That applicant has requested that the south lot and 2 of his property be rezoned from RO to C-3. At present, the zoning boundary splits his property and, in fact, the existing gas station building, in half. This appears to have been a draft- ing error during the 1971 zoning process. The proposed change of zoning is consistent with the adopted Comprehensive Plan and would still retain a significant RO buffer between this subject property and any surrounding residential properties. Therefore, Staff recommends approval . 2. The applicant will be- dedicating an additional ten�feetf of right-of-way along- S.W. 62nd Avenue and, as a .result ,of-thaat dedication and the odd shape of the lot, is asking to be allowed to provide ten feet side setback where twenty feet is normally required. Due to the hardship created by the odd shape of the lot and the surrounding traffic patterns on driveway location it would be impossible for the developer to provide the entry court envisioned in the proposed plans if the full twenty foot setback was required. Likewise, the existing structures immediately to the south in the RO district have setbacks of fifteen and .3 feet respectively. Due to the RO FAR limitations these buildings are not likely to be replaced. Specifically, the corner building which has a .3 foot setback contains 4,099 sq. ft. and could only be re- placed by a 4,606 sq. ft. building. Therefore Staff recommends approval . It 3. It is to the City's advantage to get this driveway as far away from S.W. 62nd Avenue as possible and therefore Staff recommends approval . 4. Due to the odd shape of the lot and the traffic impact on drive- way location, this deck was the only means available to gain addi- tional parking. Likewise, although this setback is at,:the rear of the lot in question, it will effect the neighboring property as if it were a side setback where only 10 feet would be required. Fur- ther, height of the proposed parking deck is only 4.5 feet so there should not be any significant impact on the neighboring property. Therefore, Staff recommends approval . 5. and 6. Staff recommends approval subject to a condition that no medical offices be allowed on this site unless the full number of parking spaces can be provided. -1- 7. Staff recommends approval due to the fact that it is highly unlikely that U.S. 1 will be widened any time in the foreseeable future and therefore the effect of this variance is negligible.: Likewise, requiring the full 20 feet would significantly reduce..,the number of parking spaces. There being no one else caring to speak for or against the request of the applicant , Chairman Michelson deemed the public hearing closed . In response to the request of the Board , Mr . McDowell stated that if the entire property was developed under the RO regulations the applicant could build a maximum of 8 ,067 . 9 square feet of development on the property . The building proposed is approximately 20 ,000 square feet , somewhat less than one-half that would be allowed under the R0 . He stated he recommends approval of the change of zoning as requested . The front portion of the property is currently zoned C-3 . Due to the shape of the property it would be virtually impossible to build any building within that one piece of C-3 property . He stated that it was his opinion this was probably a drafting error in the original zoning ordinance adopted in 1971 . It is not typical in developing Page 2 - 10/26/82 jk a zoning map or ordinance or comprehensive plan to draw a boundary line that splits an existing building in half--and this zoning splits the existing gas station directly in half so that one-half of the building is C-3 and one-half of the building is R0 . Under RO the gas station could not have been built , so at some point this property had to have had a different zoning on all of it . So the staff recommendation on the rezoning is to approve . He stated he would like to point out that this will not endanger any of the surrounding residential areas . It is also in conformance with our comprehensive plan . There will be significant RO property to the south of this property . If this lot is rezoned there will still be two and one-half lots to the south of the property towards 76th Street that will remain as R0 . Likewise , the five lots behind it , two of which have a two-story doctor' s office immediately behind this property heading toward the RM-18 property is also R0 . So there remains a significant RO buffer between this property and the surrounding residential areas . As to variance #2 , to allow a 10 foot side corner setback where 20 feet is normally required , Mr. McDowell stated that the applicant will be dedicating an additional ten feet of right-of-way along S . W . 62nd Avenue and , as a result of that dedication and the odd shape of the lot , is asking to be allowed to provide ten feet side setback where twenty feet is normally required . Due to the hardship created by the odd shape of the lot and the surrounding traffic patterns on driveway location it would be impossible for the developer to provide the entry court envisioned in the proposed plans if the full twenty foot setback was required . Likewise , the existing structures immediately to the south in the RO district have setbacks of fifteen and . 3 feet respectively . Due to the RO FAR limitations these buildings are not likely to be replaced . Specifically , the corner building which has a . 3 foot setback contains 4 ,099 sq . ft. and could only be replaced by a 4 ,606 sq . ft. building . Therefore , Staff recommends approval . As to variance #3 , to eliminate 5 foot landscaped island adjacent to the driveway along the northeast property line , it is to the City ' s advantage to get this driveway as far away from S . W. 62 Avenue as possible and therefore Staff recommends approval . As to variance #4 , to allow a parking deck of no more than 4 ' 61' elevation with a rear setback of 5 feet where 20 feet is normally required along a portion of the south property line , due to the odd shape of the lot and the traffic impact on driveway location , this deck was the only means available to gain additional parking . Likewise , although this setback is at the rear of the lot in question , it will effect the neighboring property as if it were a side setback where only 10 feet would be required . Further , height of the proposed parking deck is only 4 . 5 feet so there should not be any significant impact on the neighboring property . Therefore , Staff recommends approval . As to variances #5 and #6 , variance to allow 71 parking spaces where 73 spaces are normally required and variance to allow 28 compact parking spaces where 26 spaces are normally allowed , staff recommends approval subject to a condition that no medical offices be allowed on this site unless the full number of parking spaces can be provided . Page 3 - 10/26/82 jk As to variance #7 , to allow a 16 foot front setback and one foot landscaped strip along U . S . 1 where' 20 feet and 5 feet are required respectively , staff recommends approval due to the fact that it is highly unlikely that U . S . 1 will be widened any time in the foreseeable future and therefore the effect of this variance is negligible . Likewise , requiring the full 20 feet would significantly reduce the number of parking spaces . Discussion ensued and some of the Board members stated there was no hardship to justify granting the variances . They also felt the building was too large for the site and would generate a dangerous' amount of traffic on South Dixie Highway and S . W. 62nd Avenue . MOTION : By Mr. Smith , seconded by Mrs .
