WHEREAS,the City of South Miami (the “City”)maintains a Schedule of Fees and Fines (the “Fee Schedule”),which the City Commission amends from time to time;and WHEREAS,the City’s well-designed parking program not only generates substantial revenue,but also contributes to the City's overall vitality and functionality;and WHEREAS,on March 18,2025,the City Commission approved an ordinance on First Reading amending Section 15A-18,“Controlled Parking Residential Zones,”of the City Code of Ordinances (the “City”)to establish a single residential permit parking zone and revise permit eligibility and issuance procedures (the “Ordinance”);and WHEREAS,based on the comments made at the March 18,2025,regular City Commission Meeting,the City proposes revising the Fee Schedule;and WHEREAS,the City Commission desires to update the Fee Schedule to incorporate the provisions of the proposed Ordinance,including through the establishment of a monthly parking permit rate for the South Miami Parking Garage and revisions to the annual residential parking permit structure and related fees;and WHEREAS,the City Commission finds that this Resolution is in the best interest and welfare of the City. BACKGROUND:On March 18, 2025, the City of South Miami Mayor and Commission approved, on first reading, an ordinance amending Section 15A-18 – Controlled Parking Residential Zones. The Mayor and Commission will review and potentially adopt the ordinance at its second and final hearing on April 1, 2025. The resolution incorporates specific provisions of the amended code, including establishing a monthly rate for the South Miami Parking Garage Monthly 24-Hour Overnight Permit and the South Miami Parking Garage Monthly Roof Overnight Permit. The amendment also eliminates the very costly Annual Residential Parking Visitor decal and updates language in the Annual Residential Parking Permit regulations and introduces a Permit Processing Fee. ATTACHMENTS: PROPOSED Resolution PROPOSED Ordinance amending Section 15A-18 – Controlled Parking Residential Zones 3 SouthTMiami THE CITY OF PLEASANT LIVING Page 1 of 10 ORDINANCE NO. 2025-1 2 AN ORDINANCE OF THE MAYOR AND CITY 3 COMMISSION OF THE CITY OF SOUTH MIAMI, 4 FLORIDA, AMENDING SECTION 15A-18. “CONTROLLED 5 PARKING RESIDENTIAL ZONES”, OF CHAPTER 15A -6 PARKING, OF THE CITY CODE OF ORDINANCES, TO 7 ESTABLISH A SINGLE RESIDENTIAL PERMIT PARKING 8 ZONE, PERMIT ELIGIBILITY AND ISSUANCE AND 9 PROCEDURES FOR IMPLEMENTATION OF THE 10 PROGRAM; PROVIDING FOR CORRECTIONS, 11 SEVERABILITY, CONFLICTS, IMPLEMENTATION, AND 12 AN EFFECTIVE DATE.1314 WHEREAS, Article VIII, Section 2 of the Florida Constitution, and Chapter 166, Florida 15 Statutes, provides municipalities with the authority to exercise any power for municipal purposes, 16 except where prohibited by law, and to adopt ordinances in furtherance of such authority; and 22 23 WHEREAS,currently, Section 15A-18 “Controlled Parking Residential Zones” of the 24 City Code provides for eight (8) controlled parking residential zones, seven (7) of which are 25 located on streets immediately south of the Town Center, and residents in each of these zones are 26 not permitted to park in another zone; and 27 28 WHEREAS,the City engaged THA to perform the South Miami Parking Study dated 29 September 13, 2024 (the “Parking Study”), which addressed parking demands, future adequacy, 30 parking operations, ordinances and policy review, and parking facility enhancements, and made 31 recommendations to enhance and stream-line parling operations within the City; and 32 33 WHEREAS, the Parking Study recommended that the zones directly south of the Town 34 Center be consolidated into a single zone considering their proximity to one another, and the 35 proposed Code amendments to Section 15A-18 simplify the system by consolidating all zones 36 south of the Town Center into a single unified zone, thereby eliminating the need for residents to 37 park in designated color-coded areas, and allowing residents to park anywhere within the 38 Residential Permit Parking Zone on a first-come, first-served basis; and 39 40 WHEREAS, the chart and map attached to this Ordinance establish the “Residential 41 Permit Parking Zone” to create a more streamlined and uniform paid parking system and optimize 42 the use of public on-street parking and public garage parking by allowing hourly parking during 43 the day while prioritizing residential use in the evening; and 44 45 46 6 Page 2 of 10 47 48 49 WHEREAS,the proposed Ordinance also eliminates visitor passes, designates South 50 Miami Parking Garage as a residential permit parking zone for overnight residents, and 51 contemplates the implementation of a digital permitting system for the purchase and management 52 of residential permit parking spaces; and 53 54 WHEREAS,the proposed schedule of fees, as proposed in the staff memorandum 55 accompanying this Ordinance, will be established by Resolution amending the Schedule of Fees 56 to be presented to the City Commission along with second reading of this ordinance; and 57 58 WHEREAS,the City Commission finds that amending Section 15A-18. of the Code as 59 provided in this Ordinance to eliminate the color zones and designate the Resident Permit Parking 60 Zone is essential for improving parking availability and demand management in residential areas61 and allow for flexible designations, balances the needs of different community members and 62 alleviates conflicts between residential and commercial areas while ensuring equitable parking 63 solutions, enabling the City to address parking shortages more effectively, ensuring that residents 64 have sufficient access to on-street and public garage parking while also considering the impact on 65 local businesses, public spaces, and neighborhood accessibility; and 66 67 WHEREAS,the proposed Ordinance will also authorize the City Manager and/or designee 68 to implement the changes, including a more streamlined and data-driven approach to digital 69 permitting, and authorize the City Manager and/or designee to oversee parking designations,70 parking operations and hours and enforce regulations; Section 15A-18. “Controlled Parking Residential Zones” 89 of Chapter 15A–“Parking”, of the City Code of Ordinances, is hereby amended to read as follows:90 * * * 91 Chapter 15. – Parking 92 Sec. 15A-18. - Controlled parking residential zones. Residential Permit Parking Zone. 93 (a)Definitions. Whenever in this Section the words hereinafter defined are used 94 they shall, unless the context requires otherwise, be deemed to have the following meanings:95 Commuter vehicle means (a) (a) motor vehicle(s) parking in a residential area by a person who 96 is not a resident of the designed controlled parking residential zones.97 Controlled rResidential parking permit means a digital permit property issued and displayed 98 decal issued by the city that authorizes a specific vehicle to park within the Residential Permit 99 Parking Zone without paying regularly applicable hourly parking fees twenty-four (24) hours 100 per day, seven (7) days per week. within a specific controlled residential parking zone for 101 which the permit was issued.102 Controlled rResidential permit parking zone means the controlled residential parking zone 103 established by this Ordinance and/or as amended by the City Manager or designee, for which 104 specified residential and visitor's permits are valid for parking shall be in the designated zone 105 in which the decal permit holder resides,, and where non-resident vehicles may be excluded 106 during designated hours to be set by the City Manager, as necessary.107 Resident means a person who owns or leases real property within a controlled the parking 108 residential permit parking zone and who maintains bona fide occupancy and residency at that 109 address.110 Visitor parking permit means a properly issued and displayed parking permit that authorizes a 111 commuter vehicle to park within a specific controlled residential parking zone for which the 112 permit was issued.113 (b) Signage for and marking of controlled residential permit parking residential zones. 114 The director of the traffic engineering department, through his/her authorized representative in 115 the police department, City Manager and/or designee is hereby authorized to identify and 116 designate "controlled “the residential permit parking residential zone" in accordance with this 117 chapter section. Appropriate signs and color markings shall may be utilized at the discretion of 118 the City Manager and/or designee to identify and designate the residential permit parking zone 119 those areas where on-street parking and public garage parking of vehicles may be restricted at 120 specific times during the day; and shall provide on-street and public garage parking for vehicles 121 bearing a valid residential parking decal and/or a valid visitor parking decal permit issued 122 pursuant to the terms of this chapter section. All other vehicles shall be precluded from on-street 123 8 Page 4 of 10 parking within a designated controlled parking residential zone. The authority to establish these 124 regulations shall be in addition to any other authority of the city to regulate motor vehicle parking 125 on public streets.126 (c) Eligibility for controlled residential permit parking zone residential permits.127 (1) Eligibility. Controlled Residential permit parking residential zone permits may be 128 issued only to persons who reside within the residential permit parking permit zone for 129 which the permit is issued; who own and/or have legal control of a motor vehicle; and 130 for those motor vehicles owned by or under the legal control of the resident. For the 131 purposes of this chapter section, "residence" shall be defined as the street address of the 132 structure in which the applicant resides as determined by the U.S. Postal Service. All 133 other vehicles shall be precluded from on-street parking within a designated controlled 134 parking residential zone.135 (2) The proof of residence. Proof of residence shall be established by:136 a. Display of a valid driver's license reflecting a current address within the residential 137 permit parking zone for which the permit is issued; or138 b. Display of a deed or current lease, current rental agreement or utility bill, bank 139 statement, credit card statement or other acceptable document showing residency within 140 the residential permit parking zone for which the permit is issued.141 c. Ownership of motor vehicle. Proof of ownership and/or control of a motor vehicle 142 may be established by possession of a valid registration in the applicant's name, or by 143 display of a valid registration accompanied by proof that the applicant has legal use and 144 control of the vehicle.145 (d) Application for permits.146 (1) Authorization of the finance department. The Finance Department is hereby 147 authorized to issue digital permits to qualified residents who reside in a controlled the 148 residential permit parking zone and who own or have control of a motor vehicle.149 (2) Application form. Application shall be made on forms or digital platforms provided 150 by the City Clerk Manager which shall include:151 a. The name, address, telephone number and license number of the applicant.152 b. Make, model, color and year of the registration of the vehicle for which the permit is 153 sought.154 c. The type of document used to establish eligibility for the license plate number (and 155 state) of vehicle,156 9 Page 5 of 10 d. A statement immediately above where the applicant is to sign stating that the applicant 157 has been provided with an opportunity to examine this chapter section and is familiar 158 with the terms thereof..159 All applications shall be signed by the applicant under penalty of perjury in accordance with 160 Florida Statutes, Section 92.525.161 (e) Fees. All fees associated with the Residential Permit Parking Zone, including but not 162 limited to, permit fees, processing fees, and parking rates, shall be established within the 163 Schedule of Fees, which shall be adopted and amended by resolution of the City Commission.164 (1) The annual fee for the residential permit shall be twenty dollars ($20.00).165 (2) Fees and any outstanding penalties levied under this chapter section shall be 166 collected prior to issuance of the permit. A copy of all permits issued shall be 167 promptly sent to the city department responsible for enforcement.168 (f) Controlled Establishment of Establishment of Residential Permit Parking Zone. The 169 controlled residential permit parking zone is hereby established, which shall include on-street170 parking, public off-street parking and public garage parking within the South Miami Garage, as 171 shown on the map attached to this Ordinance and on file with the City Clerk. The zone(s) may 172 be amended, expanded or reduced administratively by the City Manager, as deemed necessary 173 to address parking demands and enhance the overall good and welfare of the City and its 174 residents, provided notice is provided to the public, permit holders, and the City Commission, 175 and the amended map or zone is filed with the City Clerk, Any amendments, expansions, or176 reductions of the Residential Permit Parking Zone shall be subject to periodic review to ensure 177 continued effectiveness and alignment with the City’s transportation and urban planning goals. 178 The established hours for residents shall be established by the City Manager and/or designee. 179 The establishment of such zones shall be based on factors including, but not limited to:180 1. Parking availability and demand in residential areas.181 2. Impact on local businesses, public spaces, and neighborhood accessibility.182 3. Traffic flow, public safety, and enforcement feasibility.183 4. Feedback and recommendations from affected residents, property managers, and 184 relevant stakeholders.185 Red Zone: 5770-5786 S.W. 74th Terrace. Located on the South Side of 74th Terrace from 58th 190 Avenue to the end of the property line.191 Green Zone: 5801 S.W. 74th Terrace. Located on North side of 74th Terrace from 58th 192 Avenue to the beginning of Mayan North's Parking lot.193 Orange Zone: 7500 S.W. 59th Avenue. Located from beginning of Shari Gardens Parking lot to 194 the end of the parking lot; and 7430 S.W. 59th Court and 7540 S.W. 59th Court. Beginning on 195 59th Court, both sides of street ending on 59th Court at the end of the parking lots of Brittany 196 Villa Apartments and Villa Fontana Apartments.197 Purple Zone: Lee Park Condominium, located on the south side of 70th Street between 61st 198 and 62nd Avenue.199 Black Zone: 7541 S.W. 61st Avenue, on the east side comer of 61st Avenue.200 Pink Zone: 7400—7500 S.W. 59th Place, on the east side corner of 59th Place, and Sunset 201 Square 5950 S.W. 74th Street, on the east side corner of 59th Place.202 (g) Residential parking permit description. The permit shall contain the following 203 information.204 (1) The make, model, color, year, license plate number and registration of the vehicle; 205 and 206 (2) The controlled parking zone for which it is issued; and (3) The expiration date of 207 the permit.208 (h) Visitor's permits.209 (1) The city finance department is hereby authorized to issue visitor's permits which 210 shall be valid for a period of up to one (1) year. The finance department may issue one 211 (1) visitor's permit per residential address.212 (2) The annual fee for visitor permits shall be forty dollars ($40.00). Any outstanding 213 penalty levied under this chapter must be paid prior to the issuance of a visitor's permit.214 (3) The visitor permit shall only be issued to an individual who establishes residency.215 (Ig) Use and validity of permits.216 (1) Digital Permit. Display. All Residential Parking Permits shall be issued and managed 217 through a digital permitting system established by the City Manager and/or designee. 218 Permits shall be displayed in the lower left hand inside comer of the vehicle's front 219 window.220 11 Page 7 of 10 (2) Validity. Residential permits shall be valid only for the vehicle for which they are 221 issued, only in the zone designated and only so long as the permit holder retains the 222 vehicle and resides at the address specified in his or her application.223 (3) Expiration. Permits shall expire one (1) year from the date of issue, so long as the 224 permit holder retains the permit vehicle and resides at the address specified in his/her 225 permit application.226 (4) The City Manager and/or designee may impose reasonable regulations and restricted 227 non-resident parking hours, and/or permit conditions to ensure effective management and 228 equitable access to parking spaces within the Residential Permit Parking Zone.229 (jh) Unlawful acts. It shall be unlawful for any person to do any of the following:230 (1)To make any false or misleading statements in application for a permit;231 (2)To transfer the permit to another person or vehicle;232 (3)To fraudulently alter a permit in any respect whatsoever;233 (4)To improperly display use the permit or visitor's permit or to violate any terms 234 or conditions under which the permit or visitor's permit was issued;235 (5) Use or place the permit or any other vehicle than that for which the permit is 236 issued;237 (65)To use or permit to be used a revoked or suspended permit; or238 (76)Sell or transfer a visitor's permit to a third party.239 (ki) Revocation of permit. If the city finds that a permit should be revoked for any of 240 the reasons set forth in this chapter section, a written notice shall be sent by U.S. mail, or via 241 email or text message registered with the City to the permit holder at the address contained on 242 the application. The notice shall contain the following information:243 (1) Advise the permit holder that the permit will be revoked on a specified date 244 which shall be not fewer than ten (10) days from the date of the letter;245 (2) Advise the permit holder that unless a written notice of appeal setting forth the 246 reasons for the appeal is filed with the city clerk no later than the date set forth 247 in subsection (1) of this section, the permit will be deemed revoked;248 (3)Advise the permit holder that if a written notice of appeal is filed within the 249 required time, the date, time and place of the hearing will be set; and250 (4)The reasons for the revocation.251 12 Page 8 of 10 (lj)Parking Citation Fees. Schedule of fines. Parking citation fees shall be pursuant 252 to Miami-Dade County uniform fee schedules. Fines shall not exceed two hundred fifty dollars 253 ($250.00) per day for a first violation of this chapter and shall not exceed five hundred dollars 254 ($500.00) per day for a repeat violation. Illegally parked vehicles shall be fined in the manner 255 presently provided in the city for illegal parking and their vehicles may be towed and stored at 256 their expenses.257 (m)Appeal. Upon receipt of the appeal, the city code enforcement section shall set a 258 date for hearing before the city's special master within thirty (30) days of receipt of the notice 259 of appeal and notify the appellant of the date, time and place of hearing. The special master 260 may affirm or reverse the revocation decision or order suspension for a specified period.261 (n)Eligibility and criteria for establishing controlled parking residential zones is 262 hereby set forth:263 (1)A residentially zoned area shall be deemed eligible for designation as a controlled 264 parking residential zone for residential permit parking if, parking therein is 265 impacted by commuter vehicles at any time.266 (2)In determining whether an area identified as impacted and eligible for residential 267 permit parking shall be designated as a controlled parking residential zone, the 268 following factors shall be considered.269 a.The possibility of a reduction in total vehicle miles driven in the city.270 b.The likelihood of alleviating traffic congestion, illegal parking and 271 related health and safety hazards.272 c.The desire and need of the residents for controlled residential permit 273 parking.274 (o)Procedures for establishing controlled residential parking zones.275 (1)In order to determine whether a particular area should be designated as a 276 controlled parking residential zone, the city commission can request, or the 277 parking board may conduct, upon its own initiative or upon a petition of a majority 278 of the households on a proposed residential zone addressed to the city manager, a 279 study to determine if the proposed area meets the criteria set forth above. 280 Following the study, the parking board, shall determine whether to recommend to 281 the city commission that the proposed area under consideration be designated as 282 a controlled parking residential zone or to remove the designation in the case of a 283 previously established controlled parking residential area zone. The city 284 commission may also designate an area as a controlled parking residential zone 285 based upon a study previously conducted, if the criteria set forth above are met.286 13 Page 9 of 10 (2)When the city commission finds that the criteria to designate have been met in a 287 controlled parking residential zone, the city manager shall have parking signs 288 erected upon public streets in the area, indicating the times, locations and 289 conditions upon which parking shall be by controlled residential parking permit 290 only. When an area has been approved, designated and posted as a controlled 291 parking residential zone, it shall be unlawful and a violation of this chapter to 292 park a commuter vehicle in an area restricted to decal parking only without having 293 a visitor permit or valid residential parking permit affixed.294 295 296 Section 3.Corrections. Conforming language or technical scrivener-type corrections 297 may be made by the City Attorney for any conforming amendments to be incorporated into the 298 final Ordinance for signature.299 300 Section 4.Severability. If any section, clause, sentence, or phrase of this Ordinance 301 is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding 302 shall not affect the validity of the remaining portions of this Ordinance.303 304 Section 5.Conflicts. That all ordinances or parts of ordinances, resolutions or parts 305 of resolutions, in conflict herewith, are repealed to the extent of such conflict.306 307 Section 6.Implementation. The City Manager is hereby authorized to take any and 308 all necessary action to implement the purposes of this Ordinance. 309 310 Section 7.Effective Date.
