Request: Pursuant to Section 20- 3.4(B)(4)(b) of the Land Development Code (LDC) the applicant, Dent Masters, is requesting a Special Use Approval to operate an automobile repair -body shop at the above referenced location. The proposed use is located in the TODD(LI -4) Zoning District. An automobile repair -body shop is permitted in that district with Special Use Approval. The applicant is proposing to re -use a currently vacant building on a site adjacent to a site with an existing automobile repair business, which is owned by the applicant. The building located at 5795 S. Dixie Highway (aka 5795 Progress Road) was used as an automobile repair -body shop, however, it has not been used for several years, which requires the current special use application. Staff Analysis: (1) The applicant's proposal includes the placement of required parking on the open flat area of the site. The parking requirement for the proposed building use is one space for each 300 sq. ft. The building contains 2970 sq. ft. The applicant is providing 1 l spaces on site, one more than required. The site plan submitted shows all parking spaces and maneuvering space to be in accord with required LDC dimensions. (2) The site plan also shows in the open area the installation of two car wash bays and two lift centers under an unenclosed canopy structure. These uses are considered accessory to the main use and will only be used as part of the automobile service center and not open to the public. (3) The location of an automobile repair -body shop in the Progress Road industrial area is a compatible use for the area and will not be detrimental to the neighborhood. Special conditions applicable: The LDC provides that special uses must be approved by the City Commission after a public hearing and receipt of a recommendation from the Planning Board. The overall purpose is to determine the compatibility of the proposed use with the surrounding neighborhood. A special use must comply with the conditions set forth in Section 2,0- 5.8(B) in that the use: a) will not adversely affect the health or safety of persons residing or working in the vicinity of the proposed use; b) will not be detrimental to the public welfare or property or improvements in the neighborhood; c) and complies with all other applicable Code provisions. Planning Board Action: The Planning Board at its December 9, 2008 meeting adopted a motion by a vote of 6 ayes 0 nays recommending approval of the special use request with three conditions set forth below. Recommendation - The requested special use approval for an automobile repair -body shop at this location complies with the LDC requirements set forth for special uses in Section 20 -3.4 and the conditional use requirements set forth in Section 20 -5.8. Approval of the application with the following conditions is recommended: (1) The applicant must agree that the car wash facilities will not be expanded or opened to the general public as a full car wash business; (2) The proposed development shall be in accord with the submitted site plan dated December 3, 2008 prepared by Fernando Gomez -Pina, P.E.; (3) If the proposed use, in the future, is determined by the Director of Planning, to be adversely affecting the health or safety of persons residing or working in the vicinity of the proposed use, to be detrimental to the public welfare or property or improvements in the neighborhood, or to be not in compliance with other applicable Code provisions, the special use approval may be modified or revoked by the City Commission upon notification and public hearing. Name Address Position Cesar Rodriguez 5786 Progress Road Favors Mr. Rodriguez informed the Board members of the auto body pair facility and the business has entered into a contract with Geico and that is the reason for its expansion into a business of general mechanics. He then commented that the building has been fixed, up to dated and the expansion will bring business to the city of South Miami. Mr. Cruz questioned if it was two buildings being placed together. Mr. Youkilis replied the properties are not being joined together. Ms. Young asked the applicant to state his hours of operations. Mr. Rodriguez replied that the hours are regular standard 8 a.m. through 6 p.m. and on Saturdays its half a day 8 a.m. until noon and it will be kept the same. Mr. Morton questioned if the site plan includes the two additional car detail bays.. The applicant replied yes, two bays for oil change and for detail. Mr. Morton then questioned if the bays were going to be covered. The applicant responded it is going to be covered with an awning. The applicant then went in to further detail regarding the car- detailing business. Mr. Morton questioned if the canopy is a permit issue. Mr. Youkilis replied that it will be part of the overall building permit. Mr. Morton questioned if the rolling gate that leads to Progress Road is going to be closed. The applicant said that the gate is not going to be closed and we will be adding another gate to help with the car flow around the shop. Mr. Cruz questioned if an entry way was created by the applicant to the existing building. The applicant responded no, it was an entry way that had already been created, it was being used for convenience by the employees and nothing has been done to the property. Mr. Morton questioned what motors one, two and three are. The applicant replied that it is to pump the oil. The applicant then commented that he been working with an engineers on the project and they will keep in contact with Mr. Youkilis when it comes to environmental issues. Ms. Young questioned how long the company' has been in business. The applicant replied that the building has been there twenty — two years; his partner has been there for 7 years and the companies have been together a little over a year.
