AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF

THE CITY OF SOUTH MIAMI, FLORIDA, RELATING TO THE

CITY'S CODE OF ORDINANCES, CREATING SECTION 2 -22

ENTITLED "TERM LIMITS" LIMITING TERMS OF OFFICE FOR
5
COMMITTEE OR BOARD MEMBERS SERVING ON A
PARTICULAR BOARD OR COMMITTEE TO TWO CONSECUTIVE

TERMS; PROVIDING FOR CODIFICATION, ORDINANCES IN
8
CONFLICT AND AN EFFECTIVE DATE.

WHEREAS, the Mayor and City Commission desires to establish two (2) consecutive
11
terms as a limit for all City Boards and Committees; and,
12

WHEREAS, the Mayor and City Commission recognize the valuable contributions made
14
by all members serving on City Boards and Committees; and,
15
16
WHEREAS, the Mayor and City Commission recognize that the City of South Miami
17
has many qualified citizens willing to serve on City Boards and Committees; and,
18
19
WHEREAS, in order to provide opportunities to all citizens willing and able to serve on
20
City Boards and Committees the Mayor and City Commission desire to create term limits
21
in order to ensure participation by the many qualified members of the City in the various
22
appointed boards, commissions, and committees.

NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY

COMMISSION:

Section 1. Section 2 -22 of the City of South Miami Code of Ordinances is
28
amended, s provided below:

2 -2.2 Reserve& Term Limits.

Appointees are limited to two (2) consecutive two -year terms of membership on a
33
specific commission board or committee An appointee may not be reappointed to the
34
same commission board or committee after completion of two (2) consecutive terms.

After serving a maximum of two (2) consecutive two -year terms an appointee shall not
36
be reqppointed to the same commission board or committee unless at least one year has
37
elapsed between the term limited position and the effective date of commencement of the
38
proposed appointment for a new term Notwithstanding any provision to the contrary, an
39
appointee shall not be precluded at anytime following completion of service on a
40
commission board or committee from being a orated to another commission board or
41
committee without being required to comply with the lapse of time between
42
npointments Term limits will be applied prospectively, commencing with appointments
43
made on or after January 1, 2009.

Section 2. If any section, clause, sentence, or phrase of this ordinance is for
any reason held invalid or unconstitutional by a court of competent jurisdiction, the
holding shall not affect the validity of the remaining portions of this ordinance.
Section 3. All ordinances or parts of ordinances` in conflict with the
provisions of this ordinance are repealed.
Section 4. This ordinance shall be codified and included in the Code of
Ordinances.
Section 5. This ordinance shall take effect immediately upon enactment.
