This sidewalk shall be located in an area and at a grade so as to be compatible with the proposed widening of 62nd Avenue, as is presently contemplated by the Public Works Department of Metropolitan Dade County, Florida. The Owners have caused substantial landscaping to be done in the .area where the said sidewalk is to be constructed. The parties agree that they will use their best efforts to prevent the necessity of removing any trees in connection with the construction of the sidewalk, and in this connection, will allow the..sidewalk to be notched around trees or plantings where same will not interfere substantially with the contemplated use of the sidewalk. The parties agree that certain trees may be pruned or cut back in order to accommodate the said sidewalk with- out the necessity of removing said trees. If certain trees must be uprooted in order to accommodate the said sidewalk, such trees shall be moved to another portion of the property and replanted. 2. The requirement of constructing curbs and gutters on the property is hereby waived until such time as the City Council requests that these items be constructed. 3. The Owners shall forthwith grant appropriate dedications as may be required by the City of South Miami or Dade County, as the case may be, for the right of way. of the proposed widened 62nd Avenue. Said dedications shall be in a form approved by the City Attorney of South Miami. 4. In the event the Owners fail to construct the sidewalk as contemplated herein, or the curbs and gutters when same are required to be constructed after having been given fifteen (15) days notice by certified mail to do so, then, and in that event, the City shall have the right to make such improvements and the cost therefor shall consti- tute a lien against the property described in this Agreement subordinate only to governmental real estate taxes and the assessment and collection of said lien shall be made in accordance with the law, including but not r -2- tiff Pc ?33 limited to the terms and conditions of Chapter 170 F.S.A. , said lien to be togethe_- with interest at six (60) per cent per annum and reasonable attorneys fees. 5. All work, installations and/or improvements to be made by the Owners shall be at the sole direction of the City and at the sole cost of the Owners and at no cost to the City. 6. Covenants, agreements and undertakings of the Owners herein contained shall be and constitute covenants running with the land and same shall be binding on the Owners and its successors and assigns in ownership of the above described property, and those persons who consent thereto. 7. The Owners shall supply the City with an Opinion of Title showing ownership of the aforedescribed property to be in the Owners and naming all mortgagees, said Opinion of Title to be in a. form approved by the City Attorney of the City. 8. This Agreement shall be effective only if all mortgagees shall consent to the. terms and conditions of this Agreement and Covenant Running With The Land. This beam operates as a tie beam in conjunction with two adjacent structual beams. In discussing its removal with Mr. Breiderman, we have determined that although it could be done, it would be an involved, and rather costly project. A letter notifying you that there are violations in the subject building was sent to you on November 12, 1974 requesting a meeting for the purpose of gaining code compliance. A letter was received by this office on November 26, 1974 from Art Construction, authored by Mr. Singerman, itemizing each code violation and stating the disposition of each and closing with "We will be in contact with you very soon regarding the above listed items". Neither you nor Mr. Singerman contacted this office until the receipt of a letter from this office. dated February 17, 1975. At this time, this office learned that some compliance was gained. Upon an inspection of the subject building on April 8, 1975, this department found the items that are listed in this letter to be in violation of the code. A meeting with Mr. Singerman was called for the purpose of discussing the continued non-compliance of the codes. The meeting was held on April 10, 1975 . Mr. Singerman stated in the April .10th meeting that he would immediately begin compliance, notify the owners of the continued code problems, and return to this office on Monday, April 14, 1975 with revised plans for stairway No. 1 that would meet code requirements. The South Florida Building Code, adopted by the City of South Miami, "Sub-section 307 .1 Certificate of Occupancy", states in part: "No building hereafter erected, altered or enlarged, shall be used or occupied in whole or in part until a Certificate of Occupancy shall have been issued by the Building Official certifying that the building and occupancy are in accordance with the provisions of this code and all other ordinances and laws applicable thereto. ARTICLE IX _ -------. NONCONFORMING USES 9-1 NONCONFORMING USE OF LAND A use approved as a nonconforming .use of land shall be considered a conforming use so long as the conditions of the approval are met. 9-2 NONCONFORMING SIGNS Where a sign does not comply with the provisions of these Regulations, such sign and supporting structures, other than a building, shall be removed not later than one (1) year from the date of passage of these Regulations. A nonconforming sign painted on the wall of a building or similar flat surface shall be removed by painting so as to completely obliterate the sign. Supporting structures for nonconforming signs may continue in use for a conforming sign if they comply in ell respects with the applicable requirements of these Regulations and other codes and ordinances. Nonconforming signs may continue in use during the one-year period unless subject to removal under other provisions of these regulations, but no permits for additional signs shall be issued for any premises on which there are any nonconforming signs. 9-3 NONCONFORMING USE OF BUILDINGS Except as otherwise provided herein, the 'awful use of a building existing at the effective date of these regulations may be con- tinued, although such use does not conform to the provisions here- in. If no structural alterations are made, a nonconforming use of a building may be changed to another nonconforming use of a more restricted classification. Whenever a nonconforming use has been changed to a more restricted use or to a. conforming use, such use shall not thereafter be changed to a less restricted use. The nonconforming use of a building may be hereafter extended throughout those parts of a building which were lawfully and mani- festly arranged or designed for such use at the time, of passage of these Regulations. 52 OFFICI_- RIGHT-OF-WAY WIDTHS (Con sued) 8-7-2 Other Rights-of-Way . No building or premises shall be erected, improved, altered or enlarged in RB-1, RB-2, RM-18, RM-24, RO, .CO, C-1, C-2, C-3 or I Districts, or Certificates of Occupancy issued for buildings in said districts, except on the condition that sidewlaks, curbs, gutters, drainage structures and paving, on or off-site, are properly installed in accordance with City requirements, unless any of said requirements are waived by the City Council. l Revised': 10/15/74 71 CHAPTER 2 ORGANIZATION AND ENFORCEMENT 201 PGVIERS AND DUTIES OF BUILDING OFFICIAL 202 UNSAFE BUILDINGS 203 BOARD OF RULES AND APPEALS 204 ALTERNATE MATERIALS AND TYPES OF CONSTRUCTION 205 VIOLATION AND PENALTIES 201 POWERS AND DUTIES OF BUILDING OFFICIAL The appointing authority shall appoint a Building Official and such person shall have not less than five years experience as either a registered professional engineer, a registered architect, a general contractor holding a certificate of competency and in effect at the time of his appointment, or a building official in responsible charge of enforcing a comprehensive building code; provided that the provi- sions of this section are not applicable to the persons acting as build- ing officials in the incorporated areas on the effective date of this ordinance. 201.1 EMPLOYEES: The Building Official shall have the power to delegate powers and assignments to subordinate employees working under his authority. Such employees shall have the duties and powers as delegated by the Building Official. 201.2 RIGHT OF ENTRY: Upon presentation of p p proper cre- dentials, the Building Official or his duly authorized representatives may enter, at any reasonable time, any building, structure or prem- ises for the purpose of inspection or to prevent violation of this Code. 201.3 STOP-WORK ORDERS: Whenever any building work is being done contrary to the provisions of this Code or is being done in an unsafe or dangerous manner, the Building Official may order such work stopped, or may order the violation corrected within a reasonable period of time, by notice in writing served on the person or persons engaged in the doing or causing, of such work to be done; and such persons shall immediately stop such work until arrange- ments, in compliance with the provisions of this Code and satisfactory to the Building Official, have been made, at which time he may authorize the work to proceed. 201.4 CONCEALED WORK: The Building Official may order portions of the structural frame of a building and/or structure to be exposed for inspection when, in his opinion, there are good reasons to believe that a building or portion thereof is in an unsafe or dan- gerous conditi ncealment of a o this Code. 201.5 OCCUPANCY: 'Whenever any building or portion there- of is being used or occupied contrary to the provisions of this Code, the Building Official shall order such use or occupancy discontinued / and the building or portion thereof vacated._Such order shall be by notice in writing, served on the persons or persons using, or causing to be used such building or portions thereof. Within a reasonable period of time after receipt of such notice or order, such building or v0 portion thereof shall be made to comply with the requirements of this Code; however, in the event of an emergency, Sub-Section 202.5 a 202 UNSAFE BUILDINGS 202.1 GENERAL: (a) Buildings or structures that are, or hereafter shall become, unsafe, unsanitary or deficient in adequate 2-1 Amended 29 April 19 12 (b) VALUATION CRITERIA: - (1) If the cost of alteration, repair and/or replacement of an C unsafe building or structure or part thereof exceeds 50% of its value, such building shall be demolished and removed from the premises. If the cost of alteration, repair and/or replacement of an unsafe building or structure or part thereof does not exceed 50% of such replacement cost, such building or structure may be re aired and made safe, as provided in Section 104 and in the applicable minimum housing code; or (2) If the cost of structural repair or structural replacement of an unsafe building or structure or part thereof exceeds 33% of the structural value, such building or structure or part thereof shall be demolished and removed from the premises; and if the cost of such structural repairs does not exceed 33% of such replacement cost, such building or structure or part thereof may be structurally re- paired and made safe,as provided in Section 104. (3) In order to determine the value of a building or structure and the cost of alterations, repairs and replacement, the guides and Standards provided in Section 104 shall apply. 202.3 INSPECTION OF UNSAFE BUILDINGS AND STRUC- TURES: The Building Official, on his own initiative or as a result of reports by others, shall examine or cause to be examined every building or structure appearing or reported to be unsafe, and if such is found to be an unsafe building or structure as defined in this section, the Building Official shall post the property concerned and shall furnish the owner of such building or structure with written notice, the manner of posting and furnishing of written notice is provided hereinafter. 202.4 POSTING: The building Official shall post, but not before 14 days after the notice of violation hereinafter provided has been served, a signed notice in a conspicuous location on the building l" or structure which has been determined to be unsafe. The posted notice shall read substantially as follows: "UNSAFE BUILDING". f This building or structure is, in the opinion of the Building Official, unsafe, as defined in Secton 202 of the South Florida Building f Code. This building SHALL BE VACATED—SHALL NOT BE OCCUPIED. Action shall be taken by the owner as further pre- 4 scribed by written notice previously served. THIS NOTICE SHALL NOT VED ING OFFICIAL. E-...._.................................. 202.5 EMERGENCY ACTION: (a) When in the opinion of the Building Official, there is actual or immediate danger of the failure or the collapse of a building or structure, or there is a health, windstorm or fire hazard, he may order the occupants to vacate, temporarily close for use or occupancy the rights of way thereto, sidewalks, streets or adjacent buildings or nearby area and institute such other temporary safeguards, including securing and posting of the building or structure, as he may deem necessar% under the cir- cumstances, and may employ the necessary labor and materials to perform the required work as expeditiously as possible. (b) Costs incurred in the performance of such emergency work shall be paid by the appropiate governmental authority and upon the recording in the public records of this county a certificate ex- ecuted by the Building Official, certifying the amount so expended and why expended, the same shall become a lien against the properi involved. For .failure to comply with such notice after such period of five days,the permit holder is subject to the penalties specified herein, and the Building Official shall have the clean-up work done and public prop- erty restored and shall notify the legal authority, who shall institute the necessary action to have the costs placed as a lien against the r a ton as issued. 307 CERTIFICATE OF OCCUPANCY 307.1 WHEN REQUIRED: No building hereafter erected, al- tered or enlarged, nor existing building involving a change of Occu- pancy shall be used or occupied in whole or in part until a Certifi- cate of Occupancy shall have been issued by the Building Official; certifying that the building and Occupancy are in accordance with the provisions of this Code and all other ordinances and laws a cable thereto; exc een uring the work of alteration or enlargement shall be discontinued within 30 days after the completion of the work unless the required certificate is secured from the Building Official. If the building.or part thereof complies with the provisions of all pertinent laws and regulations, the Building Official shall issue the Certificate of Occupancy. A Certificate of Occupancy for places of assembly shall indicate thereon and make record of the number of persons for which such certificate is issued. 307.2 EXISTING BUILDINGS: If an occupancy which does not comply with the requirements of this Code has existed prior to the adoption of this Code, the Building Official shall issue a Certifi- cate for Occupancy therefor, unless the building and use, in his opin- ion, constitute a serious hazard to life, limb or property. If an ap- plication for a Certificate of Occupancy is not approved, such oc- cupancy shall not be started or shall be discontinued. 307.3 REVOCATION: The Building Official shall have the authority to ixevoke a Certificate of Occupancy for any building which is occupied, .in whole or in part, for any use not authorized i ar which is changed in.Occupancy,to a classification where such Occu- pancy does not comply with this Code, or for any building where the live loads imposed on any floor or the number of,persons permitted \�\ • to assemble therein or thereon exceed those authorized in Faid Cer- tificate. The revoking of a Certificate of Occupancy shall have the J \� effect of nullifying any occupational license issued in connection � ' with such building or the affected part of such building. 307.4 TEMPORARY AND/OR PARTIAL CERTIFICATE OF OCCUPANCY: (a) A Temporary and/or Partial Certificate of Occupancy may be issued by the Building Official for the temporary use of a portion of a building, providing the portion of the building to be occupied is clearly designated and all code provisions such as sanitary facilities, means of egress, fire-resistive separations, struc- tural adequacy, the barricading of work areas, etc., relating to public safety have been approved by the Building Official. (b) The Temporary- and/or Partial Certificate shall be issued for a limited period not to exceed ninety days. 307.5 CONNECTION OF SERVICES: It shall be unlawful for any public-service corporation or agency to begin service to a building, except temporary service for use during building opera- tions and for testing- purposes, until a Certificate of Occupancy has been issued and%or notice posted on the premises. 3-12 terials of construction.
