In order to build to 8 stories without residential floors, a project must have underground parking, a "cross-through," a minimum 5,000 sq. ft. public plaza, and develop full frontage with street design as part of the pedestrian walkway system. This plan does have underground parking and a "cross-through," but does not depict a public plaza or designed frontage• as part of the pedestrian walkway system. The "cross-through" and public plaza could be incorporated together. However, the current "cross-through" is only 1,200 sq. ft., 3,800 sq. ft. less than the required minimum. IV.Reminders: • Arcade or Awning is required. • Buildings shall abut the street-front sidewalk and orient the primary entrance or entrances toward the street. • Street trees are required. • Service and loading areas shall not be visible from public streets and adjacent residential properties. Building and Its Placement Please be aware that the structure must comply with all provisions of the Land Development Code; more specifically, it should comply with the following regulations: Section 20-8.8(D) • Garage structures must be designed or landscaped so as to either appear to be a floor of the building or obstructed from street view. • All garages must be at the rear of the building. Garages may go through to the street above the first floor, providing it looks the same as the face of the building above. • The ground floor on the sides facing any street shall contain any uses indicated on the permitted ground floor uses in Section 20-8.5. Section 20-8.9(F) • Where there is no minimum distance between adjacent buildings, nor a minimum building setback from a property line, one of the first two of the following conditions must be met: 1. If the distance from the exterior wall to the property line is less than five feet, the applicant must show evidence of a maintenance easement from adjacent property owner(s); or 2. The structure shall be built on the property line and the owner shall give an attachment easement to the adjacent property owner(s). Section 20-8.15 • When necessary for public convenience or safety, the developer shall dedicate to the public access ways to pass through oddly shaped or unusually long blocks, to provide the networks or public paths creating access to parks, schools, mass transit facilities and community services. • Buildings shall abut the street-front sidewalk and orient the primary.entrance or entrances toward the street. Based on the City of South Miami TODD ordinance we have proposed a 6- story detached parking garage which will provide a pedestrian walk-through to the park to the east of the building and improvements to the pedestrian sidewalk in front of the building at S.W. 62 Avenue. These two items provide us with two bonuses according to TODD which will allow us to build two additional floors on our project. In concert with your approval of our request, we will revise our drawings to incorporate the following requirements: 1. The pedestrian walk-through will be enlarged to a 10-15-ft. width and will be re-designed to exhibit a substantial enough presence as a cross-through from 62nd Avenue to the park. 2. The building facade at 62nd Avenue will be repositioned 8 ft. back from its present design to provide for a wider sidewalk that incorporates landscaping and pedestrian purposes. Re: A/C SCREENING - 7211 S.W. 62 Avenue File #EB-92-007 Dear Mr. Berg: At the suggestion of Ms. Sonia Lama of the South Miami Building and Zoning Department, we are directing this inquiry to you because of a problem we are having with Ms. Lama' s department concerning the applicability of a code provision to the replacement of air conditioning units on our building. We (a partnership composed of Edward L. Magill, Esq. , Francis A. C. Sevier, Esq. , and Oswald H. Coury, M.D. ) are the owners of an office building located at 7211 S.W. 62 Avenue, South Miami, Florida. We have owned that building continuously for the last 13 years. During the past several weeks we have replaced five (5) air conditioning units and there began our tale of unbelievable and unfathomable woe. Although you may be somewhat familiar with the scenario of events which have given rise to our problem, some historical background may be useful to you in understanding and appreciating our position. . First, as indicated above, we replaced five (5) air conditioning units in the exact location where they were previously located. The size, location, format, and appearance of these units varied insignificantly from those which had been in existence since the building was constructed. There was no change in duct work, insulation, roof, structure or electric. As you can see from the attached invoice of Classic Air, Inc. the work was solely replacement and not new construction. The cost of the undertaking was $29, 976. 00. Mr. Martin D. Berg February 28, 1992 Page No. 2 When Classic Air applied for a permit, we learned that the City of South Miami would not permit us to install the air conditioning units until we conformed with the Building and Zoning Department's interpretation of a code provision regarding screening for NEW air conditioning units, even though the units were being installed on an emergency basis. At about that time, Mr. Magill spoke to you about the problem. In turn, you spoke to the City Manager, Bill Hampton, who permitted the installation to go ahead after he confirmed the emergency and we put up a $5, 000. 00 deposit with the City. Thereafter, our air conditioning contractor, Classic Air, without our knowledge, authority, agreement or permission submitted three (3) proposals to the City of South Miami regarding the screening of these units. The Environmental Review and Preservation Board (ERPB) at a meeting on 21 January 1992--at which we were unrepresented because of lack of knowledge and notice--one of the three (3) proposals by Classic Air was preliminarily approved. (Notice of that approval was mailed to us on 24 January 1992 . ) The cost of the screening in the chosen proposal, which naturally is the most expensive of the three (3) proposals, is more than $10, 000. 00; excluding the cost of tying the new screening structure into and under the roof, which will be more than $5, 000. 00 additional . Of course, the screening performs no useful function. Needless to say, there is not a single building in this area, including those belonging to the City of South Miami, that complies with this provision of the code as it is construed by Ms. Lama. Thus, we are confronted with incurring costs for decorative screening well in excess of $15, 000. 00 when in both fact and law we had no opportunity to be heard. Further, we do not now and never have agreed with South Miami's interpretation of the code as applied in this instance. Ms. Lama and the members of her department decided the code applied to our situation because they opined that is what the .City Commission intended. The section of the code at issue is Section 20-4 . 5 ENVIRONMENTAL REVIEW STANDARDS. We have been directed to the following portions of that code, as relied upon by the City of South Miami, to support its position that we must screen our replacement air conditioners: The following standards shall be utilized by the Environmental Review and Preservation Board in their (sic) review Mr. Martin . D. Berg February 28, 1992 Page No. 3 and evaluation of all site and landscape plans as required by this Code. (D) SIGNS AND STORAGE (2) Exposed storage areas, machinery, service areas, utility buildings and structures and similar accessory areas and structures shall be subject to such placements, screen plantings or other screening methods as shall be reasonably required to prevent their being incongruous with the existing or, contemplated environment and surrounding properties. It is our position, which we intend to have a court of competent jurisdiction evaluate if necessary, that the code, as presently drafted, has no applicability in our situation. But why such a firm belief and conviction in our position? Because under the most rudimentary rule of syntax and statutory construction the code has no applicability to our air conditioners. For example, the code applies to exposed storage areas machinery service areas utility buildings utility structures (One must read "utility" as a distributive adjective which is descriptive of "buildings" and "structures" rather than part 'of a compound noun meaning "public utilities. " Further, the simplest English syntax requires "exposed" to be distributive across the five categories enumerated. ) But the air conditioners are NOT . exposed storage area, they are NOT exposed machinery, they are NOT exposed service areas, they are NOT exposed utility buildings, Mr. Martin D. Berg February 28, 1992 Page No. 4 and they are NOT exposed utility structures. Next, if one applies the elemental principle of statutory construction "expressio unius exlusio alterius" to the remainder of the categorization or classification portion of the code, one arrives at the same result, i.e. , similar accessory areas similar structures comprise the catch-all categories of the code section. But under the doctrine of "expressio unius exlusio alterius" these catch-all categories are "similar" to those in the preceding enumeration, i.e. , exposed storage area, exposed machinery, exposed service areas, exposed utility buildings and exposed utility structures. And, if the requirement is not specifically set forth in the statue (code) it is deemed EXCLUDED. Accordingly, the replacement air conditioners, and indeed any air conditioner, are NOT similar accessory areas or similar structures. The remaining portion of the code is equally inapposite to these air conditioners. The code provides: ***shall be subject to such*** other screening methods or shall reasonably be required to prevent their being incongruous with the existing or contemplated environment and surrounding properties (emphasis supplied) . Since we are replacing, and thereby changing nothing, and since the air conditioners which were replaced were consistent with (indeed were part of) the existing environment and surrounding properties, then it is evident the replacement air conditioners are not incongruous with the existing environment and surrounding properties. But are they incongruous with the contemplated environment? This phrase is so vague, uncertain and indefinite as to hardly warrant comment--it could never pass any legal muster since it is so subjective and ephemeral as to be a transitory daydream. s? , Mr. Martin D. Berg February 28, 1992 Page. No. 5 And even if the concept of replacement is not relied upon, the air conditioners are NOT incongruous with the existing environment and surrounding properties. Indeed our extensive investigation of buildings in South Miami, including the municipal buildings, indicate that our air conditioners are in the same condition, format, degree of exposure; and so forth as ALL buildings in the city. It is not our desire to go to war with the City over this issue. What we would like to obtain, at the operational level of municipal government if possible, is a sensible resolution of this issue. We do, after all, pay sustantial taxes to the city. We don't expect much nor do we receive much from the city in return. However, we do not think it proper for municipal functionaries to be able to inflict sustantial financial harm upon us without a legitimate reason. Perhaps it would be a good idea if they were reminded once in a while that they are supposed to be "public servants, " and while they may be incapable of providing any useful services for the taxpayers, they should refrain from doing them any harm. It is not difficult to understand why the American public generally is thoroughly disgusted with government at every level. We. agree that the air conditioners, which are now painted in their delivered condition of preservation oxide paint should be painted in conformity with the color scheme of the building (as has been done on some of the surrounding properties in the existing environment) . We would like to have the opportunity to discuss this matter with you personally and take you on a tour of the neighborhood so that you can observe all of the building air conditioners in the area. Then you will fully appreciate our position. Finally, if the City of South Miami will not agree with our interpretation of the code, then we request that this matter be placed before either the City Commission or the ERPB, whichever is the appropriate body, for hearing and decision .so that we may exhaust our administrative remedies prior to litigation. i.
