Moved by Mayor Block, seconded by Councilman Gibson, that the i Resolution be adopted and assigned the next number by the City Clerk. Mr. Moore advised the Council that Opinion of Title had. been requested for lots 6 and 7, but through an error by the attorneys involved the abstract for only lot 7 had been delivered. A pencil sketch from the Title Company was done and it was determined that the only difference between the lots was that lot 6 had a mortgage on it. Mr. Moore stated that he was promised that before the Resolution became effective he would be provided with Satisfaction of Mortgage and Opinion of Title in the form required. He further stated that from a legal standpoint he was satisfied. There was lengthy discussion with regard to a time limit being placed in the Resolutions to assure that all required paperwork is completed before a CO is issued. City Attorney stated that this question had been discussed before with the result that the City Manager was requested to direct the Building Department that if paperwork is not completed within 30 days a CO would not be issued. Mr. Moore further stated that it was his opinion that in order to cancel a Resolution the matter would have to be placed before the Council again. Motion on the Resolution carried by the following roll call : "Yeas" Councilwoman Willis, councilman Gibson, Councilwoman Andrews Lantz, Vice Mayor McCann and Mayoi Block. "Nays" - None. Moved by Mayor Block, seconded by Councilman Gibson, that the Resolution be adopted and assigned the next number by the City Clerk. Mr. Moore advised the Council that Opinion of Title had been requested for lots 6 and 7, but through an error by the attorneys involved the abstract for only lot 7 had been delivered. A pencil sketch from the Title Company was done and it was determined that the only difference between the lots was that lot 6 had a mortgage on it. Mr. Moore stated that he was promised that before the Resolution became effective he would be provided with Satisfaction of Mortgage and Opinion of Title in the form required. He further stated that from a legal standpoint he was satisfied. There was lengthy discussion with regard to a time limit being placed in the Resolutions to assure that all required paperwork is completed before a CO is issued. City Attorney stated that this question had been discussed before with the result that the City Manager was requested to direct the Building Department that if paperwork is not completed within 30 days a CO would not be issued. Mr . Moore further stated that it was his opinion that in order to cancel a Resolution the matter would have to be placed before the Council again. City Attorney advised that he had given an erroneous opinion when lie had previously stated that a second detached sign 100 square feet or less would not be a non-conforming sign and, since this would be in a shopping center of more than seven acres, the non- conforming sign would come under an exception. Therefore , if" the proposed restaurant is advertised on a detached sign they would then have a right to whatever the law permits in the way of an identification sign for the restaurant . In response to a question by Vice Mayor McCann, City Attorney stated that if an additional sign is requested this would be regulated by the Shopping Center Ordinance, Motion on the Ordinance, Item No. 10, carried by the following roll call. : "Yeas" - Councilwoman Willis , Councilman Gibson , Councilwoman Andrews Lantz and Mayor Block. "Nays" - Vice Mayor McCann. * The next item on the Agenda was "Council" remarks : * Councilwoman Willis commented on the practice of people doing construction work without obtaining permits and then coming before the Council to request a Variance. She suggested that Council con- sider an Ordinance which would apply more stringent penalties for people involved in non.--conforming construction work without a permit than imposed for regular construction work without a permit . She further suggested a double penalty for non"conforming construction and a straight penalty for regular construction work - when done without permits. Mr . James Bowman requested and received permission to address the Council . Mr. Bowman stated that it was his feeling that by imposing such fees , the door would be opened for people to do construction work. without a permit knowing that it would only cost them "X" amount of dollars - if they got caught . Mayor Block suggested that a schedule of penalties should be developed based on the cost of the job involved giving as an example that if a job cost $500. 00, the fee would be $100. 00 and, if a job cost $1, 000, 00, the fee would be $200. 00. Mr. Bill Biondi addressed the Board and stated that he represents the owners of the building. He explained the need for the signs requested because this is the largest office building in the City and it has a high vacancy factor because of lack of_ identity due to insufficient signs. Mr. Bruce Spencer, the architect who designed the signs presented photo- graphs of the existing ground floor offices and businesses and the proposed sign locations. Mr. Jerry Bengis of Bengis Signs described the type of signs to be used, the size of the letters and stated they would be made of bronze material. There being no one caring to speak against the request of the applicant, Chairman Michelson deemed the public hearing closed. A lengthy discussion was had by the Board concerning all aspects of the type of signs- requested and conformance with the sign ordinance. MOTION: By Mr. Fleischer, seconded by Mr. Michelson, to recommend to the City Council a variance be permitted for continuance of the existing sign labeled "A" in Exhibit A submitted by the applicant, and that the sign labeled "B" on the Sunset Drive exposure of the building not to exceed 90 square feet, recommending denial of that sign labeled "B" on the east side of the building, recommending approval of that sign labeled "C" identifying only the function of the accessory use without including trade names, recommending denial of that portion of "C", all of "D" and recommending approval of "E" which is the logo. AN ORDINANCE OF THE CITY OF SOUTH MIAMI , FLORIDA, GRANTING A VARIANCE TO THE PLAZA 7000 BUILDING TO PERMIT 272 . 50 SQUARE FEET OF SIGNAGE INSTEAD OF THE PERMITTED 74 SQUARE FEET IN A CO (COMMERCIAL OFFICE) DISTRICT AS TO CERTAIN DESCRIBED PROPERTY LOCATED AT 7000 SOUTHWEST 62ND AVENUE, SOUTH MIAMI , FLORIDA. Mayor Block read the Planning Board recommendation as .being 5 in favor, 1 opposed. Mayor Block stated that a representative for Plaza -7000 would give a presentation covering Items 10 and 11 on the Agenda . In response to a request for Administration ' s recommendations, Mr. Godwin advised that Administration was in favor of the request adding that with regard to "signage" this refers to the entire building - not just one sign and that "Exhibit A" (the site plan) demonstrates all requested signs with codes depicting each sign. Mr. Bill Biondi, Partner of the Clark-Biondi Company, requested and received permission to address the Council . Mr. Biondi explained that what is being attempted is to remove window signs currently in place and put up identification signs for the benefit of tenants . He added that the signs would name the type of business but not the name of the business . Mr. Biondi further stated that if the identification. signs were permitted then al]_ neon signs and window signs would be removed and no other non-conforming signs other than those indicated on the site plan would be used. There was lengthy discussion with regard to the proposed sign } and logo to b� placed on the outside of ti.,-- building for the r' American Automobile Association and it was noted that this would not be an advertisement for AAA, but would be identification . of the world-wide American Automobile Association. At this time, City Attorney advised that the Ordinance to be discussed next on the Agenda, Item No 11, which pertained to a re- quest for a variance to permit an additional flat sign on a wall with regard to the same property presently under discussion, should be corrected as follows : Section 1, 7th line, following the words " . . .which Site Plan is marked Exhibit "A delete the words " . . .attached hereto and made a part hereof. . . " , and insert the words " . . . and which Site Plan is on file with the City Clerk, . . . " e Mayor Block stated that Section l of Agenda Item No. 10 was to be similarly corrected by inserting that portion of the paragraph in Section 1 beginning with the words "pursuant to that" and ending with the corrected words "Site Plan on file with the City Clerk" . Vice Mayor McCann stated that she could not go along with what was being proposed as it was her feeling that the AAA sign would be too large and would go against what the City' s Sign Ordinance was trying to accomplish. She added that inasmuch as the Ordinance for a Variance required a 4/5 vote, and being that she was opposed, it was her suggestion that the matter be deferred until a fifth Council Member would be present .
