RESOLUTION OF CITY OF SOUTH MIAMI, FLORIDA,
REZONING TO RU-3 USAGE AND GRANTING SETBACK

DIVISION PB 4/111; GRANTING VARIANCE PERMITTING
PARKING ON LOTS 1 THROUGH 5• LOTS 23 THROUGH 26

PB 41/41 IN CONNECTION WITH CHURCH BUILDINGS
LOCATED ON LOT 22 THROUGH 27 HOBBS 'SUBDIVISION,
PB 4/111.
WHEREAS, First Baptist Church of South Miami duly made application
for rezoning to RU-3 of Lots 26 and 27 HOBBS SUBDIVISION, PB 4/111
and for variance as to spacing requirements so as to permit a church
building thereon and further made application so as to permit off
street parking as hereinafter set forth, and
WHEREAS, the Planning and Zoning Board of the City duly held a
public hearing on said application and recommends that the afore-
mentioned Lots 26 and 27 be rezoned to RU-3 and a variance granted
as to set-back requirements as requested and further recommends that
off-street parking be permitted on a separate site from the principal
site as hereinafter set forth, and
WHEREAS , the City Council, after the hearing of interested parties
and considering the recommendation of the Planning and Zoning Board,
finds that the proposed zone usage of RU-3 would constitute a . reasonable
usage of said lands compatible with the comprehensive zoning of the
City and further finds that the existing zoning requirements and regula-
tions would constitute undue hardship if the variances hereinafter
set forth were not granted;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF CITY OF
SOUTH MIAMI; FLORIDA:
1. Those certain lands legally described as to-wit;
Lots 26 and 27 of HOBBS SUBDIVISION, according
to the Plat thereof as recorded in Plat Book
4 at Page 111 of the Public Records of Dade
County, Florida,
are hereby rezoned to RU-3 zone usage and the Zoning Director of the
City is hereby authorized and directed to make the necessary changes
upon the official zoning map of the City.
2. A variance is hereby granted waiving the set-back requirements
on the North, South and East of the aforementioned property and permit-
ting a westerly set-back of 10 feet so as to permit the construction
of a church building on the aforementioned property.
3. A variance is hereby granted so as to permit offstreet. parking
on those lands legally described as , to-wit:
Lots 1 through 5; Lots 23 through 26, and South i Lot '6
and South 2 of Lot 22 of POINCIANA PARK, according to the
Plat thereof as recorded in Plat Book 41 at Page 41 of
the Public Records of Dade County, Florida.

Enclosed herewith you will find two applications for
re-zoning, together with supporting documents on real. property
described therein , owned by the. First Baptist Church of South
Miami. , who is making the application. The properties con-
tained i'n the two applications are contiguous ; S:W. 62 Avenue.,
. S.W. 62 Court runs between the two properties . The primary
reasonshfor the Application requesting re-zoning are as follows :
1 . The general area , and more. particularly contiguous
property and property in the immediate vicinity, has
undergone a change as to use and nature, which
change. is continuing to expand.
2. Inasmuch as the nature, and use of property in the
gener:al area has changed , it is realistic and
practical that the herei.n property should be per-
mitted to conform as to' zoning classification.
3. The parking lot area on th.e east side of S.W.62 Avenue
and to� th.e east of the Church property , owned by the
Church , ' has already been re'-zoned for .commercial
business use. Th.i's property is used by th.e Church for
parking facili'ti'es . The South Miami Hospital has been.
permitted by the Church to use the parcel for parking
purposes .
4. The Church intends , of necessity, to inaugurate an
expansion program on the property for which ap-plica-
tions for re-zoning have been made.
In considering the. Appplication. it is necessary, in con.nection
ts
with the Lhurch ' general program, to .consider the two Applications
as one. They are being made separat.e.ly because of the g.rouping
of the lots involved.
