The MO zoning district permits many different office uses including medical. In July of 1995 the South Miami City Commission approved a parking reduction for this building. This reduction allows 17,014 gross square feet of this building to be occupied by medical uses. Following the parking reduction a top floor addition was presented to the South Miami Building and Zoning Department. This addition passed through zoning review with out having to go before the Environmental Review and Preservation Board because the addition did not have any street side facade changes. Commissioner Carver noted that no matter how it is calculated , there should be a different amount of parking required for areas in use and areas that are just used for storage . The applicant feels that the 20% increase being requested is reasonable in view of the fact that the new Metro-Rail parking garage is less than one block away. Public Hearing opened. In answer to a question from Mr. Gutierrez, Mr. Mackey stated that the required number of handicap parking spaces is included in this request. Lots 6 & 7 , Block 3 , Rosswood Subdivision Plat Book 13 , Page 62 of the records of Dade County Dear Sir: We are requesting a change in parking requirements for the above referenced property that would change the building from partial medical use to full medical use. The current use is for: 4049 sq.ft. - medical 9293 sq.ft. - non-medical This existing use requires 52 parking spaces as per the old C-2 zoning under which this building was permitted. The new MO zoning is more restrictive and will require one parking space per 200 square feet of gross area, which would require us to have 67 parking spaces in order to become a full medical building. Because of our close proximity to the South Miami Metro Rail station, we would like to have a special exemption granted that would allow us to have a full medical building. Notice we are only asking for a 29% reduction where the zoning ordinances allow 50%. The reason for this request is the strong demand in office space we are getting from the medical community. We presently have leased the top floor to Dr. Paul Canali, who is currently operating here in South Miami, and have other doctors who are interested in leasing the rest of the building, but the parking situation is a major obstruction. We have installed handicapped ramps from the sidewalk and have provided three handicapped parking spaces where only two are required. Also, the new garage being built at the Metro Rail Station is less than 200 feet from the property. Any reduction obtained in this application will be more than compensated by the parking conditions in the area. Dear Mayor McCann: Please accept this letter as our follow-up to the City Commission meeting of March 17 , 1992 concerning the Application filed by South Miami Professional Building, Inc . to reduce the number of required off-street parking spaces at- 5996 S.W. 70th Street, South Miami, Florida. At the last City Commission meeting, it appeared that the Commission was willing to consider a reduction in parking of approximately 12 percent or 8 parking spaces based upon the full occupancy of the building by medical office uses . A reduction in 8 parking spaces added to the 52 parking spaces provided on site would provide the equivalent of 60 parking spaces and allow the occupancy of up to 12,000 square feet of medical office space. After meeting with City staff and the City attorney, we have determined that the most logical way to approach occupancy of this building is to view it as a medical office building but to modify the building in such a way that medical offices will not occupy more than 12 ,000 gross square feet within the building. This can be accomplished in any number of ways through construction of partitions with no doorway or other access through them and through the expansion of public spaces to encompass larger areas thereby excluding tenants from occupying additional space. We have prepared a set of floor plans showing a combination of expanded lobby areas and non-access build out spaces on the tenant floors of the building. A copy of these plans are attached to this letter for illustrative purposes . Assuming that the Commission is willing to grant the reduction of 8 parking spaces , we are prepared to either build out the building as shown on these plans or to work with the City to develop an alternate set of plans to accomplish the same reduction in space. Likewise, in order to put future tenants and owners on notice of these restrictions, we are prepared to record the resolution approving the special use permit in the public records of Dade County at our expense if the City feels that that would be advisable. Finally, based upon our discussions with Sonia Lama, I should point out that there are two alternate ways to calculate the percentage reduction in parking. Our feeling is that it is appropriate to view the entire building as being occupied by medical uses , thereby requiring 67 parking spaces . Under that circumstance, a reduction of 12 percent reduces the required parking by 8 parking spaces . On the hand, since we have agreed to reduce the area of the building occupied by medical uses to no more than 12 , 000 square feet, then building can be viewed as only requiring 60 parking spaces . In order to reach the 8 parking space reduction that the floor plans are predicated upon, it would require a 13 . 33 percent reduction in parking. We believe that the 13 . 33 percent difference in the reduction in parking is not significant and we are hopeful that the Commission will grant a reduction of 8 parking spaces thereby no more than 12 , 000 square feet within this building. First let me address the question of the calculation of the reduction in parking. Based on our discussions with the City Administration and you, we have determined that the most appro- priate approach to the reduction in parking and use of space within this building will be to make the entire building a medi- cal office building. As shown in the calculations prepared by the City staff as originally permitted, the building contains 13,342 gross square feet of building space. Applying the current zoning code requirement of one parking space for every 200 gross square feet of medical office space, the building would require 67 parking spaces. As indicated in the letter from Jack Rice, it is expected that 12% of the building users will utilize mass transit and thereby do not require parking on site. Applying that 12% transit usage rate to the number of required parking spaces (67 spaces) results in a reduction of 8.04 parking spaces. With the reduction of 8 parking spaces and the 52 parking spaces provided on site, the building will have the equivalent of 60 parking spaces. March 30, 1992 Page Two We therefore have developed a set of floor plans to limit occupancy by medical tenants to no more than 12,000 square feet which represents a reduction at 1,342 square feet. This reduction has been achieved in a number of ways . First, in the basement and first level lobby area, we have eliminated enclosing walls around the entry lobby areas . Under the zoning code, this will reduce the gross square footage of the building by 299 square feet. Second, on the second level which is expected to be occupied by a single tenant, we have developed a set of plans which will eliminate occupancy by medical offices of an addi- tional 441.5 square feet. This has been accomplished by substan- tially increasing the elevator lobby area, which has been carved out of what was originally intended to be tenant space and by framing out one small area so that it likewise cannot be occu- pied. On the third floor we will make the same modifications as on the second floor and in addition, since it is anticipated that the third floor will have multiple tenants, we will create a central common hallway that is 6 feet 6 inches wide as opposed to the 4 foot wide corridor required by the code. This . represents a further reduction of 440 square feet. Finally, on the fourth floor we will once again -build out a large elevator lobby eliminating another 167 square feet .from the tenant occupied space. With these reductions which total 1,347.5 square feet, we will have modified the building in such a way that tenant occupancy will never exceed the 12,000 square feet permitted by a 12% reduction in the parking requirements . It is my suggestion, assuming that the City Commission approves a 12% reduction, that the resolution be modified to include a condition limiting the building to no more than 12,000 square feet of medical office space and further requiring that the building be modified to incorporate the changes shown on the modified floor plans. These floor plans could then be incorpo- rated by reference in the resolution so that all parties will clearly understand what has been approved.
