Mayor Gluck then annouta.ce ,p with Councils' approval_., that he would -move up the retter of the Florida. Power and Light Company franchise since representatives of the company Taere prese,mb , This was agreeable to i ambers of the Council. and Mayor Gluck proceeded by reading the proposed franchise to be r�.ar iTn as Ordinance `295. Mr© ntlle'r of the Florida Po-ver 8. Light, Co. was present together with I1ro Bostwjck to answer any questions that the Council hta have with reference to the fianchise. Mayor Gluck wished to Imow how much €iddi tional. revenue would be brought to the City %brought. the granti.l of the Franchise Mr. Bostwick answered ar ourd. We are the owners of the following described property in South-Miami., to-wit: Lots 7, 8, 9, 18, 19 and 20, Block 1, of LARKIN CENTER, and during the year 1914 we made an application for a permit to build a garage apartment on the rear of Lots 8 and 9. At that time no spot survey was required by the City, and the City Clerk and Building Inspector agreed that this improvement would probably encroach some few feet on Lots 18 and 19 in the rear, the exact amount, of course, was unknown. The permit was issued and the improvement was completed, inspected and approved by the building department of the City. This improvement consisted of a one story addition, During the early part of May, of this year, I contacted the City Clerk regarding a permit to add two upstairs efficiency apartments over the property above described. We were told to get a spot survey and submit blueprints with the approval of the State Hotel Commission in ask- ing for this permit. The spot survey was made, a copy of which is attached hereto and made a part of this letter. After going to the expense of the survey, specifications, and purchasing of building materials, an unexpected delay developed. We could not learn why the delay in issuing the permit, but vaguely, we understood the footings of the present structure were not satisfactory, yet no one in the City Hall could tell us just what the City wanted done. After several days' delay, we were finally referred to Mr. George Brewer. After several conferences with fir. Brewer we were told that we could not get a permit for the new structure because it was in violation of the zoning on Lots 18, 19 and 20. It seems that Lots 7, 8 and 9 were zoned for multiple units, while Lots 18, 19 and 20 are zoned for single residences. You will note from the survey that .Lots 18, 19 and 20 are only 87 feet deep, with 47 feet frontage. It is our understanding that the County has an easement of 10 feet off of these lots, thus reducing the depth to 77 feet. ,y Y* A -2- The City Council 6-18-51 City of South Mi i In view of all of these difficulties, Mr. Brewer finally advised that the only solution would be to apply for a change, in zoning on these lots, or for a variance permit to allow us to proceed with our present building plans. If there was a mistake made in issuing the permit in 191 ; that mistake was a mutual one made by us ,and the building department of the City of South Miami, and we donot believe it is fair for us to be penalized because of a mutual mistake. We are advised that all of the property near Lots 18, 19 and 20 have been zoned for business and since they are not deep enough for single residences, the sensible solution seems to be a change of Zoning from single residence to multiple units. Therefore, we respectfully petition the Council for a change of zoning as to Lots 18, V and 20 from single residence to multiple units, or in the alternative, that the City Council authorize the issuance of a variance permit in order that we may complete our present building plans. We have spent five or six hundred dollars in surveys, plans and specifications and building materials, and we are unable to proceed further -alth our building.
