STATEMENT OF REASON'S OR CONDITIONS JUSTIFYING CHANGE
REQUESTED

The property on which rezoning is sought as well as Lot 6
to the East of this property and all of Lots 3, 4 , and 5 belong
to the,,applicant. The applicant owns an office building on
Lots 3,4 and 5 and is utilizing a portion of this property
together with Lot 6 for parking. However, the owners of the
building are desirous of providing more parking for the people
who will be using the building, and they propose to landscape
and develop the property to be rezoned as shown on drawings
and sketches which have been filed in these proceedings . The
present residential structure on the property would be razed
except that several of the larger trees would be preserved
for esthetic purposes . , the owners 40MINEW will
as a condition to obtaining a rezoning, ,' execute a recordable
restrictive covenant which would be a unity of title agreement
so that the property to be rezoned could not later be used for
some other purpose than that of parking as an ,additional fa-
cility serving the office buildings located on Lots 3 , 4 and 5 .
At. the time this property was acquired the City permitted a
special use on residential property which would have been. uti-
lized to make this available for parking. Since the adoption
of the new Code there is no special use available to apply to
single-family residential and the only solution -to this is
rezoning. The proposed use under rezoning would be the best
use for this property, particularly since it is bordered on
the South by the Caldwell office building and parking garage
and on the East by the office building and Larkin Hospital.

AN ORDINANCE GRANTING THE APPLICATION OF
DOCTORS ROBINSON AND SOMMER FOR SPECIAL
USE EXCEPTION TO PERMIT CONSTRUCTION OF AN
OFF-STREET PARKING LOT ON PROPERTY DES-
CRIBED HEREIN; RESCINDING ALL ORDINANCES
IN CONFLICT HEREWITH; AMENDING OFFICIAL
ZONING MAP; AND PRESCRIBING PENALTIES FOR
VIOLATIONS OF THE PROVISIONS HEREOF.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY
OF SOUTH MIAMI, FLORIDA:
Section 1. That the application of DOCTORS ROBINSON and
SOMMER for a Special Use Exception to permit the construction of
an off-street Parking Lot on the following described property:
East 35' of South 100' and also the
East 25' less the South 100' of Lot 6,
and the East 25' of South 29.75' of
Lot 12, Block 4, COCOPLUM TERRACE,
according to the Plat thereof, recorded
in Plat Book 25 at Page 4 of the Public
Records .of Dade County, Florida,
be and the same hereby is GRANTED conditioned upon the development
in accordance with the plan submitted as prepared by Philip R.
Braden Architec-t, dated May 24, 1971 Order -No.- 0061. --
Section 2. That all ordinances or parts of ordinances in
conflict herewith be and the same hereby are repealed insofar as
they are in conflict.
Section 3. That the Zoning Director of the City hereby is
authorized and directed to make the necessary changes on the official
zoning map of the City.
Section 4. That any person, persons, firm, partnership or
corporation violating any of the provisions of this ordinance shall,
upon conviction, be punished by a fine not to exceed $500.00 or by
imprisonment not to exceed six months, or by both such fine and
imprisonment in the discretion of the Municipal Judge. Each ,day
that a violation is permitted to exist shall constitute a separate
offense.

STATEMENT OF REASONS OR CONDITIONS JUSTIFYING CHANGE
REQUESTED
The property on which rezoning is sought as well as Lot 6
to the East of this property and all of Lots 3, 4 , and 5 belong
to the applicant. The applicant owns an office building on
Lots 3 , 4 and 5 and is utilizing a portion of this property
together with Lot 6 for parking. However, the owners of the
building are desirous of providing more parking for the people
who will be using the .building, and they propose to landscape
and develop the property to be rezoned as shown on drawings
and sketches which have been filed in these proceedings . The
present residential structure on the property would be razed
except that several of the lar er trees would be preserved
for esthetic purposes . The owners . willlo.,
as a condition to obtaining a rezoning, to execute a recordable
restrictive covenant which would be a unity of title agreement
so that the property to be rezoned could not later be used for
some other purpose than that of parking as an additional fa-
cility serving the office buildings located on Lots 3, 4 and 5 .
At the time this property was acquired the City permitted a
special use on residential property which would have been uti-
lized to make this available for parking. Since the adoption
of the new Code there is no special use available to apply to
single-family residential and the only solution to this is
rezoning. The proposed use under rezoning would be the best
use for this .property', particularly since it is bordered on
the South by the Caldwell office building and parking garage
and on the East by the office building and Larkin Hospital.

AN ORDINANCE GRANTING THE APPLICATION OF
DOCTORS ROBINSON AND SOMMER FOR SPECIAL
USE EXCEPTION TO PERMIT CONSTRUCTION OF AN
OFF-STREET PARKING LOT ON PROPERTY DES-
CRIBED HEREIN; RESCINDING ALL ORDINANCES
IN CONFLICT HEREWITH; AMENDING OFFICIAL
ZONING MAP; AND PRESCRIBING PENALTIES FOR
VIOLATIONS OF THE PROVISIONS HEREOF.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY
OF SOUTH MIAMI, FLORIDA:
Section 1. That the application of DOCTORS ROBINSON. and
SOMMER for a Special Use Exception to permit the construction of
an off-street Parking Lot on the following described property:
East 35' of South 100' and also the
East 25' less the South 100' of Lot 6,
and the East 25' of South 29.75' of
Lot 12, Block 4, COCOPLUM TERRACE,
according to the Plat thereof, recorded
in Plat Book 25 at Page 4 of the Public
Records of Dade County, Florida,
be and the same hereby is GRANTED conditioned upon the development
in accordance with the plan submitted as prepared by Philip R.
Braden, Architect, dated May 24, 1971 Order' No. 0061.
Section 2. That all ordinances or parts of ordinances in
conflict herewith be and the same hereby are repealed insofar as
they are in conflict.
Section 3. That the Zoning Director of the City be reby is
authorized and directed to make the necessary changes on the official
zoning map of the City.
Section 4. That any person, persons, firm, partnership or
corporation violating any of the provisions of this ordinance shall,
upon conviction, be punished byla fine. not to exceed $500.00 or by
imprisonment not to exceed six months, or by both such fine and
imprisonment in the discretion of the Municipal Judge. Each day
that a violation is permitted to exist shall constitute a separate
offense.
