Dear Sirs; Please consider this latter as my formal protest against the proposed re-zoning of property on the South. Side of Bird Road for the following reasons 1. The notice of public hearing referrs to "more liberal zoning".. Since all past efforts to re-zone have entailed business proposals, I assume that the present efforts are also directed towards changing the present residential zoning to commercial zoning. Past notices of zoning hearings have always specified the proposed change and I find it to be singuarly odd that there were no details specified in the present notice. 2. The depth of the lots fronting on Bird Road does not permit commercial buildings of decent size without putting the back walls of the building againdt the property lines of the existing residential property fronting on 41st St. A good example of this type of blighting of residential property can be had by viewing the Phillips 66 service stabion recently built on the county corner of 64th, Ave and Bird Road. I am not aquainted with the owners of the homes just behind this station, but never-the-less I feel very sorry for them; the lights and noise coming from that place must be very unpleasant. 3. Since there are no full-block areas open for development, any change can only result in Strip Zoning which is certainly k Page 2 not in keeping with modern planning and zoning. 4. The residents of the area have no need for additional stores and business services in the mediate area. A study of small business turnover, change and "fatality" in the eEtablished shopping centers nearby will show that business coverage in the area is more than adequate now. In recent months two hardware stores and a dress shop have folded up within a mile of the area in question. Additional. shopping centers further west on Bird Road are now serving residents of the Westwood Lakes area who formerly had to come in to the Red-Bird area to shop. 5. Those of us who live in the 61st to 64th Aveenue area,. bought houses and made our homes in this section with the understanding that this .was a residential section and that we were safe in investing our savings in this area without fear of business encroachment lowering the value of our homes and interferring with our rights to a reasonable degree of privacy and quiet. We feel that the officials of the City of South Miami have a moral duty and a civic responsibility to help us pvotect .those rights. In the past, those petitioners who have advocated the "liberalizing" of zoning have pointed to the residential real estate office of Roehner & Roehner at Bird Road and 63rd Avenue €znd have said "Since we already have one business here, why not have others?" Gentlemen, to this fallacy I have two foplies: First of all, "Two WRONGS do not make a RIGHT" and secondly "There is no reason for that business being Page 3 in that location." My understanding of how that business came to be there at all is this; Some ten years .ago a widow, Mrs.. Virginia Danials, requested permission to operate areal estate business in her home on the basis that she was a widow and hers was a "hardship" case. She established that business in here home and since that time has made a number of efforts to change the zoning of adjacent property. Several years ago Mrs. DA.MC119 became Mrs. Roehner and has continued to operate this business in the midst of residential property even tho the original reason for having a business at this address (her widow' s status) is no longer valid. There is no reason for the City of South Miami to allow a business license at this address. The proper action to be taken is for the City to refuse to renew a business license for the Roehners thereby requiring them to conform to the existing standards rather than forcing everyone else to concede to the Roehners. It is a fundamental principle of our form of government that every man has the Might to use his property as he sees fit ass long as he does not infringe on the rights of others. I feel that the proposed changes definitely infringe on my rights as a citizen and a property owner and i respectfully request that the South Miami Planning and Zoning board do their utmost to preserve high zoning standards of a residential character in the Bird Road area. This is a residential community and should be kept as such. A rezoning of this area would greatly lower the value of the homes there. There is no need for rezoning this property, as there are many vacant stores at both Red Road and Ludlum Road on Bird Road, and such rezoning would be harmful to many people in the vicinity. There are big shopping centers atA Red & Birdboads and Ludlum Road. Is there any need for more business in between. Other property owners on the North side of Bird Road are going ahead with the construction of new homes — because the County has taken a definite stand on there zoning. Is there any reason why the South Miami Zoning Board can't do the same thing. 'Protect these home owners who bought in a residential section — the owners of the property under consideration do not have the interest of the neighboring homes or the City at heart. Rezoning and Variances sometimes constitute a betrayal of trust to the residents of South Miami. South Miami, Florida Gentlemen: We protest the rezoning of Southwest 40 Street between 61 and -64 Avenues, from residential to business. This is a residential section and should be continued as such. There are nice homes across the street from the property proposed to be rezoned and there are nice homes on 41 Street abutting the property. A criange of zoning would depreciate the value of all residential property in the neighborhood - no one wants a business office of any kind in their back yard. We bought our house for a home in a nice neighborhood and we should like to continue to live there. The traffic is already so heavy on 40 Street that it is hazardous and business zoning of the particular stretch would certainly not help the situation at all. The business section at 67 Avenue is a very good example of how bad a neighborhood can look. The condition of many of the buildingsis deplorable and even so-called "high class"business buildings can and do get in like condi- tion. There have been new homes built on 40 Street between 63 and 64 Avenues, across from the Church, and the same thing should be done on the property proposed to be re- zoned. Should this zoning be granted to Commercial I feel the value of my property will drop to make me suffer the loss of mar entire, equity. The zone planning of South Miami seems to be quite slipshod and certainly does not follow the wishes of the people. I see no need in extending the honky-tonk condition now existing at Bird and Ludlum. In our conversation by phone it was stated that it would be high-grade retail stores. How does one classify a retail store and how does the zoning board keep this under control. It would seem to me it was time the City of South Miami would follow the ideal zoning of the City of Coral Gables. In every part of South Miami you have gone against the wishes of the residents. We have learned of this meeting from a fOW neighbors who have received letters to this effect. ?ate, as well as a large percentage of others in this neighborhood, have not received such letters at this writing and we wish to take this opportunity to express our objection to any such zoning changes at this time. '+9e feel there is no need to commercialize this area any more than has already been done and do not want it destroyed as a quiet residential section. We have sufficient facilities in-our immediate neighborhood to serve us of our needs and cannot agree faith the Board's recommen- dation in this matter. At one time the county Zoning Board stated that they would not consider rezoning the north side of Bird Road in this area and did not recommend strip zoning. The records of this department indicate that a similar application was consider- ed by your Board on Friday, dune 20th, 1952, at which time this department entered objections to such re-zoning. We understand that your Board and the South Miami Council unanimously rejected this previous application. This department desires to enter objec- tions to the current application and for the same reasons which applied to the previous application, those reasons being repeated below. First, the two business centers established at Bird Road and Red Road one located in South Miami (Segal) and one located in the unincorporated area (Crandon offers suf- ficient good, developed business facilities to serve the area concerned. Any additional business zoning and resultant development would only serve to detract from these fine business developments which were erected at great expense, and which warrant protection because they do provide all required types of business and the facilities to serve the public. Second, it was the understanding of this department, at the time the aforementioned business centers were established, that one of the purposes of these well-planned centers was to eliminate any necessity or need for stripping Bird Road, or Red Road with commer- cial zoning and development. Certainly such practice of strip zoning, while admittedly done by many jurisdictions in the past, is definitely contrary to all good planning practice. Third, the practice of strip commercial zoning not only leads to the establishment of marginal businesses which struggle for survival and eventually require liberal busi- ness zoning in order to maintain themselves with any semblance of financial success, but such practice also cuts down the traffic carrying ability of the major and arterial streets along which the commercial zoning is established. Further, such extensive busi- ness zoning inevitably detracts from and devalues the residential property which abutts the commercial area. It might also be pointed out that because a particular street is a major or arter- ial thoroughfare does not mean that it cannot be developed residentially (i.e. Red Road, Coral Way, Gratigny Road, parts of Bird Road, including certain portions of the area in question, etc.) Some of the finest residential developments in Dade County and in other parts of the country has developed along major streets and highways. Gentlemen; This application is made for the specific purpose of rezoning this property to C 1 to allow for the erecting of a 7-11 store on two of these lots, plans and specifications for which have been submitted, and to open the may for negotiations leading to other desirable business improvements. The present zoning on this property, namely Duplexes, is in every way unsuitable for the following reasons: 1. It fronts on an arterial highway with heavy traffic all year round and especially during the racing season with resultant noise, dirt, and hazard especially to children. The access to the new expressway nearby) opening soon) will tend to make this situation considerably worse. 2. Some of the properties in question have a frontage of 25 feet and some fifty feet with a depth after further street widening anticipated of only 85 feet. A lot 25 x 85 has a square footage of only 21125 feet, and a lot 50 x 85 has a square footage of only 4,250 feet. The present zoning requires a minimum )qua ¢-;footage of 10,000 square feet. It is obvious that these lots are too small for Duplexes. This situation came about because this property was platted in 25 foot lots, intended for business use, and sold as such. In the block between 64th Ave, and 65th Ave. the City has already rezoned a large parcel to business and the County has rezoned the rest of the block to B-3 and a gas station and tire company are already in operation there. This is the situation on the :riest boundary of the property for which this request for rezoning is being made. On the East the City has already rezoned to C-1 all of.the property in the City which fronts on Bird Road. In other words the City has already rezoned to C-1 all of the property in the City which fronts on Bird Road except these four blocks. Meanwhile we are paying taxes on this property year after year without being able to make use of it because 6-f improper zoning. Tie feel that it is time that the strip was brought into conformity with C-1 zoning throughout so that some progress can be made in improving it. All of the property on Bird Road from Red Road to Snapper Creek is either already improved or being rapidly improved with businesses. The four blocks in question for -uh.ich this application is made constitute an island in the midst of what is now commonly known as a business street. There and no homes on this property except one which is combined.with a Real Estate Office, The only other improvement is a Church which operates a nursery school for which it makes a charge. The Church is using a large part of its property for a parking lot. If this property is not rezoned for business it will remain vacant with very negligable revenue to the City and a very substantial loss to the owners. The F.N.A. has repeatedly refused to insure mortgages on this property on the ground that Bird Road is an arterial Highway, and that it is not suitable for residential use. Business improvements will bring the City substantial income in Taxes vhich will derive to the benefit of all. Recently the Court ruled that the zoning on this property was unreason- able and directed the City to give this property a more liberal zoning. Putting two families where it is not suitable for one does not solve the problem or change the nature of the zoning in any way. This problem has existed for ten years or more without a satisfactory solution. In the light of this and all of the above facts we feel that the matter should be reconsidered, and that the only solution is for the City to rezone this property to C-1. We respectfully request that the Planning and Eoning Board and the Council reconsider this matter carefully, in the light of all of the above, and feel confident in all reason and fairness that a rezoning of this property to C-1 will be finally decided upon, and effected.
