4 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF
5 THE CITY OF SOUTH MIAMI, FLORIDA, RELATING TO
6 PROVIDING SUPPORT FOR PROPOSED STATE LEGISLATION,
7 SUPPORTING HOUSE BILL 1315 AND SENATE BILL 2644
8 RELATING TO CONSTRUCTION OF ELECTRICAL
9 TRANSMISSION LINES; DIRECTING THE CITY CLERK TO
10 PROVIDE A COPY OF THIS RESOLUTION, UPON ENACTMENT,
11 TO THE PSC; THE GOVERNOR; FLORIDA HOUSE OF
12 REPRESENTATIVES, THE SENATE, THE FLORIDA LEAGUE OF
13 CITIES, MIAMI -DADE COUNTY BOARD OF COUNTY
14 COMMISSIONERS; OUR SISTER CITIES IN MIAMI -DADE
15 COUNTY; AND THE MIAMI -DADE COUNTY LEAGUE OF CITIES;
16 AND PROVIDING AN EFFECTIVE DATE.

19 WHEREAS, the Mayor and City Commission of the City of South Miami are
20 concerned about electrical transmission lines and the proposal to install transmission lines
21 in residential corridors within the City of South Miami; and,
22
23 WHEREAS, Representative Brise has proposed a Florida House Bill, Bill 1315,
24 which bill removes exceptions to requirements for electric utility to obtain certification
25 prior to construction of transmission line; requires electric utility to notify affected
26 municipalities of proposed transmission line sites & routes; requires disclosure of
27 methods used to determine routes & efforts to minimize impact on municipality;
28 authorizes municipality to request hearing by PSC to determine disputes with electric
29 utility; authorizes municipality to bring action challenging transmission line siting;
30 authorizes local governmental entity that requests electric transmission lines be placed
31 underground to share underground installation costs with any surrounding governmental
32 entity that benefits from installation; and,

34 WHEREAS, Florida Senate Representative Siplin, has proposed a Florida Senate
35 Bill, Bill 2644, which is identical to Representative Brise's Bill; and,
36
37 WHEREAS, both the Senate and House Bill are under review during this
38 legislative session; and,

40 WHEREAS, the Mayor and City Commission desire to urge the passage of Senate
41 Bill 2644, and,House Bill 1315,

43 NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY
44 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA;

2 into this resolution. The body of both bills, which are identical are reiterated below so as
3 to facilitate the understanding of the bill and to illustrate the City's support for the
4 enactment of the Bills into law:

Section 2. The City Clerk is directed to provide a copy of this
resolution to the PSC; Governor Charlie Christ; the Florida House of Representatives; the
Florida Senate; Senate Representative Siplin, House Representative Brise; the Florida
League of Cities; the Miami -Dade League of Cities; Miami -Dade County; and our Sister
Cities in Miami -Dade County.
Section 3 This resolution shall take effect immediately upon approval.
