A building permit has never been issued by the City of South Miami for the subject project. Only an application for a permit was submitted and it is being processed for approval. This was clearly stated during our meeting last May 19th and confirmed by your consultant, Ms. Judi Witkin, in her e-mail dated May 23, 2011 as per attached copy. 2. What was actually agreed is that the City would keep the original permit application active subject to the construction documents being updated to conform with the current building codes; and under the condition that the project scope would not change from that previously approved by our Planning/Zoning Department. 3. Our permitting process requires that the construction documents be first reviewed by the Miami-Dade County Fire, Water and Environmental departments before we process them in our offices for compliance with the current edition of the Florida Building Code. We submitted the last revised set of plans to the County for their review on or about April 2010. The plans were subsequently retrieved by Ms. Witkin, and to the best of our knowledge are in her custody. The timetable for further processing of the plans by the County is currently under her control, not ours. 4. If and when the.County approves the drawings and they are returned to our office for further processing and approval, and upon payment of the appropriate permit fees, a building permit may/could be issued provided any and all other City concerns, if any, are satisfied. Mr. Schulman: It appears from what you wrote that the owner started processing of his plans in August of 2008 but then didn't do anything for over a year. Then in 2010 it re-submitted the plans. It would appear that the owner got wind of the fact that the City was contemplating an amendment to ordinance 20-8.9 and then got busy and resubmitted its plans on or about April 23,2010.In the mean time the City proceeded with the process for amending its special exception ordinance to provide a limitation period for both obtaining a construction permit and for completing construction. Now that I have had a chance to explore this matter with our new Planning Director, and after further research of our Land Development Code and Florida Statutes, I have reconsidered my initial opinion. I believe that the special exception is merely a development order because it does not comply with the statute governing development agreements. Therefore, the development order does not immunize the owner from the effect of future changes to the Land Development Code as would a development agreement. See Smith v City of Clearwater,383 so.2d 681 (Fla. 2nd DCA 1980). Please advise your client of the amendment to Ordinance 20-8.9. While it does not apply to him as to the initial 2 year limitation period, it does apply as to the limitation for completion of construction. I will advise the building department to release the hold on the permit processing.
