(2) The proposed use of "Laboratory, Medical or Dental" is permitted by right in properties zoned Transit Oriented Development District Mixed Use — 5 "TODD MU-5." The proposed use of a medical dormitory where clinical trials would take place would be considered to be a "Laboratory, Medical or Dental" use, which is permitted by right for properties zoned TODD MU-5. Based on the information listed above, the use that you are proposing to operate in the building located at 7000 SW 62 Avenue is a use that is permitted by right. However, in your inquiry it is stated that the medical dormitory would also be use for observation purposes, which implies that patients requiring observation would stay until observation is no longer necessary. While a medical office is not specifically defined in the City's Land Development Code, the Planning and Zoning Department has considered MRI procedures, X-rays and clinic type services performed by licensed professionals to be within the definition of the "Laboratory, Medical or Dental" use. However, this interpretation does not include overnight stays. Please note that if you still decide to go forward with a lease with the above listed building for the "laboratory, medical or dental" use, the only condition that will be placed upon this use would be condition for parking. Pursuant to Section 20-4.4(B)(9) of the Land Development Code, the parking requirement for a "Laboratory, Medical or Dental" use is one space per 200 square feet of gross floor area.
