Request: Authorizing the City Manager to execute an agreement with Miami Dade County through The Community Image Advisory Board (CIAB) to assist the City of South Miami to improve the percentage of tree canopy cover. Reason/Need: The City of South Miami wishes to replace tree canopy and increase canopy by 30% by the year 2020. Continued Reason/Need: The City of South Miami and the County wishes to replace trees canopies lost during hurricanes, citrus canker and urban development and which have had a negative impact on the green infrastructure and its ability to mitigate pollution and enhance air and water quality; and, the County through the Community Image Advisory Board (CIAB) Street Tree master Plan (STMP) has committed to assist the City of South Miami to improve the percentage of canopy cover in their cities and the County through the CIAB, has agreed to assist the City of South Miami in training their personnel in best practices for tree planting and maintenance. The City Manager is authorized to work with CIAB in submitting required 34 document, including presentation materials, to secure up to a value of $20,000.00 from the County for trees 35 and other plant material for public right -of -way within City limits. A copy of the agreement with Miami - 36 Dade County through CIAB is attached. 37 38 Section 2. Figueredo Commissioner Beckman: 56 Office of City Attorney Commissioner Newman: MEMORANDUM OF AGREEMENT This AGREMEENT, made and entered into this day of: , 2009 by and between the CITY OF SOUTH MIAMI, SOUTH MIAMI, FLORIDA a political subdivision of the STATE OF FLORIDA hereinafter referred to as the "CITY ", and MIAMI -DARE COUNTY, a political subdivision of the STATE OF FLORIDA, hereinafter referred to as the "COUNTY ". WITNESSETH WHEREAS, the CITY and COUNTY are concerned that recent losses in tree cover due to hurricanes, citrus canker, and urban development have had a negative impact on the green infrastructure and its ability to mitigate pollution and enhance air and water quality, and, WHEREAS, the COUNTY through the Community Image Advisory Board (CIAB) Street Tree Master Plan (STMP) has committed to assisting municipal governments improve the percentage of canopy cover in their cities, and, WHEREAS, the COUNTY through the CIAB has agreed to assisting municipal governments train their personnel in best practices for tree planting and maintenance, and, WHEREAS, the CITY Commission has by proper resolution attached hereto as Attachment "A" and by reference made a part thereof, authorized its City Manager or his designee to enter into this AGREEMENT. NOW THEREFORE, in consideration of the promises and the covenants contained herein, the parties agree: The COUNTY shall purchase, deliver, and if needed, assist with the installation of trees (up to value $20,000) for planting in parks, medians and public rights -of -way within the CITY limits, see Attachment B. The COUNTY shall arrange for training CITY employees on best practices for tree care and arborist certification. The CITY will plant and maintain the trees planted as part of this AGREEMENT using the best tree care standard practices set by one of the organizations that certify arborist. The CITY will hold harmless the COUNTY for work associated and materials provided as part of this AGREEMENT, as this is a funding agreement, and the City is to install the work contemplated. The CITY shall identify and obtain all necessary permits, utility adjustments and right -of -way to perform the project tree plantings in accordance with applicable State, Federal, and local laws and ordinances, and shall not commence the work described in this AGREEMENT until all necessary permits have been obtained. The CITY shall clear all utilities within the planting areas at least forty-eight (48) hours prior to any tree installation activities. Page 1 of 4 COUNTY CITY The CITY shall not allow trees to obstruct the view of the COUNTY'S Public Works or Florida Department of Transportation's roadway signs. The CITY shall be responsible for the inspection of the tree installations, see exhibit B. Plantings shall be completed prior to , 2009. - The CITY commits to adopting the principles of Street Tree Master Plan by approving the COUNTY'S plan or preparing an original plan that complements the concepts presented in the COUNTY'S plan. To the extent permitted by law, the CITY shall indemnity and hold harmless the COUNTY its officers and employees, from all suits, actions, claims of liability arising out of the CITY'S negligent performance of the work under this AGREEMENT, due to the failure of the CITY to construct and maintain the tree plantings in conformance with the standards described in this AGREEMENT. Design: Miami -Dade County will prepare landscape plans depicting proposed planting location, installation details and notes; as well as, a plant list showing species, quantity, specifications, etc. Development of these plans will be Estimated Design timeframe: 30 calendar days. Permitting: The project locations are along city road. The City of South Miami will process any necessary plans and permit applications. Estimated Permitting timeframe: 30 calendar days. Construction: The Miami -Dade County Office of Community Image has agreed to design, select, and procure plant material for the implementation of the landscape enhancements. Based on the permit requirements, the City will be required to coordinate with utility companies, governmental agencies having jurisdiction and calling for inspections as required. The City will accept plant material and account for quantities, quality and size - as -- specified on landscape plans provided by the county. No substitution of plant material shall be accepted unless mutually agreed upon by the City and the County and documented in writing. The County will perform a final inspection once material is installed. Estimated Construction time frame: 30 calendar days Plant Selection: The medians will be planted with drought tolerant species to minimize water use. The plans will include species mutually agreeable to the City of South Miami and Miami -Dade County that minimize water use and maintenance costs, decrease the likelihood of theft, are suitable to the locations(s) for sun/shade adaptability, continuity and design to adjacent areas, and provide vibrant colors wherever possible. Cost: Miami -Dade County's contribution of the purchase and delivery of plants, and the initial planting soil and mulch shall not exceed $20,000.00 COUNTY CITY Page 4 of 4 CITY Resolution No. hereto and incorporated herein. ATTACHMENT "A" CITY RESOLUTION dated .2008 attached Page 3 of 4 COUNTY CITY Landscape and Tree Ordinances and to be used as minimum standards in order to enhance the County tree canopy to a minimum of 30 percent coverage, countywide by 2020. Goals of the Street Tree Master Plan Plant quality trees in public rights of way Develop'and execute a Tree Management Plan to craft sustainable tree structure 3t Promote the design of urban spaces that adequately fit trees Encourage local growers to produce the quality and species for public rights -of -way Educate policy makers and the public on the importance of adequate tree canopy Promote the expansion of the overall canopy in Miami -Dade County to at least 30 percent by 2020. This target reflects both the initiatives of the Street Tree Master Plan and other canopy restoration efforts in Miami -Dade County to create a greener, more walkable, livable community. The Street Tree Master Plan will accomplish the "greenprint" goals by: 3� establishing a street tree working group educating Miami -Dade citizens on tree canopy issues promoting "right tree, right place" inventorying the condition of Miami -Dade street trees researching historical habitat and ecology developing guidelines for maintenance of the green infrastructure on par with the gray infrastructure Healthy street trees play an integral role in supporting the County's urban shade "canopy," which contribute greatly to lower ambient air temperatures, increase aesthetic enjoyment, provide economic improvement, improve the quality of life, and enhance the historic characteristics of our community. A shady, tree -lined street is more walkable, especially in the summer months in South Florida. The Street Tree Master Plan is guided by an overall vision to restore and enhance the County's tree canopy into a thriving urban forest that provides multiple aesthetic and environmental benefits. The Miami -Dade County Street Tree Master Plan, the Miami -Dade County Landscape Manual, and the proposed Best Management Practices are designed to support the vision by providing a 19 greenprint" for the appropriate planning, implementation, and management of our existing and planned tree resources.
