(See Permitted Use Schedule, Section 20-3.3(D) of the Land Development Code and Hospital district definition attached). (2) Medical office use is permitted by right for properties zoned "H", Hospital. (3) Pursuant to Section 20-9.11(A)(3), Unity of Title required, of the Land Development Code, was executed on May 28, 1970 and recorded on June 16, 1970, attached copy. The legal description of the properly is set forth in the Unity of Title Agreement. (4) The Annex Building is located in the City of South Miami, and subject to a Unity of Title Agreement, recorded in Official Records Book 6888, at pages 581-582 of the Public records of Miami-Dade County, under the terms of this agreement, the Property must be owned by only one entity and may not be subdivided without approval by the City. (5) Pursuant to Section 20-3.6(Q)(2), Screening and Soundproofing of Exterior Heating, Ventilating, Air Conditioning Equipment, and Other Mechanical Equipment, of the Land Development Code, requires proper screening by the use of landscaping or such other screening device as shall be approved by the Environme.ntal Review and Preseni2tion Board. You have indicated that a replacement of existing doctors offices with new doctors offices with supporting MR], CT & Gamma Knife equipment for the Annex Building on the subject property. Also, stated are that these modifications will be interior renovations and there will not be any expansion of the existing building square footage. In that regard,we confirm that i) the medical office use is permitted for property zoned "H" Hospital; ii) current zoning would allow the building to be renovated or would allow modifications to the interior only without any expansion or increase of the existing building square footage; (again, assuming that there will be no additions or building construction other than as described herein); and iii) the supporting MRI, CT & Gamma Knife equipment for the Annex Building requires proper screening by the use of landscaping or such other screening device as shall be approved by the Environmental Review and Preservation Board. Weinstein, this letter serves to identify the zoning designations for the properties described by the attached legal descriptions. Parcel "A" is located in the "'H' Hospital District." Parcel `B" is located in the "MU-5" sub- district of the Transit Oriented Development District (TODD). Definitions of the districts are provided below: "H" Hospital District (4-story): The purpose of this district is to permit, as a special use, areas that will accommodate various hospital needs in a manner compatible with nearby residential areas. The district also permits office uses at appropriate intensities in the event that hospital uses are terminated and is appropriate in areas designated "Hospital/Office" on the City's adopted Comprehensive Plan. The unique nature of hospital usage and its quickly changing needs and characteristics makes their proper regulation under ordinary zoning.regulations difficult. Hospitals located near residential areas are both an asset in terms of jobs and services provided and a liability in terms of traffic generated and their propensity to expand. It is the intent of this district to establish stable land use patterns in hospital areas upon which local residents and hospitals can both rely. "MU-5" TODD (4+4 story): The purpose and intent of this regulation is to maximize the presence of a dedicated mass transit center located within walking distance of the boundaries of the proposed district. The maximum utilization of that facility will be achieved through the creation of a district that surrounds this major mass transit facility and is designed to encourage a mix of high density uses, specifically residential, retail and office uses. It also will provide for the continuation of existing light industrial uses but encourage redevelopment throughout the Transit-Oriented "City of Pleasant Living" Development District (TODD.) through flexible and performance oriented zoning and other regulations.
