Commissioner McCann stated her understanding that this tree survey is mandatory under Section 11 -5-2 of the City' s zoning ordinance and would like Administration t(' check to make certain this has been done . Ms . Aran-Spinra,d, Planning Director, stated the plans do not call for tree removal and site plans denote large trees . If there was to be tree removal , the plans would then have to go to the Environmental Review and Preservation Board. However, a tree survey has not been done . With regard to parking, applicant must apply for variances which will be done after zoning change is approved or denied . The zoning designation was High Density Residential ( RM-24 ) . In 1982 , the City Commission enacted Ordinance No . 23-82-1146 (Copy attached) , which among other things , changed the future land use designation of the subject parcel to Office. The zoning designation remained the same making this parcel not in conformance with the current ( 1981 ) Comprehensive Plan. The proposal for the new Comprehensive Plan ( 1988 ) calls for this parcel to be designated as Residential Office. Explanation The Applicant wishes to occupy an existing single family residence on the parcel to operate a small real estate office. Additional landscaping might be necessary as required by the Zoning Ordinance . ( 54' front x 63 ' depth ) . Thus , under R0 , the lot coverage would be exceeded by 3%. The F .A .R. for a parcel under 10 , 000 sq . ft . in are in the RO District is . 495 . The F .A.R. for this parcel is now . 33 ( 1 � 136 divided by 3402 ) . The lot has 2 1266 sq . ft . of open space . According to RO regulations , at least one tree shall be provided for every 400 sq .ft . of landscaped open space . Thus , 6 trees are required for this lot . There are three trees on this property noun. Three more trees would be required in order to bring this parcel in conformity with landscape requirements for RO District should the change in zoning be granted . A continuous visual buffer shall be provided where ever an RO use abuts or faces directly (within 50 ft. ) a property zoned for single-family residential purposes . CCK -6- 1/3/89 rjn Applicant Robert Strickland and attorney for the applicant Robert Black, addressed the Commission. Mr. Black stated the property had been rezoned (at the request of the applicant) and the variance requests would. permit the applicant to build while retaining the landscaping on the property. The open space requirements and landscaping requirements will not actually all be waived, but will be, reduced from what is normally required. Plans were shown to the Commission and Attorney Black noted the parking would be on the grass in the front yard , thus the request for waiver of any. drainage (no asphalt) . The cars would have to back out because the parking is in the front yard and the applicant is requesting a waiver of the decorative wall as there is not enough room and the property does not backup to any residences . No one else wished to speak and the public hearing was deemed closed. Vice-Mayor Schwait stated the applicant had requested a change in zoning and now is stating he cannot comply with building requirements for that zoning. ' The variances are, in his opinion, out-of-line but he would be in favor of considering them separately. Mr. Strickland, applicant, stated he does have an alternate plan if the Commission would like to review it . Commissioner McCann said she would not be in favor of considering a last minute alternate plan for which the public had not been notified . The hardship is that with the location of the improvements on the property, there is no where else to park but in the front. A review of the survey and the property illustrates clearly this situation. In addition to the hardship, if the variances are not granted, three beautiful, large native oak trees would either have to be moved or removed. Unfortunately, these trees are not a candidate for transplanting, therefore, removal would be necessary. Furthermore, the grass lawn would have to be replaces with asphalt which is not an attractive alternative for this property. The variance being requested in (H) on the preceding page, the wall, is needed as there is insufficient space on the front which is illustrated in the photographs included with the application. Also, on the rear of the property is a parkway which would make a wall impossible. It is the applicant's intention to keep as much of the current landscape and to add to it in order to beautify this property. Memo , PB-88-010 -2- December 13 , 1988 BACKGROUND On May 10 , 1988 , the Planning Board recommended approval and on July 19 , 1988 , the City Commission approved rezoning of the subject property from Medium Density Multi-Family Residence (RM-24 ) to Residential Office (RO ) District . (Ord . #8-88-1302) The Applicant wishes to occupy the existing single family residence for a real estate office use and as he wishes to have changes that do not comply with the zoning regulations , he is requesting 8 variances . ANALYSIS The Zoning Regulations ' and the rational for each requested variance are: 1 . (5-10-4 .05 ) Open space shall be provided on each lot equal to at least thirty (30 ) percent of the total lot area; said space shall be unencumbered by structures or off-street parking spaces , and shall be landscaped and well maintained with grass , trees , and shrubbery . At least one tree shall be provided for every 400 square feet of landscaped open space . At least 50% of said trees shall be 12-14 feet tall at the time of planting, and the remainder of the trees shall beat least 10-12 feet tall at the time of planting, and shall comply with the requirements of Article XV "Vehicular Use Area Landscaping" in all other respects . A sprinkler system shall be installed to ensure proper maintenance of the landscaped areas . Due to the small size of this parcel , the above ordinance can not be followed. 2 . (5-10-4 .06 ) In addition to the requirements of .05 (preceding) a continuous visual buffer shall be provided wherever an RO use abuts or faces directly (within 50 feet ) a property zoned for single family residential purposes . To accomplish this the normally required perimeter landscaped buffer shall be increased from five (5 ) to eight (8 ) feet in width and trees from Table RO-2 (attached hereto at the end of this section) shall be planted according to the spacing listed . These trees shall be a minimum of 10-12 feet tall immediately after planting. The Applicant is requesting to have the off-street parking in front of the house and entire frontage be used as an entrance and exit for the parking. This approach does not allow any landscaped buffer in front of the property . 3 . (7-1 ) An off-street parking space defined as an all-weather surfaced area , not in a street or alley, permanently reserved Memo , PB-88-010 -3- December 13 , 1988 for the temporary storage of one ( 1 ) automobile , and connected with a street or alley by an all-weather surfaced driveway whichaffords vehicular access without requiring another automobile to be moved . The Applicant is requesting to park automobile in an existing grass area instead of paving it for off-street parking use , in addition South Florida Building Code does not allow handicapped parking, in grass area . 4. (7-1-2 .01 ) In the RO District , parking shall not be allowed in the front yard . Because of the location of the existing building the parking space can only be located in front yard . 5 . (7-2-3) Off-street parking areas shall be drained to prevent damage to abutting properties , streets and alleys and surfaced with erosion resistant material in accordance with applicable City specifications . The Applicant does not want to provide the required drainage , which is not allowed in the South Florida Building Code . 6 . (7-2-5 ) Off-street parking areas shall be marked by painted lines , curbs or other means to indicate individual spaces . Signs or markers shall be used as necessary to insure efficient traffic operation of the lot . Since the applicant wishes to have grass area instead of paving , marking would be difficult if not impossible . 7 . (7-2-7 ) Entrances and exits shall not be located where they might create undue traffic problems . Landscaping, curbing or approved barriers shall be provided along lot boundaries to control the entrance and exit of vehicles or pedestrians . All egress and ingress to off-street parking areas shall be so designated as to prohibit backing out of vehicles into public rights-of-way . The applicant is dedicating 25 ' to the City and the proposed egress and ingress to the parking spaces is not adequate . 8. (5-10-4 . 10 ) A decorative wall of masonry , reinforced concrete , precast concrete or other like material that will be compatible with the main structure , five (5 ) feet in height shall be erected along all interior property lines , including the rear property line ; provided , however , that in the event that the rear property line abuts a secondary road , said wall shall be set in ten ( 10) feet from the official right-of-way of the secondary road , and said ten ( 10 ) feet shall be landscaped ; provided , further , in the event that the interior side property line abuts the same or liberal zoning district , the requirement for the wall along , said common interior property line shall not apply. A review of the survey and the premises reveals that parking is only available in the front yard as there are no other alternatives due to the location of the residence on the property. The other variance that is being requested is to allow a waiver of a buffer in the front of the property. This waiver is necessary due to the fact that the front area of the property is required for parking and if the buffer was established, it would make the parking impossible. This legal description was used in the required advertising, posting and mailing for this public hearing and for the recent rezoning of this same property (Ordinance No. 8-88-1302) . When informed of this situation, City Attorney Dellagloria told me that the City would treat the incorrect legal description as a typographical error, uphold the rezoning of this property, and proceed with the variance requests only if Mr. Strickland understood that should anyone challenge the rezoning or variances in the future, it would be Mr. Strickland's, and not the City's, responsibility to defend them. The City Attorney said that if Mr. Strickland wished it, the City would repeat the rezoning procedure using the correct legal descripton. Aside from the incorrect legal description, the drawing of the proposed park- ing arrangement on Mr. Strickland's property provided for only four legal spaces instead of the five spaces required. Permitting of this parking arrange- ment would require a seperate variance being granted in.addition to the two for which Mr. Strickland has already applied. When I advised Mr. Strickland of these two matters he decided not to repeat the rezoning procedure, and to work to revise his parking plan so that it provides the required number of parking spaces. He understood that his appli- cation would not be heard by the Planning Board on August 9 because of this problem with his parking plan.
