The next step in the plan review process is to submit an application for building permit. Please contact the Building Department at (305) 663-6358. The final approval from the ERPB shall lapse after six (6) months if no permit is applied for. This requirement can be found in Section 20-5.11(L), entitled Expiration, Land Development Code. Please be advised that an appeal of an ERPB decision or recommendation may be filed with the City Clerk within thirty (30) days of the ERPB final decision or before a building permit is issued, whichever comes first. Appeals may be submitted by the applicant, interested citizens, or the city administration [Section 20-6.2 (A), City Land Development Code]. The applicant responded that it was a requirement from Miami-Dade County and the C.S.M. Planning & Zoning Department. Mr. Trautman questioned what was the tie beam height on the house and if there was a reason why the applicant did not want to line up the windows and doors on the facade that faces Manor Lane. The applicant responded nine (9) feet and he did not know why the windows doors did not line up, but he will look into it. Mr. Chandler commented that there are two gables that lead to the front entry that will be dumping water in the entrance. He recommended that the applicant consider adding a gutter to avoid the issue and commented that since the entrance is hidden away the applicant might want to consider the option of the roof popping up a little more. He further recommended that the applicant could adjust the situation by the entry piece by pulling it out a little more which could help the massing of the house. Mrs. Mark commented that she has some concerns in regards to the color scheme. She questioned why the applicant was considering the color black for the proposed fascia. The applicant responded that the color selection was chosen by the owner of the property, but if the board has any suggestions the owner will take that into consideration. He commented that the color black includes the fascia board, but the underside over hang will be beige. Mr. Bedell questioned the color of the quoins if they were going to be white or beige. The applicant responded that the color would be dark beige that will create a color contrast. Mrs. Mark questioned the color of the garage door. The applicant responded that the door is going to be the color brown. Mr. Trautman suggested that the colors being proposed in the rendering are perfect. Mr. Bedell suggested the color dark brown instead of the color black. Mr. Trautman moved to grant preliminary approval with the conditions that allow the architect some discretion with the way he is adjusting the front entrance, accepting his discretion that the height of windows and doors would line up on the facade that faces the street, the color of the trim would be a brown mahogany color instead of black and staff's conditions. Mrs. Mark questioned if there were any awnings previously installed on the building. The applicant commented that he was not aware of any other awnings on the building. Mrs. Mark commented that in the photographs provided by the applicant it was seen that there are existing awnings. Motion: Mr. Chandler moved to approve the application as presented with conditions the color of the awnings being proposed match the existing awnings. Mr. Bedell seconded. Vote: 5 Approved 0 Opposed 1 Abstained (Mr. Jude) REMARKS: Mr. Rivera questioned what entity within the city could request an updated change for a building that was painted twenty years ago and if the business could be obligated to paint the building over. Mrs. Cabrera-Hernandez responded that in the past the issue was brought to staff which was referred to Code Enforcement. Mr. Rivera commented on the building (Bank United) across from City hall did not look so pleasant. Mrs. Mark commented that the portion of the building that is not painted is the stone portion. She commented that the stone portion might need to be pressure cleaned. Mrs. Cabrera-Hernandez informed the Board that Staff invited the new Code Enforcement Director to meet the ERPB Board. Ms. Carmen Quinn introduced herself and commented that Code Enforcement's role in the current situation is to give the property owner a courtesy warning to allow the property owner some time to fix the situation before giving them a citation. ERPB Mins 3-16-2010 Pg 3 of 4 � l Mrs. Mark questioned if Code Enforcement is proactive or do they react to what issues people bring to their attention. Ms. Quinn commented that she could only speak on the two weeks she has been working in the City. Mrs. Mark commented that there are retail businesses such as Karate that have never come before the Board. Mrs. Cabrera-Hernandez commented that Karate retail store is on a historic property and goes through the Historic Board instead of ERPB. Mr. Bedell questioned if landscaping is included in the Code Enforcement review. Ms. Quinn replied that all properties (residential and commercial) are included. Mrs. Cabrera-Hernandez informed the Board that according to the minutes, Staff informed the Code Enforcement Department about the gas station on their underground tanks and making sure the surface is in working order. Ms. Quinn commented that Code Enforcement conducted an inspection of the property and the project is on its way. She commented that Code Enforcement is working with Planning and Zoning to make sure that upon final inspection, the department is involved to record any code violations and make sure everything is taken care of before they reach final inspection. VI. The applicant gave the board a detailed description of the project's intent. Mrs. Mark asked if the applicant had a brochure of the product, and if he provided the Board with a photograph of what the product looked like. The applicant responded that he submitted photographs of the existing building, but did not submit any pictures of the product. He further commented that there is an existing building that has the doors that are being proposing to the Board located on Commerce Lane shown by the photograph. Mr. Trautman questioned if the doors had a vision glass as well. The applicant responded no. Mr. Chandler questioned if the roll up doors are made with hurricane proof vision glass. The applicant responded that they are looking into it, but it is very expensive. Mrs. Mark.questioned if the doors being installed will have the rubberized material and if so, will it be visible. The applicant responded yes and the doors will have the rubberized material that will not be visible. Mrs. Mark questioned if the doors will be painted and what color is the building. The applicant responded that the color of the door will be grey (stainless steel) that will remain as is to avoid a maintenance issue. He commented that the color of the building is beige. STAFF ANALYSIS Awning System 1 The applicant is proposing to install an awning frame system that will be located just above an eastern entrance leading into the hospital. This awning will measure out to be approximately 24'-2" long, 5'-7" wide, and 2'-8" high. The awning will also have a minimum unobstructed, clear space of 7'-6" and will be colored brown to match the other proposed awnings. Canopy System 2 The second awning that the applicant is proposing will be located along the walkway in between the eastern portion of the hospital and the temporary CT-Scan trailers that will be located on the property. Pursuant to Section 20-3.6(B)(5) of the Land Development Code, canopies may extend from the main entrance of a principal building to the street line in multifamily or nonresidential districts provided that they: (a) Do not extend beyond eighteen (18) inches from any curb line, (b) Do not exceed fifteen (15) feet in width or twelve (12) feet in height, (c) Are not screened or enclosed in any manner, and (d) Provide a minimum unobstructed, clear space of seven and one- half(7.5) feet between grade and bottom of valance. With a total height of 10'-2", the awning will be colored brown to match the other proposed awnings. Awning System 3 The third proposed awning will be located above the walkway awning (awning system 2) between the eastern entrance leading into the temporary CT-Scan trailer and the awning extending from the eastern side of the hospital. The proposed awning will be approximately 15'-0" long, 11'-0" wide, and will have a minimum unobstructed, clear space of 12'-0". With a total height of 14'-0", the proposed awning will be colored brown. to match the other proposed awnings. Because there are currently no zoning regulations pertaining to awnings of this nature in the Land Development Code for the City of South Miami, it is staff's recommendation that the installation of awning system 1 and awning system 3 be governed by the regulations listed in the Florida Building Code. After review of canopy system 2, it was found that this system complies with Section 20-3.6(B)(5) of the Land Development Code. However, it is staff's recommendation that the installation of awning system 2 be governed by the Florida Building Code as well. It is important to note however, that the dimensions shown on the attached renderings do not match the signed and sealed plans that were presented for review and approval. Because of this, staff recommends that the dimensions in the rendering package be revised so that they are consistent with the signed and sealed plans. For additional information pertaining to color and location of the proposed awning, please refer to the attached material sample and awning installation package. RECOMMENDATION: Approval with the following conditions: 1. Approval Letter from the owner of the property; 2. The dimensions in the attached renderings must be revised so that they are consistent with the signed and sealed plans provided for review. 3. The installation of all three (3) awning systems be governed by the regulations as listed in the Florida Building Code; 4. Signage is not a part of this application, and will require a separate submission to the Environmental Review & Preservation Board; and 5. Any comments and/or suggestions from the Board.
