Regarding your submittal, dated and stamped received by the Planning and Zoning
Department on December 28, 2010, concerning an Application for Comprehensive Plan
Amendment and Public Hearing Before Local Planning Agency (LPA) & City
Commission, the following information is provided:
(1) The request noted on the Application is for a.Future Land Use Map Amendment.
(2) The Application provides a check list of the required submitted materials.
(3) The check list indicates that 15 copies of Site Plan were not submitted; therefore,
the Application is not complete.
(4) Also, the Application notes that a site plan must be submitted before item is
scheduled.
(5) Pursuant to Section 20-2.3, Definitions, of the land Development Code, Site Plan
is defined as follows: Site Plan - Shall mean a drawing illustrating a proposed
development and prepared in accordance with the specifications of this Code.
(6) Pursuant to Section 20-4.5, Landscaping and Tree Protection Requirements for
all Zoning Districts, of the Land Development Code, Site Plan is defined as
follows: Site plan — Shall mean a scaled, comprehensive drawing or set of
drawings, which indicates site elevations, roadways, rights-of-way, setbacks,
easements and the-location of all site improvements, including proposed and
existing buildings, all structures, parking areas, driveways, access roads, other
paved areas, ingress and egress drives, landscaped open space, signage and
any other site development.

(7) Article V. Procedures and Applications, pursuant to Section 20-5.4, Complete
applications required, of the Land Development Code.
Section 20-5.4(A) Completeness Determination. An application for any review
under this Code shall be submitted in the appropriate format and shall contain
all information required by this article.
Section 20-5.4(A)(9) If the director finds that such application is not complete,
he or she shall return it to the applicant with a specific list of missing items or
other deficiencies -
In that regard, staff confirms that the Application is not complete, site plan was not
submitted. Therefore, the Application shall be returned to the applicant, Mr. Naya, along
with the corresponding refund. Attached copy of a requisition, dated 4/25/11 for a full
refund in the amount of thirty thousand dollars ($30,000).
