AUTHORIZING THE WAIVER OF CERTAIN EVENT-RELATED
FEES AND COSTS IN AN AMOUNT NOT TO EXCEED $3,066.84
PURSUANT TO SECTION 15B-6 OF THE CITY CODE FOR A
SPECIAL EVENT KNOWN AS THE “TWILIGHT 5K
RUN/WALK”PRESENTED BY TEAM FOOTWORKS
EDUCATIONAL AND FITNESS CORPORATION TO BE HELD
ON SUNDAY,JUNE 1,2025;PROVIDING FOR APPLICABILITY
OF OTHER CODE REQUIREMENTS;PROVIDING FOR
IMPLEMENTATION,CORRECTIONS,AND AN EFFECTIVE
DATE.
WHEREAS,Team FootWorks Educational and Fitness Corporation (the “Applicant”),a Florida
not for profit corporation,has submitted an application to host a Twilight 5K Run/Walk on Sunday,June
1,2025 (the “Event”);and
WHEREAS,the Event application is incomplete and pending review and approval by the City
Manager pursuant to Section 1 5B-6 of the City Code;and
WHEREAS,the Applicant is requesting a waiver of event-related fees and costs in the amount
of $14,938.1 8,however,staff recommends waving only the following fees totaling $3,066.84:

WHEREAS,pursuant to Section 1 5B-6(1 1)of the City Code,the City Commission may waive
event-related fees and costs imposed pursuant to Section 15B-6;and
WHEREAS,pursuant to Resolution 002-25-16294,the City Commission has adopted a Special
Events Fee Waiver Policy which establishes guidelines for evaluating requests for fee waivers;and
WHEREAS,the City Commission desires to approve the waiver of event-related fees and costs
for the Event as set forth herein;and

WHEREAS,the City Commission finds that this Resolution is in the best interest and welfare
of the City.
NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF SOUTH MIAMI,FLORIDA,AS FOLLOWS:
Section 1.Recitals.The above-stated recitals are true and correct and are incorporated
herein by this reference.
Section 2.Waiver of Fee.Pursuant to Section 15B-6(11)of the City Code,the City
Commission hereby waives event-related fees and costs for the Event in an amount not to exceed
$3,066.84,provided and conditioned upon the City Manager approving the application for the Event and
the Applicant’s compliance with all requirements under Section 15B of the City Code.
Section 3.Applicability of All Other Requirements.Except as waived and provided for
herein,all other requirements of the Code remain applicable to the Event,and the City Manager shall
ensure compliance with all Code requirements.
Section 4.Implementation.The City Manager is authorized to take any and all actions
necessary to implement the purposes of this Resolution.
Section 5.Corrections.Conforming language or technical scrivencr-type corrections may
be made by the City Attorney for any conforming amendments to be incorporated into the final resolution
for signature.
Section 6.Effective Date.This Resolution shall become effective immediately upon
adoption.

SUBJECT:Fee waiver request for $3,066.84 -Team FootWorks Educational and Fitness
Corporation Twilight 5K Run/Walk
RECOMMENDATION: This item is submitted for consideration of a fee waiver approval of
$3,066.84 for Team FootWorks Educational and Fitness Corporation to
host its annual Twilight 5K Run/Walk on Sunday, June 1,2025.
BACKGROUND:Team FootWorks Educational and Fitness Corporation (“the applicant”),a
not-for-profit corporation, has submitted a Special Event Application to
host its 27th Annual Twilight 5K Run/Walk on Sunday, June 1, 2025, from
6:00 p.m. to 10:00 p.m. The applicant anticipates approximately 800
participants.
This year’s course has been modified to accommodate the ongoing septic-
to-sewer project and reflects input from both the Public Works and Police
Departments. The route begins and ends on SW 57th Court, providing a
scenic and relatively flat run through tree-lined neighborhood streets.

The applicant is requesting the necessary street closures along the race
route to ensure a safe and enjoyable event for participants and residents.
To support this updated route,the applicant will conduct door-to-door
outreach to inform residents who will be impacted for the first time.
Barricades and police vehicles will be stationed at key intersections to
block traffic during the event. Public sidewalks will remain open and
accessible. Public Works staff will monitor and clean affected areas,
including streets, sidewalks, and gutters.
Following the race, the applicant plans to host a post-race block party in
the United Community Bank of South Miami parking lot. The event will
feature sponsor tents offering food samples, product demos (e.g., running
shoes), and contributions from local restaurants providing complimentary
bites. Family-friendly activities, such as face painting, will also be available.
The block party will conclude by 10:00 p.m.
RACE FEES:
EVENT BUDGET:According to the applicant, the 2024 Twilight Run generated $40,670.72 in
total revenue, which included $13,000 in sponsorships. Although final
figures for the 2025 event are not yet available, the applicant projects
similar revenue levels, again including $13,000 in sponsorships. Based on
this projection, the 2025 Twilight Run is expected to result in a net loss of
approximately $10,160.62. For further details, please see the attached

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SOUTH
MIAMI,FLORIDA,APPROVING AND ADOPTING A SPECIAL EVENTS
FEE WAIVER POLICY TO ADDRESS REQUESTS TO WAIVE SPECIAL
EVENT FEES PURSUANT TO SECTION 15B-6(11)OF THE CITY CODE
OF ORDINANCES;PROVIDING FOR IMPLEMENTATION;
CORRECTIONS;SEVERABILITY;AND AN EFFECTIVE DATE.
WHEREAS,Section 15B-6 of the City of South Miami (the “City”)Code of Ordinances
(the “Code”)provides a procedure for authorization of a special event which includes the
requirement that a person presenting the special event (the “Event-holder”)reimburse the City for
all of the City’s revenue losses and expenditures incurred by the City in the provision of City
services and resources to a special event (the “Special Event Fees”);and
WHEREAS,upon the request of an Event-holder,the City Commission may consider
waiving all or a portion of the Special Event Fees pursuant to Section 15B-6(11)of the Code;and
WHEREAS,a waiver of Special Event Fees does not eliminate the costs of providing
services and resources to the City,rather it shifts the burden of those costs from the Event-holder
to the City’s general fund;and
WHEREAS,the City Commission does not currently rely on a formal policy to govern
consideration of such requests;and
WHEREAS,the City Commission desires to consider and adopt a policy to govern future
requests seeking waiver of all or a portion of Special Event Fees in order to standardize its
evaluation of such requests;and
WHEREAS,a Special Events Fee Waiver Policy,attached hereto as Exhibit “A,”has been
created to establish guidelines to be used to evaluate requests for fee waivers;and
WHEREAS,among other things,the policy provides that the City Commission as a wholecanwaiveupto$25,000 per fiscal year towards Special Event Fees for one or more special events
through sponsoring a resolution pursuant to Section 15B-6(11)of the Code,together with
suggested guidelines for considering fee waiver requests;and
WHEREAS,the proposed Special Events Fee Waiver Policy was presented to the TownCenterAdvisoryBoardanddiscussedonAugust14,2023,and September 6,2023,resulting in noproposedrevisionstothepolicy;and
WHEREAS,the proposed Special Events Fee Waiver Policy was presented and discussedbymembersoftheCityCommissiononSeptember19,2023,resulting in revisions to the policyasdetailedinExhibitA-Special Events Fee Waiver Policy;and
WHEREAS,the City Commission finds that this Resolution is in the best interest andwelfareoftheCity.

CITY OF SOUTH MIAMI,FLORIDA:
Section 1.Recitals Adopted.The above-stated recitals arc true and correct and are
incorporated herein by this reference.
Section 2.Approval and /Vdoption of Special Events Fee Waiver Policy.The City
Commission hereby approves and adopts the Special Events Fee Waiver Policy set forth in Exhibit
“A”attached hereto.
Section 3.Implementation.The City Manager is hereby authorized to take any and
all action necessary to implement the Special Events Fee Waiver Policy and the purposes of this
Resolution.
Section 4.Corrections.Conforming language or technical scrivener-type corrections
may be made by the City Attorney for any conforming amendments to be incorporated into the
final resolution for signature,or to the Special Events Fee Waiver Policy.
Section 5.Severability.If any section,clause,sentence,or phrase of this Resolution
is for any reason held invalid or unconstitutional by a court of competent jurisdiction,the holding
shall not affect the validity of the remaining portions of this Resolution.
Section 6.Effective Date.This Resolution shall become effective immediately upon
adoption.

EXHIBIT A
I.PURPOSE
The purpose of this policy is to establish guidelines to be used to evaluate requests for fee waivers
and to implement a structure and process through which consistent information for fee waiver
requestswill be collected and evaluated.
Eligibility for fee waivers or reductions largely depends on the event sponsor and the nature of
the event.Events that provide public benefits (i.e.,increased business activity,recreation,
community activity,or destination point improvement)to the entire city are best suited for a fee
waiver.Furthermore,the number of special events that are eligible for fee waivers or reductions
will depend on budget and operating impacts and will vary annually.
II.BACKGROUND
Fee waivers are an expense to the City's General Fund.Fees are established to pay for the cost
of a service provided by the City.When a fee waiver is granted,the city bears the cost out of the
general fund.Only the City Commission may grant a fee waiver request.
III.POLICY
The City Commission,may,at its sole discretion,approve or disapprove fee waiver requests per
Sec.15B-6 (11)of the City Code.Per this policy,the City Commission as a whole can waive up to
$25,000 each member of the City Commission is allocated $5,000 per fiscal year t-hat he/she can
apply towards special event fees of one or more special events.The A Commissioner may will
sponsor a Resolution for fee waiver subject to Commission approval.
Fees associated with street closure(s)and maintenance of traffic may be waived,or alternatively,
an Ordinance may be adopted noting that said fees no longer apply to Special Events (they will
apply to construction and right-of-way work related service only).
The City Commission,in its sole discretion,may decide to increase or reduce the annual amount
the City Commission can waive.The City's Parks and Recreation Department will maintain records
and provide fee waiver data to the City Commission as needed.Staff reserves the right to present
an unsponsored fee waiver request to the City Commission.
Fee waivers do not relieve the applicant from payments and obligation for
insurance/indemnification requirements,security deposits (501(c)(3)non-profit organizations
are exempt),other financial obligations associated with events,activity,or other conditions of
approval that may be required.
The following general guidelines will be used to assist in the determination of whether a
requested fee waiver is eligible or ineligible.

•Event,program,or activity for which a community/public good can be
demonstrated that is free of charge and open to the public.
•Event,program,or activity that create revenue generating opportunities for local
businesses.
•Event,program,activity,or improvement is of public benefit to the City of South
Miami and/or surrounding community,or a significant portion of its residents.
•Fundraising activities/events only when a portion of the funds raised will be
directed back to the City or service in an amount equivalent to the waiver.
•Intergovernmental cooperation,where there is a public benefit to a significant
portion of the residents of the City of South Miami and/or the event or temporary
use does not have a significant impact on city services,operations,or activities.
•City sponsored or co-sponsored events,programs,or activities.
•Event,program,or activity held and organized by non-profit organizations,as
defined by the Internal Revenue Service (IRS),having IRS approved tax exempt
status,formed for civic or educational purposes.
VII.INELIGIBLEACTIVITIES THAT ARE STRONGLY DISCOURAGED FOR CONSIDERATION

•Event,program,or activity that requires an admission fee.

of sixty (60)days prior to the event date.Please note that all applications
submitted with less than thirty (30)days prior to a requested event date may not
receive the necessary approvals from the required City Departments and/or City
Commission and may be rejected.
