W . 71 Street Vice Chairman Coburn opened the Public Hearing by inviting Mr. McDowell to present the Staff Recommendation which recommended approval since a dry cleaning plant is already located adjacent to the property . ; Hence granting this special use permit and associated variance will have little effect on the existing commercial character or traffic in the area . Mr. McDowell pointed out the hardship created by the location of the existing building and the past history of litter and other problems in the area . Mr. Mario Capone , owner of the business, addressed the Board in favor - - of the above three requests . Mr . Capone , who already has an, esta�lished dry cleaning .and tailoring business in this location , said he would .. like to have a d'ry cleaning facility there so that he would not have to contract out his dry cleaning. He feels he has good support ' from his customers and could bring more business into South Miami while provid- ing better service for his customers . I I Vice Chairman Coburn invited other persons to speak in favor. Mr. Harold Margolin . addressed, the Board . Mr . Margolin , who is the owner of the property in question noted that in the past the ques- tion of landscape strips was unresolved with the City since this is a heavily traveled street and it is almost impossible to maintain the required landscaping . He offered to show pictures to illustrate his point . He also said that the existing businesses on this street gen- erate considerable traffic , particularly in the late afternoon'. It - was also his view that Mr . Capone ' s business would create more, jobs ' in South Miami . There being no one else speaking regarding the Request , Vice Chairman Coburn deemed the public hearing closed. I MOTION : By Mr . Michelson , seconded by Mr. Perry to approve the three requests . In the ensuing discussion , Chairman Smith questioned Mr. McDowell , regarding the reason why dry cleaning plants are allowed to oplerate only on arterial roads . Mr . McDowell said that these facilities tend to generate traffic during rush hours . However , he pointed out that the location is close to U . S . #1 , and a dry cleaning plant already is in business next door. Hence this application for a second dry cleaning plant will have virtually no effect,. The applicant already receives dry cleaning on the site . He merely wishes to clean it there rather than sending it out . Vice Chairman Coburn turned the meeting over to Chairman Smith . Public Hearing #81 -20 Zoning Joint Task Force Request : Proposed amendments to the RO ( Residential Office ) District Regulation . Chairman Smith declared the Public Hearing in session and invited' . Mr . McDowell to present the Staff Recommendation . Mr. McDowell said that - the Staff recommends approval of these amendl- ments . The Zoning Joint Task Force has worked hard on these p �opo;- sals and has developed a very even-handed approach to the RO dis-' trict . The new ordinance will protect the residential character ofi the district and provide better protection for the adjacent siingle family areas than the original ordinance , yet it allows enough buildable area to ensure high quality projects in keeping with the intent of the district . . -2- G t: r Highlighting the changes in the RO District Regulations he mentioned the new landscaping requirements which call for a continuous visual buffer between any office building and a residential single family property . He also cited minor changes in the criteria to be used in consideration of a RO project . These criteria strengthen the Environmental Review Board ' s position in terms of justifiably accepting or rejecting a project . He pointed to a change in the first sentence of the Purpose statement which stressed the need for projects that are residential in appear- ance '. Another change in the regulations is that parking will now be allowed below grade . He pointed out that below grade parking partially -conceals cars which is in keeping with the residential spirit of the district . Not allowing below grade parking tends to force buildings up into the air which is not the intent of the. ordinance . Mr. McDowell also clarified several questions from the Board re- garding below grade parking and building height , breezeways , and iParking spaces for compact cars . He suggested that the Board ; might wish to look at some display boards and models which had been] made by architectural students at the University of Miami and shown I to the Zoning Joint Task Force . Chairman Smith said that if this was discretionary and not mandatory he would suggest that the dis- play's be made available to those members of the Board .who wished toi see them at the conclusion of the meeting . MOTION : By Mr . Michelson seconded by Mr. Coburn for approval . i Chairman Smith opened the hearing to the public . There being no o,,ne wishing to discuss the amendment to the R0 , prior to taking a vote , Chairman Smith complimented Mr . McDowell and the Zoning Joint Task Force for their work in revising the RO ordinance . He also praised ] the Planning Board for their imput into the revision . Mr . McDowell also mentioned that since one location of RO zoning had the special circumstance of facing on Manor Lane , a..single family residential neighborhood , on one side and the Metrorail rightof-way on the other , the Zoning Joint Task Force . felt it unnecessary to require that offices built in this location be required to have a residential facade on the side facing U . S . #1 and the Metrorai'l right- of-way. For this reason an exception in this case is written` into � section 5-10-1 , Purpose , and section 5-10-4 , . 08 providing fo.r this special circumstance . Public Hearing #8118 Celestino Borron Request : Application for a Planned Unit Development Conditional Use Permit to allow 34 detached single family homes as shown on the plans on file with the Building , Zoning and Community Development Department of the City of South Miami . Legal Description : SW 4, NW 4, SW 4 of Section 25 , Township 54 South , Range 40 East , Dade County , Florida , less portion dedicated as public canal as filed in Official Records Book 4257 at Page 199 , Dade County, Florida Location : 6767 S . W. 67 Avenue . Chairman Smith asked Mr. McDowell to give the staff recommendation . Mr. McDowell stated : "Staff recommends approval . This property covered by this application is unique in all of South Miami due to the extensive , tree cover and the proposed site plan shows an exceptional sensitivity to P the existing foliage . There are well over 300 trees on the site and by utilizing a series of cul -de-sacs and a cluster design the developer has proposed a site plan that will require the relocation of only 36 trees . The proposed development clearly maintains the intent of the RS-3 Residential Single Family district by providing 34 detached single family residences on 8. 95 acres for a density of 3 . 8 units per acre . Private lot sizes have been diminished , ranging from 3600 square feet up to 6840 square feet , but in return 40 percent of the site is maintained in common open space and only 14 percent of the total site is covered by roads and walkways . In fact , approximately 70 percent of the total site will remain as permeable open space . In order to allow flexible building location, to save trees minimum building separation has been reduced to 10 feet from 15 feet . However , the setback from all exterior property lines will be 25 feet as is normally required by RS-3 regulations. Staff wholeheartedly recommends approval . " Mr. McDowell stated this proposed project had been reviewed by the Environmental Review Board at their meeting on July 21 , 1981 and upon request of Chairman Smith read into the minutes the action of the Environmental Review Board at that meeting and their motion to give preliminary approval of the plans . The ERB motion was unanimous . Mr. McDowell explained the duties and responsibilities of the Planning Board regarding PUD projects as outlined in Section 8-10-5 . 04 of the City of South Miami Zoning Ordinance No . 20-71 -724 . Chairman Smith announced the public hearing was in session and asked if there was anyone present caring "to speak in favor of granting the request . Mr. Charles Sieger , Architect , Mr. David M. Scully , Landscape Architect , and Mr. Gene Duarte , Attorney , addressed the Board . Mr. Scully presented numerous renderings of the proposed project to the Board . He stated the minimum setbacks from all property lines is 25 feet , the minimum separation is 10 feet between units and their entire concept is to preserve the trees on the site . Out of a total of over .300 specimen trees the current plans call for relocation of only 36 trees . There are to be 34 detached residential single family units and the density is 3. 8 units per acre . He presented renderings of the CBS wall to be constructed at the entrance and the landscaping fcr the . wall . He presented a rendering showing guide lines for fences , spas , screening trellises , etc . on a typical home . Mr . Sieger presented numerous renderings of the architecture for the various types of homes to be built on the project noting they had been placed to conserve the trees . Some will have detached garages and some adjoining. The houses had been placed so they could fit in between the trees . In response to Mr . Glickman ' s question , Mr . Sieger stated that the home presently on the property would be relocated or demolished and the two guest houses and the wall would be demolished in order to save the trees . There will be a home owners association to review any additions or alterations of the homes to control the project so that over a period of years it does not deteriorate , Page 2 - 7/28/81 jk Mr . Scully stated that they are requesting a six foot chain link fence on the north and the south property lines to main- tain present security. In response to Mr. Glickman ' s question regarding sewers for the property, Mr . McDowell stated that sewers will have to be brought in to the property. Probably the developers will in- stall a lift station , and lay a force line into a nearby city sewer. The sewer plans will have to be approved by the Dade County Pollution Control Board , In response to Mr. Glickman ' s question regarding the impact on traffic at S . W. 67th Avenue and Sunset Drive , Mr . McDowell stated that considering the density of the development , it should have less impact than any development in this area he could foresee . Plans to four lane S . W. 67 Avenue have been in the Dade County Transportation Improvement Plan for several j years . No action is anticipated until Metrorail is operative , or until traffic congestion at the intersection of S . W. 67th Avenue and Sunset becomes critical . Mrs . Joyce Schechter of 6721 S . W . 68 Terrace stated that she was neither for or against this project , but wanted to ask some questions . She stated that she was concerned over the traffic problems with cars from the project emptying into Ludlam during rush hours . Chairman Smith stated this was a very good point , and suggested she- contact Mayor Clark and find out why the county is not doing something about this faster . Mrs . Schechter stated that she was happy that the developer intends to keep so many trees , but questioned whether fire trucks would ` have trouble serving the residents , Mr . McDowell answered this I would be reviewed by Dade County , and in case of problems fire hydrants could be placed in each cul -de-sac so that if a truck could not be driven in and .out , it could be driven in and hooked up right there . There being no one else caring to speak for or against the ! request , Chairman Smith deemed the Public Hearing closed . MOTION : By Mr. Michelson , seconded by Mr. Coburn to approve the project , adding that he wished to compliment both architects for their fine presentation and the tremen- dous amount of work that has been done for this pro- ject . i In the ensuing discussion , Dr. Snyder questioned whether the area is served by gravity sewers . Mr . McDowell explained that the sewers have not yet been designed , but probably will be gravity within the project and then forced main to one of the city sewers . Mr . He noted that the citizens ' f. imput on traffic control , and the presentation of the architect ; and landscape architect , and attorney were of great help to the ' Planning Board . Request : Proposed amendments to the RO (Residential Office ) Oistri ,ct Regulation . Chairman Smith declared the Public Hearing in session and invited Mr. McDowell to present the Staff Recommendation . Mr. McDowell said that - the Staff recommends approval of these amendL ments . The Zoning Joint Task Force has worked hard on these Propo- sals and has developed a very even-handed approach to the RO dis- trict. The new ordinance will protect the residential character of the district and provide better protection for the adjacent single family areas than the original ordinance , yet it allows enough buildable area to ensure high quality projects in keeping with the intent of the district . -2- S Highlighting the changes in the RO District Regulations he mentioned the new landscaping requirements which call for a continuous visual buffer between any office building and a residential single family property . He also cited minor changes in the criteria to be used in consideration of a RO project . These criteria strengthen the Environmental Review Board ' s position in terms of justifiably accepting or rejecting a project . He pointed to a change in the first sentence of the Purpose statement which stressed the need for projects that are residential in appear- ance . Another change in the regulations is that parking will now be allowed below grade . He pointed out that below grade parking partially conceals cars which is in keeping with the residential'' spirit of the district. Not allowing below grade parking tends to force buildings up into the air which is not the intent of the j ordinance . Mr. McDowell also clarified several questions from the Board re- garding below grade parking and building height , breezeways , and parking spaces for compact cars . He suggested that the Board - might wish to look at some display boards and models which had been made by architectural students at the University of Miami and shown to the Zoning Joint Task Force . Chairman Smith said that if this was discretionary and not mandatory he would suggest that the dis- plays be made available to those members of the Board who wished to see them at the conclusion of the meeting . At the present time, I subcontract all of my dry cleaning to another company. Because of this, I am subject to whatever problems are occuring in their plant. An example of this would be the fact that their trucks breakdown while delivering dry cleaning to people such as myself. The dry cleaning then does not come in to my place of business until such time as they can repair or replace the delivery truck. My customers become angry with me because the dry cleaning is not available when promised. Another reason would be that the machinery in the dry cleaning plant breaks down and all dry cleaning must then wait until those machines are repaired. In the meantime we are receiving dry cleaning from our customers and promising it to them on specific days which we may not be able to deliver because of problems over which we have no control. If one of my customers needs a rush job, if I had the dry cleaning plant on my premises, I would be able to deliver special jobs for clients if the situation were to arise. As it is at the moment, I am not able to do this because I must wait for the pickup from my subcontractor. Many of my customers leave and go to another esta- blishment because I am not able to control that situation. In addition to be able to give my customers better service than they are now receiving, I feel that I can operate my dry cleaning plant much more efficiently than the subcontractor that I am now using. Because of my many years of experience in this field, I feel that with total control of the dry cleaning plant, which I hope to put on my own premises, I will be able to give my customers much better service than they are now receiving.
