Martin Berg arrived and stated to the Board that he was required
to appear in court at this time on behalf of the City for an
emergency injunction, therefore, begged the Board's indulgence and
asked to be excused.

the proper permit after having received noticefrom the .City, the
work has been inspected and everything is in order at this time.
Mr. Auerbach used this opportunity to appeal the fines and extra
fees. He bases this request upon his statement that he had assumed
that the general contractor had applied for and received the proper
permit prior to beginning construction, which he later found not
to be true.

Officer David Walker reviewed the case history. The detachable
sign was erected without a permit as well as being too large
according to City Code. It has since been removed and replaced
with another sign which was also not applied for or approved. They
have applied for a sign permit which is not for the sign they are
presently using. The detached sign had been removed from its
location in the ground after the citation was issued and mounted
on the wall of the building.
Drs. S. Mekras and George Suarez signed in and addressed the Board.
Dr. Mekras stated that they had a permit for a temporary sign,

dated 6/14/90. The doctor stated that, at that time, they asked
their sign contractor to reduce the size of the sign and place it
on the wall of the building. The size of the sign was changed but
then replaced in the same location. A few days later, the sign was
removed and placed on the building. Dr. Mekras displayed a letter
from Acting City Manager Perry Turner notifying him of the
specifications of the sign as well as a reminder that the permit
will expire 30 days from the date of issue (6/14/90) . An extension
on the 30 day temporary sign permit is also being requested.
Mr. Ball indicated that the temporary sign receipt dated 7/18/89
shows that the permit was issued for an 18.8 sq.ft. allowable
maximum size. The receipt from the sign company shows a much
larger sign was contracted for, so, technically, the 'sign has been
impermissible since it was first erected. (The date of the receipt
should read 1990. )
B & Z Director Sonia Lama stated that, under the City's present
zoning code, a temporary sign can only be allowed for a period of
30 days and the time cannot be extended.
The request is to allow the temporary sign to remain past the 30
day limit or until construction starts, which will not be for 30
days.
Mr. Ball reiterated the code as stated by Ms. Lama, and that,
should the sign remain after August 17th, it would be in violation.
He also stated that this Board does not have the power to extend
the 30 day time period. This would have to be done through the
variance process. Ms. Lama advised Drs. Mekras and Suarez to go
to the Building and Zoning Department later in the day or whenever
it is convenient and alternate solutions to the problem will be
addressed.
Mr. Basu made a motion to dismiss as there is no violation as this
point. Seconded by Mr.Ball.

The issue of the trees is still to be addressed. There were
protected trees as well as unprotected ones removed from the site.
The contractor had come into the B & Z Department at one time but
has not returned to obtain the proper permits. Dr. Mekras stated
that it is their intention to plant a ficus hedge along the
southern edge of the property. Ms. Lama stated that according to
the Dade County Tree Ordinance, penalties are not accessed for the
removal of trees. However, replacement is required with trees with
the same canopy, species or other acceptable species.
Mr. Ball made a motion to defer this case for 60 days (the CE
meeting of October 11th) , with Code Enforcement monitoring for that
period. Seconded by Ms. Glover. If Staff is satisfied that there

is no further violation occurring, the case will be closed at that
time.

(G) Prohibited Signs and Sign Characteristics
No sign shall be constructed, erected, used, operated or
maintained which:
( 1 ) blinks, flashes , rotates or displays intermittent
lights similar to or resembling flashing lights
customarily associated with danger or customarily
used by police, fire or other emergency vehicles.
(2 ) uses the words "stop" or "danger" or implies the
need or requirement for stopping; or which is a copy
or imitation of an official sign. Prohibition of
the words "stop" or "danger" does not apply in
instances when such words are used in descriptive
lines of advertising, so long as they are not used
to copy or imply any official traffic warning.
( 3 ) creates a blended background of colored lights with
traffic signal lights which might confuse motorists
when viewed from a distance of up to three hundred
( 300) feet.
(4) projects over any public street, sidewalk or alley
in a residential zoning district.
(5 ) is a snipe sign.
(6 ) is a balloon or blimp.
( 7 ) is located on the roof or extends above th parapet
of a building.

INSTRUCTIONS FOR ERPB APPLICANTS
SUBMISSION RECIUIREMENTS AND GUIDELINES
NOTE: All construction and improvements visible from the public
right-of-way MUST be approved by the Environmental Review
and Preservation Board.
1. Each sheet of plans, for any improvement, costing $15,000 or
more (including: labor, materials and services) shall bear
the date and the impress seal and signature of a licensed
Professional in accordance with State & County regulation.
2. All applications are reviewed for accuracy, completeness and
compliance with South Miami's- Land Development Code. If a
problem is- found with your application, you will be notified
as soon as possible. Problems that are not resolved before
the application deadline will result in the exclusion of the
application from the upcoming agenda..
3. Neither applicants nor their representatives are REQUIRED to
attend the ERPB meeting. However, your chances of receiving
approval are much greater if someone is present at the meeting
.who can answer questions about the project and is authorized
to make corrections and modifications to the plans. It is
recommended that architects and engineers represent their
projects in person.
4. APPROVAL FROM THE ERPB IS NOT AUTHORIZATION TO BEGIN
CONSTRUCTION. You must obtain a valid building permit after
receiving approval from the ERPB. Applications for building
permits for single family residential projects will be
processed and issued as soon as possible after ERPB approval.
All other permit applications must observe a fifteen (15) day
appeal period before they can be issued. In order to allow
the entire process to proceed as quickly as possible, submit
a COMPLETED BUILDING PERMIT APPLICATION when you apply to
appear before the ERPB. Those plans submitted without
complete building permit applications will be disposed of
sixty (60) days after being reviewed by the ERPB.
5. Development orders shall not be issued by the City unless
public facilities and services which meet or exceed the level
of service standards established in the City's adopted
Comprehensive Plan are available concurrent with the impacts
of the development. PROOF OF ADEQUACY SHALL BE THE
RESPONSIBILITY OF THE APPLICANT.

20-4 . 9 SIGN N=QULATIONS
(A) Purpose and Intent
Regulations . affecting the design, erection and
maintenance of signs are established for the purpose of
ensuring equitable means of graphic communication, while
maintaining a harmonious and aesthetically pleasing
visual environment within the City. It is recognized
that signs form an integral part of architectural
building and site design and require equal attention in
their design, placement and construction.
(B) Applicability
No sign, unless herein excepted, shall be erected,
constructed, posted, painted, altered or relocated, until
a permit has been authorized and issued by the Building
and Zoning Department pursuant to Section 20-5. 16. Signs
in all zoning districts, except for the PUD and H
districts, shall be subject to the regulations in this
Section. Permitted sign regulations for the PUD and H
districts are referenced in those sections of this Code.
(C) Temporary Signs
( 1 ) The City may issue temporary permits for signs and
displays for a period not to exceed thirty ( 30 )
calendar days when use of such sign or display is
deemed in the public interest.

( 3 ) Temporary signs shall be removed at the end of .the

sponsored by a public or civic organization.

(b) special decorative displays used for holidays
or promotion of nonpartisan civic activities.
(c) special business opening sales and displays in
nonresidential districts where such sales are

(D) Exceptions
The following signs or displays may be erected without
a permit or review by the City, but shall comply with all
structural and safety requirements of the Building Code:
( 1 ) Official federal , state, county or city traffic
information, warning or danger signs.
( 2 ) National flags and flags of political subdivisions
of the United States, and bonafide civic, charitable
and fraternal organization signs, when limited to
one ( 1 ) flag per lot and when appropriately lowered
and removed from sundown to sunrise.
( 3 ) Changing of copy on permitted bulletin boards,
display encasements or marquees, provided that no
change is made in the size or character of the sign.
(4 ) Signs on trucks, buses and other vehicles, while in
use in the normal course of business.
( 5 ) Street address identification signs.
(E) Landscape Signs
Low-profile landscape signs which meet the following
conditions may be permitted when approved by a majority
of the Environmental Review and Preservation Board and
four (4 ) City Commissioners.
( 1 ) Said signs shall be permitted only in Low-Intensity
Office "LO" and Medium-Intensity Office "MO"
districts where building setbacks exceed required
yard setbacks at least by twenty ( 20) feet; and
( 2 ) Said signs shall replace all permitted flat signs.

SECTION 20-2. 3 DEFINITIONS
SIGN. . Shall mean an identification, description,
illustration, or device which is affixed to or represented
directly or indirectly upon a building , structure or land and
which directs attention to a product , place , activity , person ,
service , institution or business .
SIGN, ADDRESS IDENTIFICATION. Shall mean a sign which gives
the postal address of the property in numerical or written
form which shall not exceed four ( 4 ) inches in height . Any
sign larger than four ( 4 ) inches in height shall constitute
a sign for purpose of sionage calculation.
SIGN AREA. Shall mean that area within a line including the
outer extremities of all letters , figures , characters and
delineations , or within a line including the outer extremities
of the framework or background of the sign, whichever line
includes the larger area. The support for the sign background,
whether it be columns , pylon or building or part thereof ,
shall not be included in the sign area. Only one side of a
double-faced sign shall be included in a computation of a sign
area. The area of a cylindrical sign shall be computed by
multiplying one-half of the circumference by the sign height .
Only one street frontage shall be considered in the
calculation of permitted total sign area and that frontage
shall be determined by the street address .
SIGN, AWNING. Shall mean any sign painted , stamped ,
perforated or stitched on the surface area of an awning ,
canopy, roller curtain or umbrella.
SIGN, CONSTRUCTION. Shall mean a sign which is displayed on
the premises only during the progress of actual construction
work which indicates the ultimate character of the development
and those firms or individuals involved in its creation.
SIGN, DETACHED (Also FREESTANDING OR POLE) . Shall mean a sign
not attached to or painted on a building and which is affixed
to the ground .
SIGN, DIRECTIONAL. Shall mean a sign which transmits
information which facilitates vehicular access to and from
off-street parking or drive-in facilities , but does not in any
way identify or advertise the use of the premises .
SIGN, DOUBLE-FACED. Shall mean a sign consisting of two { 2 )
surfaces , both sides of which are used for advertising or
other communications .

SECTION 20-2. 3 DEFINITIONS
SIGN, FLAT. Shall mean any sign attached to and erected
parallel to the face of , or erected or painted on the outside
wall of , a building and supported throughout its length by
such a wall or building and not projecting more than nine ( 9 )
inches beyond the building wall .
SIGN, FREE-STANDING ( See SIGN, DETACHED) .
SIGN, HANGING. Shall mean any sign which is displayed over
a public sidewalk or pedestrian way and supported from a
projected canopy, bracket or roof overhang . Liability
insurance shall be required for nay hanging signs by the sign
owner and City.
SIGN, ILLUMINATED. Shall mean any sign which gives forth
light or is designed to reflect light from one or more sources
erected for the purpose of providing light for the sign,
provided that it is positioned so that none of the light
shines onto an adjacent property or into the eyes of motorists
or pedestrians .
SIGN, INDIRECTLY ILLUMINATED. Shall mean a sign which does
not produce light from within itself or is illuminated by a
light source not a part of, or attached to , the sign itself .
SIGN_ Shall mean a detached low-profile single or
double face sign-'o_f not more than three feet in height in
height from average grade-and-appropriately-1-and"soaped—in a
parklike manner designed to be compatible with adjacent.

SIGN, MURAL. Shall mean a graphic element with no printed
commercial message painted or applied to a building or
structure .
SIGN, NAME PLATE. Shall mean a sign identifying the owner or
occupant of the premises and located on an entry door or
directly adjacent thereto .

SIGN, POLITICAL OR CAMPAIGN. Shall mean a sign erected to
advocate the candidacy of a party or individual for elective
office or an issue , cause or referendum.
SIGN, PORTABLE. Shall mean a sign of any size , type or
material which is attached to a vehicle or structure and can

and Preservation Board and four (4) City Commissioners; and
WHEREAS, Satira A. .Mekras has made such a request for the
benefit of Dr-. , George:-M. Suarez, for .the property commonly known-
as 7051 S.W. 62nd'.Avenue, South Miami, - Florida, and legally
described- as: Lot&:l0, 11, 16 and 17, Block 1 , LARKINS CENTER;.
according to- the= Pla thereof as recorded in Plat Book 27 at Page
67 of the Public, Records of Dade County, Florida, less the West-
- 10.00 feet of Lots 16 and 17 ; and
WHEREAS, on June 19th, 1990, the Environmental Review and
Preservation Board approved this request by a vote of 6/0.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND THE CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1 . That the request of Satira Mekras , made for the
benefit of r. George M. Suarez for a low profile landscape sign
at 7051 S .W. 62nd Avenue, South Miami, Florida, legally described
herein, be and the same is hereby approved .

with suggestion that the recessed letters in the sign not be
painted to allow the difference in depth to create shadings.
Should this prove to be unsatisfactory, the applicant may return
and apply to change the color. Seconded by Mr. Saez.
