in multi-family or nonresidential districts provided that they: a. Do not extend beyond eighteen (18) inches from any curb line, b. Do not exceed fifteen (15) feet in width or twelve (12) feet in height, c. Are not screened or enclosed in any manner, and d. Provide a minimum unobstructed, clear space of seven and one-half (7.5) feet between grade and bottom of valance. RECOMMENDATION: Approval with the following conditions: 1. Canopy must be consistent with Section 20-3.6(B)(5) of the LDC; 2. Signage is not a part of this application; 3. Existing painted walls shall be retouched as needed; 4. Complies with the Florida Building Code; 5. Complies with the American Disability Act; 6. Landscape shall be installed as need; and, 7. Any comments and/or suggestions from the Bard. The applicant commented that the idea was not to provide a permanent construction, but rather a canopy type.
