OF ORDINANCES, CITY OF SOUTH MIAMI, FLORIDA,
TO AUTHORIZE ISSUANCE OF A CONDITIONAL PER- '
MIT TO DAVID R. RIFAS, TRUSTEE, HIS SUCCESSORS
AND ASSIGNS, TO CONSTRUCT A RECUPERATIVE AND
EXTENDED HOSPITAL CARE FACILITY ON PROPERTY
DESCRIBED .HEREIN; AND, PRESCRIBING PENALTIES
FOR VIOLATION OF THE PROVISIONS HEREOF.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF CITY OF
SOUTH MIAMI, FLORIDA:
Section 1. That the provisions of Sec. 20-22 (3) of
Chapter 20, Code of Ordinances, City of South Miami, Florida,
be and the same are excepted from insofar as the following
described real property is concerned, to-wit:
Lots 1., 2,3 ,4,5 and the South 25 ' of
Lot 6; the South 25 ' of Lot 22, and Lots
23 , 24,25 and 26, POINCIANA PARK, REVISED,
according to the Plat thereof recorded
in Plat Book 41 at Page 41, Public Records

of Dade County, Florida,
to grant to DAVID R. RIFAS, Trustee, his successors and assigns,
a permit to use said property for a recuperative and extended
hospital care facility, subject to the following conditions and
requirements, to-wit:
i a. That only mentally competent patients will
be admitted.
b. That no operating equipment or facility shall
be employed or maintained on the premises .
! c. That, by intent and operation, it be limited
to operation as a recuperative, rehabilitation
facility with therapy departments other than
major surgery.
d. That all improvements constructed and used on -
said real property shall conform with applic-
able building requirements and a previously
submitted plot plan including but not limited
to off-street parking requirements .

e. That said facility, so constructed and used,
shall comply with all Federal and State
licensing laws and applicable Dade County
Code requirements .
Section 2. That any person, persons, firm, partnership ,
or corporation violating any of the provisions of this ordinance
shall, upon conviction, be punished by a fine not to exceed
$500.00, or by imprisonment not to 'exceed six months, or by
both such fine and imprisonment in the discretion of the
Municipal Judge. Each day that a violation is permitted to
exist shall constitute a .separate offense.

Procedure on Application for Hearing Before the Planning Board
1, Secure application forms from the Zoning Director's. Office,
2, Have sketch or plans with sufficient details indicating the variances or exceptions
requested. For change of zoning, plans may not be required. The applicant is
instructed that a separate application will be required for variances and exceptions
after the change of zoning has been granted by Council.
3, Fill out the application completely and accurately with surveys, photos, plans, etc,
as needed before submitting to the Zoning Director.
4. Submit the application to the.Zoning Director at least fourteen (14) days prior to
the meeting. A fee of $30.00 is required at the time the application is filed,
5, Regular Planning Board meetings are held twice per month, on Tuesday preceding the
regular Council Meeting. (Council meets on the first and third Tuesday of each
month). The meetings are held in the Council Chambers, City Hall and begin at
8:00 o'clock P.M.
6, The applicant (or his agent) should represent himself at the Planning Board meeting,
The applicant will be expected to present his case with plans, petitions, affidavits
or any other data which he feels will help in his presentation, The Planning
Board will act on the application based on the information available if no. one is
present to speak on behalf of the applicant.
7. The Planning Board will make its recommendations to the Council which will then
act on them,
8. The applicant should be present at the Council Meeting to present his case at which

Gentlemen :
I represent and am part of a group of substantial persons
who intend to build a Recuperative and Extended Hospital Care
facility on the land located partly in the 7300 block and
partly in the 7400 block of Southwest 62nd Avenue, on the
East side thereof, in South Miami, Florida . For your
convenience, we have attached hereto a list of the interested
parties.
Our proposed plans call for a 250 bed Recuperative and
Extended Hospital Care facility that would be superior to
any privately operated facility in the State of Florida . We
have made arrangements with Mr. Raymond Poore and Mr. Leon
Tishman to act for us in an advisory capacity. We have also
employed the firm of Irani Associates, Inc. as our architects
and engineers on this project.
Please note that the land described above lies on a direct
route from Baptist Hospital, South Miami Hospital and Mercy
Hospital, and is in close proximity to other hospitals in
the area . The medical practitioner who would travel from
the Jackson Memorial Hospital complex to Baptist, South Miami
or Doctors hospital would either .pass our site or would be in
close proximity to it.
We propose, if possible, to take in patients for recuperative
purposes rather than patients who might be considered terminal
cases. This would, therefore, require extensive therapeutic
units. In a general hospital, therapeutic activities are
usually ancillary to the regular hospital care. Our facility,
of necessity, would be built around these therapeutic activities.

This project would add dignity and stability to our com-
munity without causing harm or loss to the adjoining areas.
It would contribute to improving the health and welfare of
