The zoning district, however, does not permit hospital use, therefore the existing hospital is a non-conforming use. The hospital may continue to operate at that location, however, any expansion, enlargement or the addition of square foot floor area is prohibited, . I In order to carry out any expansion or enlargement of the hospital the following changes must be applied for: j 1) A change in the Comprehensive Plan Future Land Use Map category for the property from Transit Oriented Development District to Public and Institutional. It is important to note that at this time that the City is unable to process Comprehensive Plan amendments due to State laws which require municipalities to adopt their Evaluation and Appraisal Report (EAR) Amendments before new changes can be made. The City of South Mia►ni has not adopted its EAR Amendments. It is anticipated that this situation will be resolved in the near future. 2) (a) A change in the zoning use district for the property from TODD-MU-5 to an (H) Hospital Zone. A hospital is allowed as a special use in the Hospital District. The standards for development in a Hospital District are set forth in Section 20-3.4 (13)(14) of the Land Development Code, This section also provides that the dimensional requirements for a Hospital District can not be less than the requirements listed for the MO District, or (b) A change in the zoning use district for the property from TODD-MU-5 to a (PUD-H)Planned Unit Development-Hospital district. The standards for development in a PUD-H district are set forth in Section 20-3.7(F) of the Land Development Code. It is important to note that the minimum land area required for a PUD-H District is three (3) net acres. The combination of the hospital site and its abutting parking lot to the north may be more than 3 acres. If this size minimum is met than both sites would be rezoned to PUD-H. The zoning district, however, does not permit hospital use, therefore the existing hospital is a non-conforming use. The hospital may continue to operate at that location, however, any expansion, enlargement or the addition of square foot floor area is prohibited. In order to carry out any expansion or enlargement of the hospital the following changes must be applied for: 1) A change in the Comprehensive Plan Future Land Use Map category for the property from Transit Oriented Development District to Public and Institutional. It is important to note that at this time that the City is unable to process Comprehensive Plan amendments due to State laws which require municipalities to adopt their Evaluation and Appraisal Report (EAR) Amendments before new changes can be made. The City of South Miami. has not adopted its EAR Amendments. It is anticipated that this situation will be resolved in the near future. 2) (a) A change in the zoning use district for the property from TODD-MU-5 to an (H) Hospital Zone. A hospital.is allowed as a special use in the Hospital District. The standards for development in a Hospital District are set forth in Section 20-3.4 (13)(14) of the Lan d Development Code. This section also provides that the dimensional requirements for a Hospital District can not be less than the requirements listed for the MO District. or (b) A change in the zoning use district for the property from TODD-MU-5 to a (PUD-H) Planned Unit Development-Hospital district.
