This legal description was used in the required advertising, posting and mailing for this public hearing and for the recent rezoning of this same property (Ordinance No. 8-88-1302) . When informed of this situation, City Attorney Dellagloria told me that the City would treat the incorrect legal description as a typographical error, uphold the rezoning of this property, and proceed with the variance requests only if Mr. Strickland understood that should anyone challenge the rezoning or variances in the future, it would be Mr. Strickland's, and not the City's, responsibility to! defend them. The City Attorney said that if Mr. Strickland wished it, the City would repeat the rezoning procedure using the correct legal descripton. , Aside from the incorrect legal description, the drawing of the proposed park- ing arrangement on Mr. Strickland's property provided for only four legal spaces instead of 'the five spaces required. Permitting of this parking arrange- ment would require a seperate variance being granted in addition to the two for which Mr. Strickland has already applied. When I advised Mr.', Strickland of these two matters he decided not to repeat the rezoning procedure, and to work to revise his parking plan so that it provides the required number of parking spaces. He understood that his appli- cation would not be heard by the Planning Board on August 9 because of this problem with his parking plan. This legal description was used in the required advertising, posting and mailing for this public hearing and for the recent rezoning of this same property (Ordinance No. 8-88-1302) . When informed of this situation, City Attorney Dellagloria told me that the City would treat the incorrect legal description as a typographical error, uphold the rezoning of this property, and proceed with the variance requests only if Mr. Strickland understood that should anyone challenge the rezoning or variances in the future, it would be Mr. Strickland's, and not the City's, responsibility to defend them. The City Attorney said that if Mr. Strickland wished it., 1the City would repeat the rezoning procedure using the correct legal descripton. Aside from the incorrect legal description, the drawing of the proposed park- ing arrangement on Mr. Strickland's property provided for only four legal spaces instead of the five spaces required. Permitting of this parking arrange- ment would require a seperate variance being granted in addition to the two for which Mr. Strickland has already applied. When I advised Mr. Strickland of these two matters he decided not to repeat the rezoning procedure, and to work to revise his parking plan so that it provides the required number of parking spaces. He understood that his appli- cation would not be heard by the Planning Board on August 9 because of this problem with his parking plan. Interpretation of current code suggests the need for 5 non-handicapped parking spaces and one handicapped parking zone. Toward this end, consideration is proposed for the presently non-improved portion lining S.W. 70'x' Street on the southern side of the street and toward the west and/or east of the subject property to fulfill the requirement for two regular horizontal parking spaces. The additional parking requirement is accommodated within the off-street portion of the subject property.
