AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE

CITY OF SOUTH MIAMI, FLORIDA RELATING COMMISSION

MEETINGS; AMENDING SECTION 2- 2.1(J) OF THE CITY OF SOUTH
6
MIAMI'S CODE OF ORDINANCES, ENTITLED "MANNER OF
7
ADDRESSING COMMISSION; TIME LIMIT" LIMITING PUBLIC
8
REMARKS TO THIRTY MINUTES, PER MEETING; PROVIDING FOR
9
SEVERABILITY, ORDINANCES IN CONFLICT, AND AN EFFECTIVE
10
DATE.

WHEREAS, the Mayor and City Commission of the City of South Miami attach
13
importance to promoting inclusion, and positive Community relations by encouraging members
14
from the Community to provide their input on City business under consideration by the City
15
Commission; and,
16

WHEREAS, in its endeavor to develop an efficient framework for public participation
18
and balance that with the Commission's desire to ensure that the necessary work of the City is
19
accomplished during scheduled meetings, the public remarks portion of the City Commission
20
meeting will be limited to thirty minutes; and,
21

WHEREAS, the Mayor and City Commission desire to amend Chapter 2, section 2-
23
210), of the City's Code of Ordinances in order to effectuate the changes described herein.

NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
26
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:

Section 1. That Section 2 -2.1 (J) of the Code of Ordinances entitled "MANNER OF
29
ADDRESSING COMMISSION; TIME LIMIT" is amended as follows:

Each person addressing the City Commission shall step up to the microphone, shall give his or
34
her name and address in an audible tone of voice for the public record, and unless further time is
35
granted by the City Commission, shall limit his or her address to five (5) minutes or until
36
statements appear to be repetitive or obstructive as determined by the presiding officer. All
37
remarks shall be addressed to the City Commission as a body and not to any member. No person,
38
other than the person having the floor, shall be permitted to enter into any discussion, either
39
directly or through a member of the City Commission, without the permission of the presiding
40
officer. No question shall be asked a City Commissioner except through the presiding officer.

The Public Remarks portion of the City Commission shall be limited to thirty (30) minutes.

Preference shall be given to those persons who have notified the City Clerk in advance of their
'43
desire to speak.

Section 2. If any section, clause, sentence, or phrase of this ordinance is for any
reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not
affect the validity of the remaining portions of this ordinance.
Section 3. All ordinances or parts of ordinances in conflict with the provisions of this
ordinance are repealed.
Section 4. This ordinance shall take effect immediately upon approved.
