I am representing a group of property owners who own property .
fronting on the South Side of Bird Road between Red Road and Ludlum
Road, We desire a change of classification to High Class Business,
for all of the residential property fronting on the South Side of
Bird Road and lying between Red Road and Ludlum Road, because we
think it desirable to have the improvements on the street as uniform
in nature as possible.
Submitted herewith is a copy of the petition which we have
signed to this effect, and a list of the owners of the property in
question, whose property is in South Miami, together with the legal
description of the property they own. Only those who have signed
the petition are included in this list. The original petitions will
be submitted when requested. Enclosed is my check for `"10.00 which
I understand is the required fee for a hearing on this matter.
There are undoubtedly some who will object to the change. in
zoning. However, they will benefit by the improvements which will
come about as a result. Our request is based upon sound arguments
and we ask that you bear these in rind while considering this matter.
1. The precedent for a business street has already been established
on Bird Road at Red Road and at Ludlum Road.

2. Mortgage companies consider the property undesirable for
residences because of the established precedent to business
and because of the heavy traffic on Bird Road.
3. If you consult the evaluation department at F.H.A. Head-
quarters I believe they -�rill .tell you that no applications
for committments to insure loans on this property, for
residences, will be accepted.
4. These factors are holding back the development of the Street.
only one new house has been built in this section of Bird Road
in the past two years.
5. The neighborhood is ready for a numbgr of commercial enter-
prises, such as a. moving picture theatre, bakery shop, bicycle
shop, furniture store, music store, doctor dentist and other
professional offices. We also need a good tea-room or restaurant
If South Miami does not make room for these enterprises here,
other sections will continue to get improvements and business
which should rightfully belong to South Miami.

the Dade County Planning, Zoning and Building Department,
to write you and your Board a detailed objection to the
rezoning of the southside of Bird Road from Red to Ludlum,
from its present zoning to business zoning.
Our Board has repeatedly turned down requests to
change zoning on the northside and other parts of Bird Road.
This is a main arterial highway -- business strangles traffic.
We feel that sufficient business zoning is already there and
that additional business zoning would deteriorate adjoining
residential property as well as present business property.
We earnestly solicit your Board's cooperation in maintaining
the present zoning. As County Commissioner of that district
I assure you that the surrounding property owners agree with
our Board.

Dear Mr. Finks.
Relative to the hearing to be held on Friday, June 20, 1952, by your Board pursuant
to an application by Virginia Daniels and others to rezone all residentially-zoned pro-
perty between Red Road and Ludlum Road (South side) to C-1 or C-2, this Department de-
sires to submit this unqualified objection thereto, based on the following reasons.
First, the two business centers established at Bird Road and Red Road one located
in South Miami (Segal) and one located in the unincorporated area (Crandon] offers suf-
ficient good, developed business facilities to serve the area concerned. any additional
business zoning and resultant development would only serve to detract from these fine
business developments which were erected at great expense,and which warrant protection
because they do provide all required types of business and the facilities to serve the
public.
Second, it was the understanding of this Department, at the time the aforementioned
business centers were established, that one of the purposes of these well-planned centers
was to eliminate any necessity or need for stripping Bird Road, or Red Road with commer-
cial zoning and development. Certainly such practice of strip zoning, while admittedly
done by many jurisdictions in the past, is definitely contrary to all good planning practice.
Third, the practice of strip commercial zoning not only leads to the establishment
Of marginal businesses which struggle for survival and eventually require liberal business
zoning in order to maintain themselves with any semblance of financial success, but such
practice also cuts down the traffic carrying ability of the major and arterial streets
along which the commercial zoning is established. Further, such extensive business zoning
inevitably detracts from and devalues the residential property which abutts the commercial
area.
It might also be pointed out that because a particular street is a major or arterial
thoroughfare does not mean that it cannot be developed residentially (i.e. Red Road, Coral
Way, Gratigny Road, parts of Bird Road, including certain portions of the area in question,
etc.). Some of the finest residential development in Dade County and in other parts of
the country has developed along major streets and highways.
The Dade County Planning Board and the Board of County Commissioners have, in recent
years, established and practiced the policy of refusing to approve the stripping of any
streets with commercial zoning. Instead, where business is warranted, it has been confin-
ed to an area of sufficient width and depth to provide for proper,adeauate and well-spaced.

It is sincerely hoped that your Board will refuse the requested re-zoning. Please
excuse the somewhat lengthy objection, but it is brought on by the strong feeling that
such zoning as proposed can be nothing but detrimental to the residential and business
development already existing, to the street on which it would front, and to the individ-
uals who would attempt to maintain businesses on the property which the application covers.

I have three boys, and feel it would be d6trimental to their
best development to live so close to liquor stores such as those
already established at Bird & Red. I bought the property
feeling it was a good residential neighborhood in which to bring up
boys, and would feel that my property had lost its major value for
me if a business section were allowed so close.
People ought to have a sense of security about their neighbor-
hood. That should not be sacrificed by rezoning. If there were
a need-a serious need- for more stores so close, it would be a
different matter. But the present stores meet all reasonable need.
So why ruin a neighborhood for children?

Dear Sirs:
As a resident and property owner in the Bird
Boad Estates section of South Miami I am strongly
opposed to the changg in zoning of property on Bird
Road as proposed by Virginia Daniels and others for
the following. reasons:
1. When I purchased my home in this area one and one
half years ago I was informed that the area was zoned
for residential use only and I purchhased with this
fact in mind. Had there have been business property
in such close proximity I would not have invested my
savings in a home in this area.
2. There is no need for the stores etc. named in the
Daniels proposal. Adequate facilities for shopping
of the residents of this area are provided at Red
and Bird roads for ordinary purchasing while other
consumer goods and services are available in' the
downtown section of South Miami and Coral Gables.
We are doAng fine without these added stores and
any business they would draw would only be at the
expense of other established South Miami merchants.
3. only five of the fourteen petitioners are residents
of South Miami and it is only natural that the remaining
nine have no civic interest other than personal profit.
4. It is an established fact of city growth that the
introduction of business enterprises to residential
areas lowers the resale value of the homes in the
area. The proposed change would benefit the few at
the expense of many. The citizens of Bird Road Estates
have a right to expect their city officials to
safeguard their property rights.
5. The property in question already has homes scattered
along its l6ngth. The interspercement of business houses
would result in an unatractive hodge-podge such as
Miami has along NE 2nd Ave. and along SIW Stn St. ,

6. Flashing ..on sign's, gaudy bilboards,vverflowing
garbage cans and ugly back entrances with roaring
delivery trucks will be the senic prospect for us
who live here. Since there are no alleyways in this
area and lot depths do not permit them, it is obvioua-
that all deliveries wall have to be made from Bird
Road or from SW 41st St, This will add to the noise
and traffic problem considerably. While super market�s
and theaters provide some 'off-the-street parking,
small business never do provide adequate parking
facilities for their clients. This increased traffic
will be parking in front of drivewagy and blocking
residents from acces to their homes. This is a
common problem in bbher parts of the Greater Miami
section--we dontt want it here.
9. Traffic on Bird Road is increasing and will
increase more when the enormous Makle project out
west on Bird is completed. Business houses on Bird
would only add to this traffic burden and constitute
a menace to the children of our neighborhood.
S. . Petitioners state that lots on Bird Boad are not
accepted by mortgage houses for loans. I submit that
petitioners were well aware of this fact when they
purchased. Anyone of the business acumen which is
displayed by their present proceedure is attempting
this change would not be naive enough to purchase
property wouthout investigating the loan posibilities.
9. Petitioners state that if change is not approved
these business w&ll go elsewhere. This is a cheap
threat to try to influence the Zoning Board to approve
this change in order to secure the additional tax
revenue than this petition dangles before the Board.
This point of the petition is one which is not worthy
of consideration by the Zoning Board.
1. It is my earnest desire that the Board consider
the few advantages of this project and the many dis-
advantages and render the only fair decision that can
be made--DISapproval of the Daniels petition.

Tropical Park is 6pbn, is very heavy.

fore, cars would park on Bird Road causing a
congestion.
There isntt any need for a grocery store as we are
all within walking distance of the shopping district.
The people living in back of any store would have to
face the rear of the buildings where all the garbage
etc. would be kept,

I hereby file notice of my objection to the approval
of the application of Virginia Daniel and others to rezone
all residentially-zoned property fronting on the south
side of Bird Road between Red Road and Ludlum Road to busi-
ness zoning.
This area is one of one-family residences in which
most of the owners, young veterans, have invested their
savings and have settled down with the hopes of protecting
their investments and of finding a measure of peace and
quiet for themselves. It is a lovely neighborhood, one
of the best in the City of south Miami. I feel that to .hy
rezone the area would be to deprive,'the owners of a portion
of their investment since depreciation of property values
would inevitably result from close proximity to noisy busi-
ness activity. Most of us who reside here could ill afford
to have our property depreciate in value in such a manner.
This is an area of young families and many small children
live within 1000 feet of the area. Increased traffic on our
now quiet streets would be the end result of such a change in
zoning.
The business area located at Red and Bird Roads and that
area east of Ludlum Road and north of Bird Road adequately
serve this area and it is a question in my mind that more
businesses in this section are needed for one frequently sees
small businesses moving away from the Red-Bird area and others
taking their places for a short time until they, too, move
away. A constant turn-over in the small businesses in this
area is evident even to a casual .observer.
I, therefore, earnestly request the board to consider
all of thesd reasons why the peace and tranquillity of this r
area should not be distrubed in order to provide financial
gain to a few at the expense of many small home owners. V

Anticipating that I will not be able to attend the hearing
Friday evening Itne 20, at eight o'clock; I would like to
offer my protest to the rezoning of all residentially-2onod
property fronting on the south side of Bird Road between
Red Road and Ludlum Road, to a business zoning.
1. Within the first block South of Bird Road between Std
61st Ct. and b1l 62nd Ct. there are twenty four children
school age and only two that are in Senipr High School
the rest being in Elementary School or younger. Two of
these children ane mine. To rezone this section would
make way for a section such as there is at Ludlum and
Bird Reads on the north side. I can assure you that I
have no intention of letting my children grow up in such
an enviroment. The ppposition will probably argue that
this C-1 or 0-2 zoning will not let anything like this
happen, but I have seen fezoning work before and in a
few years there will be Bar Rooms, ReQtu!rsnts with their
garbage in the alleys, . etc. I have not made a personal
survey of this strech of Bird Road but I would estimate
there are at least two hundred children school age in this
area. If these public minded citizens of our community
want to improve our community why dont they offer to
establish a park or play ground for the children of our
city instead of making way for a glorified slum area.
There are enough delinquient children in our world today.
2. My home is situated approximately two hundred and fifty
feet from this proposed rezoning area and I feel without
• doubt that to rezone would devaluate my properyy to
• great extent.
3. liffe have the RID BIRD Section and the Ludlum Bird Section
wEdeh is in walking distance for anyone on the Northern
Boundry of South Miani.
These are but three of the many reasons why I think that a
rezoning of thid area not advisable. I,personally stand to
lose a lot more than I could ever. gain, because of the un-
healthy enviroment it would create for my children.

1. The neighborhood does not require andq in our opinions never will require ,
a commercial area beyond its present development and areas presently zoned
for commercial purposes. Thisy we believesis particularly true of the area
between 60th Ave, and 64th Ave.jas this section of South Miami mum is more
than adequately served by the business areas located at Bird and Red Roads
and Bird and Ludlam Roads.
2* Rezoning of this property I should not be considered without simultaneous
consideration of the rezoning of the property fronting on the North of Bird
Road and the County areas between Red and Ludlam fronting on the South of Bird
Road. Should all or part of the County areas facing on either side of Bird
Road be rezoned for businesst at some future dates we would consider it one
of the advantages of being a part of South Hiami that they would not allow
this commercial trespass in our residential area*
3. Due to its location at the most distant portion of an isolated section of
South Miami, some two and one half miles from the center of the city proper,
a commercial development in this area would serve only a small portion of the
city's population and would, of necessityp draw the major portion of its bus-
iness from adjacent areas outside of South Miami. We cite this only to im-
press the fact that6A"a" business district is, primarily$ not for the convenience
or necessity of the citizens of South Miami but, rather, for adjacent areas.
4. The only possible advantage to be gained by the city in rezoning this
property would be in its potential tax revenue which would be more than offset
by the inevitable degrading of the neighborhood and the ultimate decrease in
the value of the adjacent residential property.
5. Even though the F. H. A. may not accept insurance co=itments for resi-
dential loans on this property$ rezoning would only broaden the "no commit-
ment" ared due to the adjacent commercial zoning and result in a shifting of
this disadvantage 2ow from one group to a second group. This same condition
exists in the Bird Road area in Coral Gabless a parallel case to that in
questions and no one, at all acquainted with the administration of our sister
community, would entertain serious thought of getting that area zoned for
business. This is only one of many examples of property on busy thorofares .
on which the F. H. A. will not insure loans for residences. It is one of

the well known disadvantages of OWAivg such property. Can any reasonable
person contend that all property along all busy streets be rezoned for busi-
ness just because it is a busy street and the F. H. A. will not insure a

6. The applicant has contended that the establishment of business' at- Bird
and Red Roads has established a precident for business' along the entire
length of Bird Road from Red to Ludlam Roads. May we ask if it also estab�
fishes a precident for the establishment of business' along the entire length
Of Bird Road from Red to Le Jeune Roads) or along the entire length of Red
Road from Bird to Sunset Roadsp or along the entire length of Red 2= Road
from Bird Road to Coral tray? The answer is most obvious.
Several attempts have been made in the past to rezone all, or part, of the

establishment at 6290 Bird Road, which has been a detriment to the community,

street paving said lighting and greatly improved sanitary service, made in
this area in the past four years* We feel confident that the officials of

Dear Mr. McConnell:
As you know, I was present at the Zoning hearing a few nights
ago, which had to do with a petition filed by someone to extend
business on the south side of Bird Road from 58th Avenue to Lud-
lum Road. I was not called upon to participate in the arguments,
as of course was correct, because I am not a resident of South '
Miami; on the other hand, I thoroughly enjoyed the meeting, and
I think I'll make it a point to be present at some more zoning
meetings, .even tho I am a disinterested party. It is not only
interesting, but entertaining, to hear the different points of
view people have, and it is quite surprising to learn how familiar
some people are with the zoning problems.
You may not know it, but this writer is the tlFathertl of the
County zoning Act. George Merrick and I worked for over a year
on the original regulations, before the matter was submitted to
the Legislature and the Board of County, Commissioners. Of course
zoning has been changed in many, many instances since the original
Act was passed; by and large however, I still feel it was a very
necessary piece of legislation and that it has reacted constantly
to the benefit of the community. I am glad the City of South
Miami has worked so closely with the County Zoning Board and the
County Commission, and vice versa, which is the way it should be,
if we expect to have good zoning.
In this particular case of the petitioner who wished to extend
business from 58th Avenue to Ludlum Road, that would certainly
be detrimental to that whole area. The type of zoning where
selfish interests are permitted to string out business for a
mile or so is very injurious, and is against the policies of
the Zoning Board and the County Commission, and has been for
many years.

If you want to see an example of just what that sort of zoning
does to a community Mr. Mayor, go up Red Road past my home to
the corner of Coral Way and Red Road and then go north until
you come to Tamiami Trail, and you will observe that this type
of zoning has just about ruined that area. Business areas,
wherever they are, should be restricted to just as small an area
as is necessary to serve the community. These areas should never
be permitted to string out along our highways. All of those
people that protested against this particular zoning the other
evening all recognized that, and many of them so stated - they
had observed the result of this type of zoning.
Several of the people who spoke against this petition referred
to the fact that there is plenty of business at Red and Bird
Road, which of course there is; as a matter of fact, I have over
500 feet of vacant business property there, just waiting for
somebody to come along and want a builting erected there, which
we are ready to do, all of which indicates the demand for busi-
ness property has not yet filled the vacant business lots now
available, and then too, right across the street from me we have
all those small stores which have been vacant several times.
I was glad to see Mr. Cook of the County Zoning Department pre-
sent, which indicates his interest in all these fringe areas and
his willingness to put himself out to follow through on these
zoning matters connected with his office. As near as I have been
able to observe, Mr. Cook and his staff have been doing a very
excellent job.'
Was glad to meet you Mr. McConnell, and noted you were using
your genial talents and personality to "throw oil on troubled
waters" and maintain harmonious relations with your city officials.

Reviewing this notice, it appears that there is
no definite concrete plan for progressive- development of
this area. The present Bird and Red Road business area is
a fine nucleus for the beginning of a progressive business
street and every effort should be made to continue this
in plan by providing adequate parking space for each
business and adhering to the general construction scheme
as already established. however, this does not appear
feasible under the general wording of the present
application. I cannot attend the meeting on- June 20th,
and therefore register my dis-approval of the application
as written.
I do not wish to take the position of standing in
the way of well planned progress but I am sure there are
many who dissapprove of a haphazard zoning which would
depreciate the community in general. Therefore, I would
consider approval of rezoning of this area for business
if a definite progressive plan of development was agreed upon.
A few suggestions follow:
Business areas are now established at Bird & Red
and Bird & Ludlum. Continue development progressively from
Red Road Nest and from Ludlum Road East.
Adhere to a reasonable set back from street for
construction to provide for off-street parking and planting
of trees and landscaping.
Deviate from the conventional business building
architecture in obder to have a community business area
which will not be objectionable to the surrounding residences.
Reasonable assurance that property not located in the
City of South Miami in this area would eventually be zoned
corresponding to the precedent' set by the City of South Mimi.
Use discretion for approval. of such businesses only
that would be considered appropriate for a residential business
district.
