That Section 1 of Ordinance 37-26-669 be and . . is hereby amended to read as follows : "Section 1, That the application of DOROTHY CARTER, Alfred Jaskewicz, Sr. , Agent, for an exception from the requirements of Sec. 20-14 (2) (g) of the Code of Ordinances , City of South Miami, Florida, to permit ten off-street parking spaces instead of fifteen as .required by The Code for a drive-in, pick-up laundry and planton real property described as : The E.5 ' of the S.40' of Lot 21 and all of Lots 22, 23 and 24, COOPER'S SUBDIVISION, according to the Plat thereof recorded in Plat Book 4, Page 152, Public Records of Dade County, Florida, be and the same hereby is GRANTED, subject to the. follow- ing conditions : (a) That the site be developed in accordance with the plans submitted, within 1,8.0 days after final approval by Council, other- wise the exception will become null and void, . (b) That on-premises parking be limited. to customer parking only. (c) That forthwith applicants enter into an agreement with the City for the . annual rental of not less than five parking spaces in the City owned parking .lot at SW 71st Street and SW 58th Ave. , South Miami, such. spaces to be designated by the City Manager and to be at . the annual rate of $60.00 per space. The Manager shall issue appropriate identifying vehicle decals for use by the applicants and their employees and shall make such other :regu lations as shall be required to` comply with and enforce the intent of this, ordinance; (d) That forthwith applicants enter into a recordable agreement in the nature of covenants running with the land, as applied to the aforementioned real property, acknowledging that a specific condition of the .variance 'to the off- street parking requirements is 'that applicant and their successors in title shall at all times provide additional . offstreet parking as set forth above in sub-paragraph (c) or make suitable arrangements for substitute offstreet parking space to be approved by the Mayor and Council and accepting and agree- ing to such condition.". That any person, persons , firm, partnership or corporation violating any of the provisions of this ordinance shall, upon conviction, be punished by a fine not to exceed $500.00, or by imprisonment not to exceed six months, or by both such fine and imprisonment in the discretion of the Municipal Judge. Each day that a violation is permitted to exist shall constitute a separate offense. Sect ion 3. By reason of the nature of the content of this ordinance it shall not be included in the Code of Ordinances, City of South Miami, Florida.
