South Miami :s F l o r i d a 'A All-America City �xxx 2001 CITY OF SO UTH MIAMI PLANNING AND ZONING DEPARTMENT Tree Removal Permit Conditions Form June 6,2011 Applicant: Larkin Community Hospital Property Owner Larkin Community Hospital Project Address 6129 SW 70`h Street, South Miami Folio Number 09-4025-028-1900 APPLICANT'S REQUEST: The applicant has filed a tree removal permit for the relocation of the following trees as shown on the attached Existing Tree List, sheet L-2: • 3 Sabal Palm Trees • 2 Queen Palm Trees • 1 Live Oak Trees • 1 Orange Geiger Tree The permit is approved with the following conditions: Tree Specifications All tree replacements must be Native Hardwoods, Florida Fancy Number I with a minimum height of 12'-0"to 14'-0"unless otherwise stated I. As per the City's certified arborist, Doug Baker, the relocation of the three (3) Sabal Palm trees and two (2) Queen Palm trees listed above are approved for relocation with the following conditions: A. The approval to relocate the palm trees listed above will be contingent on the review and approval of the new construction project by the Environmental Review & Preservation Board. Please note that the trees are not to be removed until the ERPB has issued its final approval for the site plan B. The relocation of the three (3) Sabal Palm trees and two (2) Queen Palm trees must comply with the regulations as set forth in the Tree Removal Permit Relocation Standards, Section 20-4.5(K)(2)of the City of South Miami Land Development Code,which states: 2. Palms: a. Fronds shall be securely tied around the bud prior to relocation and shall remain securely tied around the bud during the entire relocation process and for a minimum of one (1)week after relocation;and, c. Any palm that dies or becomes nonviable within one (1)year of relocation shall be replaced according to the standards set forth in Sections 20-4.5(J) (2) & (3). C. Preservation credit for relocated trees. Permittees who successfully relocate trees shall receive full credit for the relocated trees and the tree replacement requirements herein shall not apply to such relocated trees. All relocated trees shall meet the standards set forth above. D. Root pruning of the trees listed above will be required prior to their relocation. E. Failure to plant, preserve, or maintain each individual tree shall be considered a separate violation of the Land Development Code. F. If any of the three (3) Sabal Palm trees fail to survive relocation, the tree that did not survive shall be replaced by one(1)tree that meets the tree specifications listed above. G.After such time, a final inspection must be held prior to the Certificate of Occupancy being issued for the new construction building. II. The relocation of the six(6)Royal Poinciana trees and eight (8)Live Oak trees must comply with the regulations as set forth in the Tree Removal Permit Relocation Standards Section 20- 4.5(K)of the City of South Miami Land Development Code,which states: A. The approval to relocate the palm trees listed above will be contingent on the review and approval of the new construction project by the Environmental Review & Preservation Board. The relocation of the Live Oak tree and the Orange Geiger tree must comply with the regulations as set forth in the Tree Removal Permit Relocation Standards, Section 20- 4.5(K)(1)of the City of South Miami Land Development Code,which states: 1. Trees other than palms: a. Tree roots shall be severed in such a manner as to provide a root ball which is sufficient to ensure survival of the tree when relocated. A sufficiently-sized planting hole shall be provided at the relocation site to ensure successful re- growth; b. After root severing, adequate time shall be allowed prior to replanting to ensure survival of the tree(s). After root severing and prior to relocation, tree(s) shall be watered a minimum of twice weekly; and, after relocation, said trees) shall be watered a minimum of twice weekly until the tree(s)are established; c. During removal and transportation of the tree, the root ball and vegetative portions of the tree shall be protected from damage from wind or in' ; and, d. Any tree that dies or becomes nonviable within one (1)year of relocat on shall be replaced according to the standards set forth in Section 20-4.5(J)(2) (3) of t Land Development Code. In the event that any of the above listed trees die or become nonviable within one (1)year of relocation, the replacement tree shall follow the guidelines listed in the Land Development Code for replacement trees. IV. As per the City's certified arborist, Doug Baker, a performance bond must be placed on the relocation of the three (3) Sabal Palm trees and the one (1) Live Oak tree. Pursuant to the Tree Removal Permit— Submittals Section 20-4.5(I)(4)(d) of the City of South Miami Land Development Code, 1. A performance bond to guarantee compliance with all conditions, limitations, and restrictions of the tree removal permit, including, but not limited to, planting of all required replacement trees. 2. The bond shall be equivalent to one hundred fifteen percent (11 S%) of the estimated cost of the permitted activity and may be in the form of a letter of credit, surety, cash, or certificate of deposit. 3. All performance bonds shall remain in force for a minimum of either one (1) year after the actual completion date of the permitted. activity (to ensure that any replanted trees which perish are replaced), or until viability of all replanted trees has been achieved, which ever occurs last. 4. At the discretion of the Planning Director, performance bonds may be partially released in phases based upon partial completion of planting or other permit requirements. The Performance Bond must be made for the amount of.$1,667.50. The Performance Bond calculation for the three(3)Sabal Palm trees are as follows: 1. The estimated price for replacing one(1) Sabal Palm tree is$200.00. 2. The applicant wants to relocate three (3) Sabal Palm trees. Therefore the price for these trees are: $200.00 x 3 =$600.00 3. Pursuant to Section 20-4.5(I)(4)(d)(ii) of the Land Development Code, The bond shall be equivalent to one hundred fifteen percent (115%) of the estimated cost of the permitted activity and may be in the form of a letter of credit, surety, cash, or certificate of deposit. Therefore: $600.00 x 115% =$690.00 4. The Performance Bond for the Live Oak tree must be made for the amount of$690.00. H. The Performance Bond calculation for the Live Oak tree is as follows: 1. The estimated price for replacing one(1)Live Oak tree is$850.00. 2. The applicant wants to relocate one(1)Live Oak tree.Therefore the price for this tree is: $850.00 x 1 =$850.00 3. Pursuant to Section 20-4.5(I)(4)(d)(ii)of the Land Development Code, The bond shall be equivalent to one hundred fifteen percent (115%) of the estimated cost of the permitted activity and may be in the form of a letter of credit, surety, cash, or certificate of deposit. Therefore: $850.00 x 115% _$977.50 4. The Performance Bond for the Live Oak tree must be made for the amount of$977.50.
