Request: EXTERIOR RENOVATION
APPLICANT'S REQUEST:
The applicant is requesting approval for the exterior renovation for the above referenced
property located in Residential Office "RO" zoning district.
STAFF ANALYSIS:
The applicant's intent is to upgrade the existing one-story building with a design that will provide
a unified look for a new medical office facility which is a permitted use in the RO zoning district.
The renovations consist of the installation and replacement of several windows and doors to the
north, south, east, and west facades. Several windows will be replaced and their specifications
may be found on sheet A-1. Various windows will be removed and will be stucco finished to
match the existing wall. The building will also undergo the replacement of a door on the
southern fagade. The details for this replacement door can be found on the sheet A-1 as well.
The north fagade will also undergo the installation of a handicap accessible ramp. The scope of
work includes a concrete landing, a walkway (accessible route), and prefabricated steel hand
rails that will be installed. The minimum size of handicapped parking spaces, signs and symbols
are guided by Section 20-4.4(D)(1)(2) of the Land Development Code. In order to ensure a
functional and safe design, the handicap ramp must be consistent with the American Disability
Act (ADA) and the Florida Building Code (FBC). Note that the concrete slab and planter located
on the north side of the building will be removed in order to accommodate the new handicap
ramp.
The proposed medical office use of the one-story building which has a total area of 1,129
square feet has a parking requirement of one (1) space for every 200 square feet of medical
office space calculates to a total parking requirement of six (6) parking spaces. The applicant
will be providing four of the six (6) required spaces and has signed a parking lease agreement
with the City dated March 16, 2007 where the City agrees to provide the applicant with two (2)
off-site metered parking spaces. The lease agreement states that the two (2) off-site parking
spaces are being provided in order to prevent the removal of the two (2) existing oak trees.
RECOMMENDATION: Approval with the following conditions:

1. Disabled ramp must comply with ADA and FBC;
2. Provide four parking spaces;
3. The two existing oak trees cannot be removed;
4. Any comments and/or suggestions from Board.

OFF-SITE PARKING AGREEMENT
The approval of a Building Permit, a Certificate of Use, a Certificate of Occupancy
or an Occupational License by the City of South Miami for the operation of a medical
office (the "Business") located at 6230 SW 70'h Street , South Miami, Florida (the
"Building") is conditioned upon the applicant's compliance with the terms set forth
below.
I, Dr. Arthur S. Colsky, owner of the building, do fully understand that in order to
obtain a Building Permit, a Certificate of Use, a Certificate of Occupancy, or an
Occupational License, to operate the Business, the conditions established in this
agreement, as set forth below, must be strictly complied with. As the duly authorized
representative of the Business I agree to the following:
1. The use of the building as a medical office requires the provision of six parking
spaces.
2. Four of the required parking spaces shall be provided on the building site to be
used as required parking. (see Attachment "A", Site Plan,showing location of the four on-
site parking spaces)
3. Pursuant to Land Development Code Section 20-4.4 (A)(2) the City hereby
agrees to assign two (2) off-site parking spaces to the Property located at 6230
SW 701h Street which spaces are to be credited as required parking spaces for the
Business. The two-spaces credited are on-street metered spaces within the right-of
way of SW 70th Street and are located within 1500 feet of the building. The
two spaces and are not currently assigned to or credited to any other business or
property. (See Attachment "B" showing the location of the two on-street credited parking
spaces)
4. As consideration the applicant agrees to retract the current tree removal
application submitted to the Planning Department on December 12, 2006. The
applicant agrees and understands that the two off street spaces which have been
assigned to the Building are contingent upon applicant maintaining the two oak
trees listed in the application. (See Attachment "C"Tree Removal application)
5. The City agrees that as long as the applicant adheres to the intent of this
Agreement and otherwise complies with the Land Development Code the City
shall not revoke or terminate its assignment of the two spaces.
6. In the event, the property ceases to be used as an office for a period of six months
or more, the City may terminate this Agreement. Prior to termination, the City
shall provide the property owner with thirty days prior written notice.

7. The applicant further agrees to construct four of the required parking spaces on
the building site to be used for as required parking. In the event the City requires
an ADA space on site, the City agrees to assign an additional off-site parking
space to the property in order to prevent tree removal.
8. If at any time, the applicant ceases to provide the required four on-site parking
spaces, the City will have the right to require that operation of the Building as
medical office shall cease until such time as adequate proof of the required on-
site spaces is provided to the Planning Department; however, the Building may
be operated for some other lawful purpose, provided it meets the provisions of
the Land Development Code,then in effect;
9. This agreement applies to the current Business, and any subsequent or future use
which may be located at the Building provided that any new use meets the
provisions of the Land Development Code, then in effect.
10. The City agrees that the destruction or removal of the two oak trees by an act of
nature shall not result in the loss of the two spaces credited to the Building as set
forth in this agreement. If the City determines that one or both trees should
threaten the foundation and or the structure of the building, the tree removal may
be performed without the loss of the assigned off-street parking spaces.
11. Yearly renewal of the Occupational License for the business shall include
reference to this off-site parking agreement.
!2. This Agreement may be recorded at the Applicant expense in the Official public
records book of Miami Dade County.

6. In the event, the property ceases to be used as an office for a period of six months
or more, the City may terminate this Agreement. Prior to termination, the City
shall provide the property owner with thirty days prior written notice.

7. The applicant further agrees to construct four of the required parking spaces on
the building site to be used for as required parking. In the event the City requires
an ADA space on site, the City agrees to assign an additional off-site parking
space to the property in order to prevent tree removal.
8. If at any time, the applicant ceases to provide the required four on-site parking
spaces, the City will have the right to require that operation of the Building as
medical office shall cease until such time as adequate proof of the required on-
site spaces is provided to the Planning Department; however, the Building may
be operated for some other lawful purpose, provided it meets the provisions of
the Land Development Code, then in effect;
9. This agreement applies to the current Business, and any subsequent or future use
which may be located at the Building provided that any new use meets the
provisions of the Land Development Code, then in effect.
10. The City agrees that the destruction or removal of the two oak trees by an act of
nature shall not result in the loss of the two spaces credited to the Building as set
forth in this agreement. If the City determines that one or both trees should
threaten the foundation and or the structure of the building, the tree removal may
be performed without the loss of the assigned off-street parking spaces.
11. Yearly renewal of the Occupational License for the business shall include
reference to this off-site parking agreement.
!2. This Agreement may be recorded at the Applicant expense in the Official public
records book of Miami Dade County.

APPLICANT'S REQUEST:
The applicant is requesting approval for the exterior renovation for the above referenced
property located in Residential Office "RO" zoning district.
STAFF ANALYSIS:
The applicant's intent o upgrade the existing one-story building with a design that will provide
a unified look for n p'dedical office facility which is a permitted use in the RO zoning district.
j The renovations con lst of the installation and replacement of several-windows and doors to the
f, south, east, and west facades. Several windows will be replaced and their specifications may be

existing wall. The building will also undergo the replacement of a door on the southern fagade.
The details for this replacement door can be found on the sheet A-1 as well. The north fagade
will also undergo the installation of a handicap accessible ramp. The scope of work includes a
concrete landing, a walkway (accessible route), and prefabricated steel hand rails that will be

Section 20-4.4(D) the Land Development Code. In order to ensure a functional and safe

1. Disabled ramp must comply with ADA and PBC;
2. Provide four parking spaces;
3. The two existing oak trees cannot be removed;
4. Any comments and/or suggestions from Board.
