removal of 1 specimen Live Oak.
The permit is approved with the following conditions:
1. Applicant replaces canopy with 2 Live Oaks 2" DBH and 12' in height or,
2. Applicant'replaces canopy with 1 Live Oak 4"DBH and 16' in height and,
3. All newly-planted .plant material shall be watered by temporary or
permanent irrigation system until such time as they are established and,
4. All plants installed shall conform to, or exceed, the minimum standards
for Florida Number One as provided in the most current edition of:Grades`-
and Standards for Nursery Plants, Part I and II," prepared by the State of
Florida Department of Agriculture and Consumer Services and,
5. Failure to plant, preserve, or maintain each individual tree shall be
considered a separate violation of this Code and;
6. The trees are not removed until the ERPB has issued its final approval for
the site plan.

20-3.1 Zoning use districts and purposes.
(A) Zoning Districts Established. In order to implement the intent of this Code and the
city's adopted Comprehensive Plan, the City is hereby divided into eighteen (18) zoning use

(10) 'ROB'Residential Office District:The purpose of this district is to provide suitable sites
which will accommodate the limited office space needs of certain low impact profes-
sional services in attractive low profile buildings on heavily landscaped sites, archi-

(A) Applicability. All structures and uses which are erected,established or enlarged within
the city shall provide adequate off-street parking spaces and control mechanisms for on-site
vehicular and pedestrian traffic in order to insure the safety and convenience of the public

Planning Technician Application
While reviewing material submitted by Mr. Robert_.S_tr_icklandlsupporting his
application for variances for his property at (623_0 SW. 70 St PB-88-010 I
discovered that the legal description on Mr. S rickland's survey was incorrect.
This legal description was used in the required advertising, posting and
mailing for this public hearing and for the recent rezoning of this same
property (Ordinance No. 8-88-1302) .
When informed of this situation, City Attorney Dellagloria told me that the
City would treat the incorrect legal description as a typographical error,
uphold the rezoning of this property, and proceed with the variance requests
only if Mr. Strickland understood that should anyone challenge the rezoning
or variances in the future, it would be Mr. Strickland's, and not the City's,
responsibility to! defend them. The City Attorney said that if Mr. Strickland
wished it, the City would repeat the rezoning procedure using the correct
legal descripton. ,
Aside from the incorrect legal description, the drawing of the proposed park-
ing arrangement on Mr. Strickland's property provided for only four legal
spaces instead of 'the five spaces required. Permitting of this parking arrange-
ment would require a seperate variance being granted in addition to the two for
which Mr. Strickland has already applied.
When I advised Mr.', Strickland of these two matters he decided not to repeat
the rezoning procedure, and to work to revise his parking plan so that it
provides the required number of parking spaces. He understood that his appli-
cation would not be heard by the Planning Board on August 9 because of this
problem with his parking plan.

Please find enclosed a letter from Robert Strickland indicating
that neither he or his attorney were notified that his request
for rezoning of his above referenced property had been placed on
the Commission Agenda of June 7 , 1.988 (item 20 ) ; he was also
upset because of the cancellation of the Planning Board meeting '
of April 12th due to lack of quorum.

Planning Technician Application
While reviewing material submitted by Mr. Robert Strickland supporting his
application for variances for his property at 6230 SW 70 St (PB-88-010) , I
discovered that the legal description on Mr. Strickland's survey was incorrect.
This legal description was used in the required advertising, posting and
mailing for this public hearing and for the recent rezoning of this same
property (Ordinance No. 8-88-1302) .
When informed of this situation, City Attorney Dellagloria told me that the
City would treat the incorrect legal description as a typographical error,
uphold the rezoning of this property, and proceed with the variance requests
only if Mr. Strickland understood that should anyone challenge the rezoning
or variances in the future, it would be Mr. Strickland's, and not the City's,
responsibility to defend them. The City Attorney said that if Mr. Strickland
wished it., 1the City would repeat the rezoning procedure using the correct
legal descripton.
Aside from the incorrect legal description, the drawing of the proposed park-
ing arrangement on Mr. Strickland's property provided for only four legal
spaces instead of the five spaces required. Permitting of this parking arrange-
ment would require a seperate variance being granted in addition to the two for
which Mr. Strickland has already applied.
When I advised Mr. Strickland of these two matters he decided not to repeat
the rezoning procedure, and to work to revise his parking plan so that it
provides the required number of parking spaces. He understood that his appli-
cation would not be heard by the Planning Board on August 9 because of this
problem with his parking plan.

Dear Mr. Basu:
I am planning to establish a medical office at the above referenced address. This planned
use is in accordance with approved zoning for this property. Plans are to integrate
improvements in order to maintain a neighborhood feel.
Interpretation of current code suggests the need for 5 non-handicapped parking spaces
and one handicapped parking zone. Toward this end, consideration is proposed for the
presently non-improved portion lining S.W. 70'x' Street on the southern side of the street
and toward the west and/or east of the subject property to fulfill the requirement for two
regular horizontal parking spaces. The additional parking requirement is accommodated
within the off-street portion of the subject property. Enclosed is a diagram f
demonstrating the proposed use.
