WHEREAS,on November 16,2022,the Planning Board unanimously recommended approval of the Somi Sixty-First (Marshall Williamson)Final Plat application as presented with the recommendation that the City Commission consider the City-owned parcel as a passive park, located south of SW 64th Terrace and between SW 60*Avenue and 61st Court/aka SW 61st Drive Court (“Williamson Property”);and WHEREAS,on December 20,2022,the City Commission unanimously adopted the Final Plat application by Resolution #178-22-15931;and WHEREAS,the City Commission desires for the east 80 feet (measured from the post¬ dedication property line;equivalent in depth to 6518 S.W.60th Avenue)of the Williamson Property at the southwest comer of the intersebtion of S.W.64th Terrace and 60th Avenue to be reserved as a passive park (the “Park Parcel”)with the remainder of the Williamson Property to be used for development of affordable and/or workforce housing,or other public purposes;and WHEREAS,the City Commission desires to name the park to be established on the Park Parcel in honor of and after Dr.Anna Price and host an event in the near future to honor Dr.Anna Price;and WHEREAS,Dr.Anna Price has served as a Commissioner and Mayor for the City of South Miami,and her current and past community activities and involvement stretches over 20 agencies/organizations such as Delta Sigma Theta Sorority Inc.,member of the Concerned Citizens and Clergy and Marshall Williamson Scholarship Committee to Women’s Commission of Miami-Dade County,Planned Parenthood,YWCA,Orange Bowl Foundation,and Dade County Commission Youth Crime Task Force;and WHEREAS,Dr.Anna Price has multiple patents and publications and has received several different awards,most recently including “Seniors Who Serve”,Miami-Dade Commission,2022 and ‘Woman of Distinction”,Women’s History Coalition of Miami-Dade County,2018;and WHEREAS,Dr.Anna Price has worked tirelessly as an educator and mentor,inspired so many people,and is much loved in the South Miami community and beyond;and WHEREAS,Section 17-10.1 “Guidelines for Naming City Property and Roadways” allows for the waiver of the requirement for the naming of public property that the person beinghonoredisdonesoposthumously,by a 4/5 vote of the City Commission after a background checkhasbeenconductedandmadeapartofthebackupinformationforthisresolution;and Page 1 of 2 Res.No.010-25-16302 WHEREAS,the City Commission desires to honor Dr.Anna Price and name the park to be established on the Park Parcel after Dr.Anna Price,and finds the use of the property as a passive park to be in the best interests of the City. NOW THEREFORE,BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Section 1.Recitals Adopted.The above-stated recitals are true and correct and are incorporated herein by this reference. Section 2.Approving the Naming of the Park Parcel in Honor of Dr.Anna Price. The City Commission hereby approves the naming of the Park Parcel in honor of and after Dr. Anna Price,and waives the requirement of Section 17-10.1 that such be done posthumously. Section 3 Implementation.The City Manager is hereby authorized to take any and all action necessary to implement the purposes of this Resolution,including the designation of the Park Parcel as a passive park and the naming of the park to be established at the Park Parcel in honor of and after Dr.Anna Price. Section 4.Corrections.Conforming language or technical scrivener-type corrections may be made by the City Attorney for any conforming amendments to be incorporated into the final resolution for signature. Section 5.Severability.If any section,clause,sentence,or phrase of this Resolution is for any reason held invalid or unconstitutional by a court of competent jurisdiction,the holding shall not affect the validity of the remaining portions of this Resolution. BACKGROUND: In 1975, the subject parcels along SW 61st Court were created during a previous platting process that conveyed the property subject to a restriction that it is not used as a building site. In an effort to resolve this issue, the City initiated the process of removing this restriction through a replatting application which would have also include an application to record a Unity of Title that would join the properties. On July 1, 2022, the project completed the first phase of the process and was granted Tentative Plat (T-Plat) approval from Miami-Dade County with conditions. Prior to that approval, the City Commission reviewed and approved the T-Plat request on January 4, 2022, via Resolution #006-22-15759. To complete the process, the project must receive Final Plat approval from Miami-Dade County. Once completed, the lots will have a combined, total area of 41,554 square feet (0.954 acres +/-). Currently, there are no plans to develop the property. Approval of any future plans to develop the site, whether by the City or a new owner, will follow the appropriate procedures. REQUEST: The City of South Miami, the applicant, is requesting Final Plat approval to replat the parcels of land that are located between SW 60th Avenue, SW 64th Terrace, and SW 61st Court which is in the City’s Two-Family/Townhouse Residential (RT-9) zoning district. The subject parcels are shown in the location map below. Each guideline is described below along with Staff’s analysis of how the application satisfies them. 1.Section 20-4.2(B)(2)(a)(i): The building site created by the proposed tentative plat should be equal to or larger than the median of the existing building sites in the Surrounding area…surrounding area is defined as all lots within the same zoning district and within five hundred (500) feet from the exterior boundaries of the subject property. Staff Response:Not applicable as there are no other properties with the RT-9 zoning designation that are within 500 feet. 2.Section 20-4.2(B)(2)(b):The building site created by the proposed waiver of plat, tentative or final plat, will not result in existing structures becoming nonconforming as they relate to setbacks, lot area, lot width and depth, ground coverage and other applicable regulations of the City's Land Development Code and/or City's Code of Ordinances, except as permitted by this ordinance. Compliance with this provision may occur by demolition or relocation of existing structures. An example of an adverse impact includes visual impacts arising from a proposed two-story structure in an area built out with single- story homes; mitigation could include adding a condition to the approval of the waiver of plat, tentative plat, or final plat, for landscape buffers, or adjusting second-story setbacks or building facades to reduce the visual impact. Staff Response: Not applicable as new construction is not proposed at this time. It is important to note that any future construction will be required to be reviewed and approved by the Environmental Review and Preservation Board prior to a building permit being issued. 6.Section 20-4.2(B)(2)(f):The building site(s), lot(s) or parcel(s) of land that would be created are divided in such a manner that they are in compliance with the regulations of the City's Land Development Code. Applicant: The City of South Miami, represented by Aurelio Carmenates, PE (Capital Improvement Program Project Manager) Mr. Lightfoot read PB‐22-015 into the record and then presented the staff report for the item to the Board. Mr. Miller asked if this item was a second review of the item that the Board reviewed in 2021, to which Mr. Lightfoot stated yes. Mr. Miller then asked if anything has changed since it was last reviewed, to which Mr. Lightfoot stated no. Mr. Miller asked staff how S. Dixie Highway received a Level of Service (LOS) of “D” rating. Mr. Lightfoot responded that because he wasn’t a transportation expert, he could not answer the question. Mr. Jacobs asked if this parcel was the only property in the area that was zoned RT-9, to which Mr. Lightfoot stated yes. Mr. Jacobs then asked how it was able to be the only RT-9 district in the area, to which Mr. Lightfoot stated that he was unable to answer the question. Mrs. Readon then provided the Board with a brief history on the subject property. Mr. Jacobs asked questions regarding the building restriction on Parcel K. Mr. Lightfoot responded that the reason for the plat is to remove the building restriction that was placed on Parcel K. Mr. Miller asked if the purpose of this item is to combine the properties and to remove the restriction. This property isn’t being subdivided. Mr. Lightfoot stated that he was correct. Mr. Miller then asked if there was any intent to build on the parcel, to which Mr. Lightfoot stated no. There is no intent to build. Depending on what is proposed in the future, if any, may not come before the Planning Board. At the least, any future development will need to be reviewed by the Environmental Review & Preservation Board. Mr. Miller asked what uses would be permitted by right on the subject property. Mr. Lightfoot then read the uses listed as “Permitted by Right” in the City’s Permitted Use Schedule, Section 20- 3.3(D) of the Land Development Code (LDC) into the record. Mr. Jacobs asked if the City was considering using the property as park, to which Mr. Lightfoot responded that he was not aware of what the City’s intent for the parcel was. Mr. Jacobs then 4149 3 asked how the City decides where to put parks, to which Mr. Lightfoot responded that the City Commission decides on where parks should be placed with the aid of a park master plan that is prepared by the City’s Parks & Recreation Director. Mr. Basu asked if the City was going through the plat process to combine three (3) parcels of land into one (1) parcel, to which Mr. Lightfoot responded yes. Mr. Basu then asked if someone would need to go through the subdivision process if they were to buy the property in the future and wanted to divide it up. Mr. Lightfoot confirmed that they would need to go through the subdivision process. Mr. Lightfoot then added that if the lot were subdivided, it would need to comply with the dimensional requirements for the RT-9 zoning district. Mr. Basu then asked why the restriction was put into place and who placed it. Mr. Pepe responded that he believes that it was tied to the J.R.E. Lee school. Mr. Pepe then added that Miami-Dade County has already approved the tentative plat application which led him to believe that Miami-Dade Public Schools was fine with the replat as well. Mr. Jacobs stated that he would like to see the property designated as a park. The Chairperson opened the floor to public comments on both PB‐22-015. • Mr. Lightfoot read an email of objection into the record from Ms. Lashawnda Williams. The email was sent to the Planning Board members on November 16, 2022. • Antoinette B. Fischer – Ms. Fischer stated her objections with the project. She also stated that the property should be used as a passive park for everyone in the community to enjoy. The Chairperson closed the floor to public comments on both PB‐22-015. The Chair opened the floor to Board discussion. Mr. Miller stated that the item was a request for second review of the plat. The item does not approve any redevelopment of the site. By combining the property, it makes a more compelling case for designating it as park space. Mr. Jacobs stated that because of the TRA Policy 1.1.1, the City is in the transportation concurrency exemption area which implies that the City doesn’t have the ability to manage LOS in the City. He then stated that it wasn’t true, especially with the subject property. The City owns it and can choose whether to build on it or not. Because all of the roads are a LOS F, the City should be careful how the property is developed. Mrs. Readon stated that the area is a historic area, and that the property should stay the way that it is as an undeveloped property. Motion: Mr. Basu moved to approve PB-22-015 as presented with the recommendation that the City Commission consider the site as a passive park.
