We expect to demolish the existing residence and build a two story office building within the next two years. In the interim, we request special exceptionto permit the parking of vehicles within the space allotted by the existing landscaping. South Miami code requires a 9' by 20' parking space. We have a few spaces that are only 8' between the existing trees. The driveway has a tree which encroaches into it, that we would also like to save at this point in time. In as much as the area is still in its transitional period, maintaining the beautiful rear yard in its present state would be in keeping with the overall present use of the surrounding properties which, although they are zoned RO, are being used as residences. Your building and zoning department has requested that five off- street parking spaces be provided. We are providing fifteen (15) spaces which will also take care of the four off-street parking spaces required for our present building at 7615 S. W. 62nd Avenue. Kimmons, Secretary of the Planning Board, was asked to obtain parking ordinances from the City of Coral Gables and Dade County and distribute same to the members of the Planning Board for study and further discussion at the next meeting. Location: 7615 S. W. 62nd Avenue . Mr. Lemuel Ramos appeared before the Board and presented his request. Mr. Bra.m read into the Minutes a Memorandum from Herman R. Lichtman, Director of Public Works to the Building Official advising of the ruling of the City Attorney, Ed Moore with regard to this request, to-w-,It: "Off-street parking requirement cannot be waived (4-1-5) but requirements can be modified by variance. " A discussion was had by the Board with regard to the number of parking spaces required and as to how the Planning Board could legally recommend granting this request. Mr. Coburn pointed out that this request involved a temporary situation of a. two-yeas period, and that Mr. Ramos had_ received a letter from the owner of the parking lot across the street granting him permission to use six parking spaces . MOTION: By Mr. Fleischer, seconded by Mr. Coburn, to recommend approval of the request if the. Legal Description: Lot 3 and South �2 of Lot 2, Block 3, Larkin Pines, PB 24/20. Location: 7615 S. W. 62nd Avenue Mr. Ramos presented his request to the Board stating that he had received a. letter from Mr. Raymond Ross, owner of the Shopping Center a.ccross the street from his property, giving him permission to park six cars in the Shopping Center parking lot. This letter was in the file together with a petition signed by the adjacent property owners expressing their wish to allow him to leave the rear yard in its present condition; copies of a plan showing the revised location of the office number sign and color photographs of the exterior showing the decorative wood grill which will be stained in the near future. He stated that he expects to demolish the existing residence and build a. two-story office building within the next two years . He stated that inasmuch as the area. is still in its transitional period, maintaining the beautiful rear yard in its present state would be in keeping with the overall present use of the surrounding properties, which, although they are zoned RO, are being used as residences . Mr. Ramos stated that the Building and Zoning- Department ha.s requested that four off-street parking spaces be provided, and therefore he is procuring six parking spaces in the parking lot across the street. Mr. Fleischer stated that he was concerned as to whether or not the Planning Board had legal authority to recommend granting or denying the request to the City Council. A discussion was had by the Board members . Mr. Fleischer asked if there was anyone present who wished to speak either for or against the request and .there was not. MOTION: By Mr. Fleischer to defer. action on this request to the next meeting and request that the City Attorney offer an alternate solution that will allow the Board to approve the request.
