Dear Soheila:
This letter addresses the zoning questions you raised in your telephone call yesterday,
which were further elaborated in the facsimile transmission you sent today.
1. What is the zoning on 7051 SW 62nd Avenue (hots 10-11 & 16-17 Blk 1 less
W10 Ft of Lots 16 & 17, Larkin Center)?
The zoning map shows the boundary between H Hospital and MO Medium
Intensity Office districts bisecting the parcel in question. A greater portion of the
parcel appears to be in the MO district.
In general, zoning district boundaries are not drawn purposely to divide a lot into
two different districts. As is stated in Sec. 20-3.1(D)(1), "District boundaries are
usually along streets, alleys, property lines or extensions thereof."
In drawing the zoning map, it was not our intention to divide this lot between two
districts. Rather, we attempted to draw the zoning district boundary along the lot
line closest to the extension of the southern right-of-way line of SW 71st street,
consistent with the City's Future Land Use Map.
It appears that we may have inadvertently drawn the line along an obsolete lot line.
If that is the case, and the parcel identified above is a single lot, then there would
appear to be sufficient uncertainty about the location of the boundary line to allow
staff to use administrative discretion to determine the actual location of the district
boundary line. One of the guidelines to be used in such cases of uncertainty is that
"district boundaries shall be construed to be the lot lines" (Sec. 20-3.1(D)(2)(d)).
Since the majority of the lot appears to be in the MO district, it would be
reasonable to determine that the entire lot lies in the MO district.
2. ,/ What are the dimensional requirements for the H district?

3. How should a wholesale car dealer be classified?
There are two land use categories into which a wholesale car dealer could be
classified: automobile dealer or wholesale sales and storage. Since neither term is
defined, the SIC manual should be used as a guide (Sec. 20-3.3(C)). The SIC
manual classifies wholesale auto sales as 5012, which would fall under wholesale
sales and storage (500). The SIC code specified for retail automobile dealerships
is 551.
If the City is convinced that the proposed use is in fact going to be limited to
wholesale sales, it should probably be classified as wholesale sales and storage.
