RESOLUTION NO.048-25-16340 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA,APPROVING AN APPLICATION TO AMEND THE CONDITION(S)OF RESOLUTION NO.022-24-16127 WHICH APPROVED A FINAL PLAT TO PERMIT DEVELOPMENT OF A TWO-STORY SINGLE-FAMILY HOME ON THE PROPERTY LOCATED AT 6623 SW 77 TERRACE;PROVIDING FOR CONDITIONS; IMPLEMENTATION;CORRECTIONS;SEVERABILITY; AND AN EFFECTIVE DATE. WHEREAS,on March 5,2024,the City of South Miami (the “City”)Commission adopted Resolution No.022-24-1 6127 (the “Final Plat Resolution”)attached hereto as Exhibit “A”which approved a final plat application for the property described in the Final Plat Resolution (the “Property”),to subdivide the Property into three (3)lots in the Low-Density Single Family Residential (RS-3)zoning district,so that each of the three (3)buildable single-family lots could be developed with a new single-family residence pursuant to Section 20-4.2 of the Land Development Code (the “LDC”);and WHEREAS,the Final Plat Resolution imposed several conditions,including Section 3(f), which states:“The easternmost lot of the Property shall be limited to one story,but be permitted a building coverage of 35%of the lot area and impervious coverage of 50%of the lot area”(the “Condition”);and WHEREAS,Jasiel Jimenez,on behalf of Ludlam 3 LLC (the “Applicant”),submitted an application (the “Application”)requesting to delete or amend the Condition to allow the construction of a two-story single-family home on Lot 3,located at 6623 S W 77 Terrace,which is a portion of the Property,and is the easternmost lot of the plat subject to the Condition of the Final Plat Resolution;and WHEREAS,the City Commission desires to approve the Application;and WHEREAS,the City Commission finds that this Resolution is in the best interest and welfare of the City. NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA,AS FOLLOWS: Section 1.Recitals.The above-stated recitals are true and correct and are incorporated herein by this reference. Section 2.Application Approval.The Application submitted by Ludlam 3 LLC to amend Resolution No.022-24-16127 by removing the Condition in its entirety for Lot 3,located at 6623 SW 77 Terrace,is hereby approved. Res.No.048-25-16340 Section 3.Conditions of Approval.The Final Plat Resolution is hereby amended to add the following conditions: a.Except as may be modified herein,the Applicant shall comply with all other conditions outlined in the Final Plat Resolution;and b.Increased landscaping shall be planted or maintained along the eastern and northern boundaries of Lot 3 to better buffer the two-story home from neighboring properties. Section 4.Implementation.The City Manager is authorized to take any and all actions necessary to implement the purposes of this Resolution. Section 5.Corrections.Conforming language or technical scrivener-type corrections may be made by the City Attorney for any conforming amendments to be incorporated into the final resolution for signature. This approval should be subject to the following terms and conditions as well as all applicable City ordinances, codes, rules, and regulations: 1. Except as may be modified herein, compliance with all other conditions outlined in City Resolution #022-24-16127; and 2. Increased landscaping shall be planted or maintained along the eastern and northern boundaries of Lot 3 to better buffer the two-story home from neighboring properties BACKGROUND: On May 5, 2023, an application for Tentative Plat (“T-Plat”) was filed by the previous property owner, Legacy 7709, LLC, to subdivide the vacant parcel located at 7709 SW 67 Avenue into three (3) parcels so that new single-family homes can be built. The parcel sits at the northeast corner of SW 67th Avenue and SW 77th Terrace. The T-Plat was reviewed by the City Commission at their September 5, 2023, meeting where it was approved with conditions via Resolution #106 -23- 16039. After receiving T-Plat approval from the Miami-Dade County Plat Committee, Legacy 7709, LLC submitted a final plat application to the City for review that was approved on March 5, 2024, via Resolution #022-24-16127. As part of the approval, a condition was placed on the application that limited the height of the proposed structure on Lot 3 to one-story. The property was then sold to the current owner, Ludlam 3, LLC, who filed an application requesting that the City Commission amend Resolution #022-24-16127 to remove the height limitation placed on Lot 3. ANALYSIS: Located in the Low Density Single-Family Residential (RS-3) zoning district, the intent of the applicant’s request is to ask that the City Commission allow for the construction of a two -story single-family residence on the property located at 6623 SW 77 Te rrace (“Lot 3”). Pursuant to Section 3(f) of Resolution #022-24-16127: 2 SoutP'Miami THE CITY OF PLEASANT LIVING The easternmost lot of the Property shall be limited to one story, but be permitted a building coverage of 35% of the lot area and impervious coverage of 50% of the lot area The Final Plat application was approved with the condition that the single-family residence on Lot 3 be limited to one-story whereas the structures on the remaining lots (Lot 1 and Lot 2) were permitted to be two-story in height. This condition was originally placed upon the application during the approval of the Tentative Plat application (Resolution #106 -23-16039) for the project and was carried over to the Final Plat application. As part of this review, Staff compared the applicant’s request for a two -story single-family structure against the surrounding area to determine if there would be any impacts and the following is noted: The single-family structures to the north of Lot 3 all have a height of one -story. The single-family structures to the south of L ot 3 all have a height of one-story. The one-story single-family structure immediately to the east of Lot 3 (6621 SW 77 Terrace) has been demolished via Building Permit #BRB25 -0383 that was finaled on May 15, 2025. Upon further inspection, it was found that Building Permit #BRB25 -0382 was issued on April 14, 2025, for the installation of a temporary construction fence on the site. Last, the owner of the property applied to the City’s Design Review B oard (DRB), requesting approval to build a new two -story single-family structure on the site (DRB- 2025-014). The item was scheduled to be reviewed on May 6, 2025, but because the meeting was cancelled because of a lack of quorum, the item was approved purs uant to Section 20 -6.1(C)(4)(c) of the LDC. While Lot 3 is surrounded by existing one -story structures, two-story structures are proposed for the two (2) parcels immediately to the west of Lot 3 and for the parcel immediately to the east of Lot 3. It is important to note that pursuant to Section 20 -3.5(H) of the Land Development Code (“LDC”), two-story single-family structures are permitted by right by the LDC which also permits a maximum height of 25 feet. The applicant has provided a conceptual site plan for lot 3, sheet A0.1, for the City Commission to review that proposes a two-story structure for the lot. Staff reviewed the revised plan against the City’s two-story dimensional requirements for single-family residences found in LDC. Pursuant to Section 20-3.5(H) of the LDC, the cumulative width of both side yards shall be not less than 20 percent (20%) of the total lot width. While the LDC permits two-story single-family structures by right in the RS-3 zoning district, they could be considered to be out of character for this neighborhood which is due to the makeup of the surrounding area being compromised mostly of on e-story structures. However, as the older existing parcels in the area are redeveloped, two-story structures may at some point become more prevalent in the area. Because an impact will be created by the introduction of structures with larger heights, it is recommended that additional landscaping be required to offset any adverse impacts created by the new structure.
