3 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OY THE CITY OF
4 SOUTH MIAMI, AUTHORIZING THE CITY MANAGER TO INITIATE A PROPERTY
5 ACQUISITION PROCESS (INCLUDING PAYMENT OF APPRAISAL FEES UNDER
6 THE MAXIMUM ADMINISTRATIVE EXPENDITURE LEVEL) WITH THE TRUST
7 FOR PUBLIC LAND IN ORDER TO ACQUIRE VACANT LAND LOCATED AT 6540
8 MANOR LANE FOR PARK PURPOSE; FURTHER AUTHORIZING THE CITY
9 MANAGER TO PLACE THE PROPOSED ACQUISITION IN THE PROPOSED
10 CAPITAL IMPROVEMENT PLAN (FY 2008/09 — 2012/13); PROVIDING FOR AN
11 EFFECTIVE DATE.

13 WHEREAS, a .40 acre vacant property located at 6540 Manor Lane zoned for low
14 density town -homes is currently for sale; and
15
16 WHEREAS, the subject property would be an excellent location for a passive park for
17 the surrounding residential community, and would also provide a connection to certain street
18 improvements and bicycle paths being considered for SW 801' Street; and
19
20 WHEREAS, the acquisition of this property would add needed open space acreage to
21 maintain the City's concurrency level of service for recreation and open space; and
22
23 WHEREAS, the City of South Miami has received assistance in the past from the Trust
24 for Public Land for the purpose of acquiring park and open space land ; and
25
26 WHEREAS, the City Manager may need to expend appraisal fees as part of the
27 acquisition process with the Trust for Public Land, said fees must be below the maximum
28 administrative expenditure level ; and

30 WHEREAS, the City Manager is authorized to place the subject acquisition in 'the
31 proposed Capital Improvement Plan (FY 2008/09 — 2012/13); and

34 NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY
35 OF SOUTH MIAMI, FLORIDA:

37 Section 1. The City Manager is authorized to initiate a property acquisition process with
38 the Trust for Public Land for the purpose of acquiring park and open space land by the purchase
39 of vacant property at 6540 Manor Lane.

41 Section 2. The City Manager is authorized to expend appraisal fees as part of the
42 acquisition process with the Trust for Public Land, said fees must be below the maximum
43 administrative expenditure level.

46 Section 3. The City Manager is authorized to place the subject acquisition in the
47 proposed Capital Improvement Plan (FY 20.08/09 — 2012/13).
