Ord No 24-24-2509ORDINANCE NO. 24-24-2509 AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE C ITY OF SOUTH MIAMI, FLORIDA, COMPREHENSIVELY AMENDING ARTICLE III, "NOISE," OF CHAPTE R 15 , "OFFENSES AND MISCELLANEOUS PROVISIONS," OF THE CITY CODE OF ORDINANCES TO REVISE THE NOISE R EGULATIONS WITHIN THE CITY; REPEALING OUTDATED PROVISIONS IN SECTIONS 15-83 THROUGH 15-92, SECTION 15-94, SECTION 15-95, AND SECTIONS 15- 97 THROUGH 15-99; AND DELETING SECTION 15-100, "GRAFFITI AND GRAFFITI REMOVAL AR EAS" FROM A RTICLE III "NOISE" AND AMENDING ARTICLE I "IN GENERA.L" TO RELOCATE THE PROVISION AS SECTION 15-2; PROVIDING FOR CORRECTIONS; SEVERABILITY; CONFLICTS; IMPLEMENTATION; AND AN EFFECTIVE DATE. WHEREAS, Article VIII , Sect ion 2 of the Florida Co nstitution , and C hapte r 166 , Florida Statutes, provides muni cipa liti es with the author ity to exercise any power for municipal purpo ses , except where prohibited by law, and to adopt o rdinan ce s in furtherance of s uch auth or it y; and WHEREAS, th e Ci ty Com mi ssion of th e City of So uth Miami ("C it y") finds it periodically necessary to ame nd it s Code of O rdin ance s ("Code") to update regulation s and procedures to maintain consi stency w ith state law , impl ement muni cip a l goa ls and o bj ect ive s, clarifY regulations , and addres s s pecific iss ues a nd need s that may ari s e ; and WHEREAS, Article III "N o ise," of Chapter. 15 , of the Ci ty 'S Code addresses noise regul ations w ithin the C ity , includin g the int ens ity of no ise and all owab le hour s; and WHEREAS, o n Jun e 16, 2024 , the C ity Comm is sion discu ss ed upd ates to Art icl e III "Noise", includin g exempting or limitin g th e app li catio n of th e no ise rest ri cti o ns w ithin the Town Ce nter and Dow nto wn SoMi district and esta bli s hin g maximum decibel leve ls for so und and noise and to aid enforce me nt ; and WHEREAS, the C ity Commiss ion w ishes to comprehensively amend A rticl e III "Noise", of Chapte r IS , of th e C it y Code to revi se and updat e noi se regulations , including enforce ment procedures and penalties, and to repea l o utd ated provis ions; and WHEREAS, Section 15-100 , "Graffi ti a nd Graffit i Re mova l," is being deleted from Article III "No ise" and re loca ted to Article I "In Ge nera l" as Sect io n 15-2 ; and WHEREAS, the C it y Co mmi ss ion co nsid ered the ordin a nc e o n Oc tober I , 2024 , and approved th e ordinance o n first reading; and Ord. No. 24-24-2509 WHEREAS, October 15, 2024, the City Commission conducted a duly noticed public hearing as required by law and approved the ordinance on second reading; and NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, AS FOLLOWS: Section 1. Recitals. The above-stated recitals are true and correct and are incorporated herein by this reference. . Section 2. Amending Article III "Noise" of Chapter 15, "Offenses and MisceUaneous Provisions" of the City Code. Article III "Noise," of Chapter 15, "Offenses and Miscellaneous Provisions," of the City Code of Ordinances, is hereby amended to read as set forth in Exhibit "A" attached hereto. Existing Sections 15-83 through 15-92, Section 15-94, Section 15- 95, and Sections 15-97 through 15-99 are hereby repealed as set forth in Exhibit "A" attached hereto. Section 3. Amending Article I "In General," of Chapter 15 "Offenses and MisceUaneous Provisions," of the City Code to Relocate Section 15-2. Section 15-100, "Graffiti and Graffiti Removal," is being deleted from Article III ''Noise'' of Chapter 15, "Offenses and Miscellaneous Provisions," of the City Code of Ordinances, and relocated to Article I "In General" as Section 15-2, as set forth in Exhibit "B" attached hereto. Section 4. Corrections. Conforming language or technical scrivener-type corrections may be made by the City Attorney for any conforming amendments to be incorporated into the final Ordinance for signature. Section 5. Severability. If any section, clause, sentence, or phrase of this Ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this Ordinance. Section 6. Conflicts. That all ordinances or parts of ordinances, resolutions or parts of resolutions, in conflict herewith, are repealed to the extent of such conflict. Section 7. Implementation. That the City Manager and City Attorney are authorized to take any and all actions necessary to implement this Ordinance. Section 8. adoption. Effective Date. For purposes of this definition, the term "mixed-use property" means more than one type of use in a building or set of buildings with some combination of residential and nonresidential use, and the term "multifamily building" means any building occupied or intended to be occupied by more than two families, living separately and with separate kitchens or facilities for cooking on the premises (which includes apartments, condominiums and coach homes, but does not include hotels, motels, bed and breakfasts, townhouses, or cluster dwellings). Sound level means the weighted sound pressure level obtained by the use of a sound level meter and frequency-weighting network, such as A, as specified in the latest revision of the ANSI Standard S 1.4, "Specification for Sound Level Meters. " Sound level meter means an instrument that measures sound and conforms to ANSI S 1.4- 1983 or its successor publications. Violator means any person that has committed or is alleged to have committed a Code violation or is legally responsible for a Code violation including, but not limited to, a property owner or his or her agent, tenant, or entity on the premises, or any combination thereof. Sec. 15-80. Same-Near schools. It shall be unlawful for any person, by himself or by the operation of any instrument, agency or vehicle, to make any unnecessary or unseemly noises that are clearly audible within one hundred (100) feet of any portion of the grounds and premises on which is located any school during school hours. The city manager shall place as many signs as he may deem proper within or near zones hereby created, calling attention to the prohibition against unnecessary noises within such zones. The following tVJ?es of noise are hereby made exemnt from the Rrovisions of this Section: I. In the case of a snecial event. exhibition, exposition and/or festival, not exceeding five (S) days, Rermitted by the city manager, the snecial event nermit may nrovide for a time Reriod in excess of the limitations set forth in this article, but not to exceed midnight on Friday, Saturday and holidays and not to exceed 9:30 R.m. on Sunday through Thursday. Sec. 15-82.1. Excessive noise or music from motor vehicles. (a) It shall be unlawful for any person owning, operating or occupying any motor vehicle as defined in F.S. § 316.003(21), in the city at any time to cause or suffer or allow any loud, unnecessary, excessive or unusual noises in the operation of the motor vehicle where the noise is plainly audible at a distance of one hundred (100) feet from the motor vehicle. The provisions of this section shall exclude any motor vehicle which has not been modified for the purpose of emitting loud noises. (b) It shall be unlawful for any person owning, operating or occupying any motor vehicle as defined in F .s. § 316.003(21), in the city at any time to cause or suffer or allow any loud, unnecessary or excessive music to emanate from the vehicle where the music is plainly audible at a distance of fifty (SO) feet from the motor vehicle. ( c) It shall be unlawful for any commercial diesel vehicle to remain standing and running within two hundred (200) feet of a residential neighborhood or a home. (1) Idling control measure. Page 3 of17 a. A driver of a commercial diesel vehicle: 1. Must turn off the vehicle engine upon stopping within two hundred (200) feet of a residential neighborhood or a home, and must not tum the vehicle engine on more than thirty (30) seconds before beginning to depart from the area; and 11. Must not cause or allow the vehicle to idle at any location within two hundred (200) feet from a residential neighborhood or a home for: 1. More than five (5) consecutive minutes; or 2. A period or periods aggregating more than five (5) minutes in any one hour. (2) A business establishment that receives deliveries from a commercial diesel vehicle must ensure that the vehicle driver or the driver's employer is informed prior to making any deliveries, in writing, of the requirements in (c)(I), and of the consequences, under this section and must maintain copies of all such notifications and proof of delivery of same for a period of one (1) year. (3) Exemptions. This section does not apply for the period or periods during which: a. Idling is necessary while stopped for the following reasons: 1. For an official traffic control device; 11. For an official traffic control signal; 111. For traffic conditions over which the driver has no control, including, but not limited to, stopped in a line of traffic; or 1V. At the direction of a peace officer; b. Idling is necessary, for a period not to exceed three to five minutes (as per the recommendation of the manufacturer), to cool down a turbo-charged diesel engine before turning the engine off; c. Idling is necessary and limited to that which is necessary while performing the work for which the vehicle was designed, for example: 1. Collection of solid waste or recyclable material by an entity authorized by contract, license, or permit by a school or local government; 11. Operating a lift, crane, pump, drill, hoist, mixer, or other auxiliary equipment other than a heater or air conditioner; 111. However, idling merely to wait until the work is to be performed shall not be considered necessary. d. Idling is necessary to operate: i. A lift or other piece of equipment designed to ensure safe loading, unloading, or transport of persons with one or more disabilities; or 11. A heater or an air conditioner of a bus or vehicle that has, or will have, one or more children and the children are not allowed to exit the vehicle due to reasonable safety concerns or by reason of law; Page 4 of17 (4) Enforcement. This section shall be enforced in accordance with the procedure set forth in section 2-25 of the city's Code except that a first time offender shall be issued a written warrung. (5) Penalties. Any person who violates subsection (c)( 1) above, including the driver, the person or entity that hires the offending driver, as well as the person or entity who ordered the goods being delivered by said driver, after first being given a written warning, shall pay a fine of one hundred fifty dollars ($150.00) for the first offense after the written warning and the fine shall double for each subsequent offense. However, the person or entity that hired the driver or that ordered the goods being delivered shall not be fined if that person or entity has written proof that notice was given to the driver or, in the case of the person that ordered the goods, to the driver's employer, of the requirements in subsection (c)( 1), and of the consequences, under this section. For the purpose of defining "excessive animal noise," excessive, shall mean the habitual frequent, continuous and/or incessant noise for a period of ten (10) minutes or intermittently for one-half (Yl) hour or more. (b) Violation. The owning, harboring, possessing, or keeping of nay dog, cat, animal. or bird which causes excessive animal noise, which noise is plainly audible from the property line containing the building, structure, or yard in which the animal or bird is located, is a violation of this Code. The tenn "cause to be operated," as used in this section, shall include the act of hiring someone who violates this ordinance, whether the hiring is done by the owner, occupier or by their agent. The occupier of the property shall be deemed the agent of the owner for the purposes of this section. d. The city manager or the manager's designee, or any city code enforcement officer, shall issue a written warning to the person or persons who have violated this section, including the operator and the hirer of the operator as well as the owner of the property if he or she is different from the person who personally hired the operator of the equipment. However, notwithstanding the fact that one (1) or more of the violators may not have received a written warning, nothing contained herein shall prevent the prosecution of the violators who have received a written warning. The written warning may be served by hand delivery, by certified return receipt mail or any other method that provides evidence of delivery. The word "operator," as used in this section, shall mean the owner of the entity or the sole proprietor of the business that is hired and that conducted the offense. The employee of the operator is exempt from the penalties of this section unless the employee is also the owner of or has any financial interest in the business. e. All persons who continue to violate this section after receiving a written warning shall be punished by the imposition, on each violator, of a fine in the amount of two hundred fifty dollars ($250.00) for the first offense and five hundred dollars ($500.00) for each succeeding offense. ANALYSIS:Article III of Chapter 15 of the City’s Code regulates noise within the City. Currently, Section 15-82 addresses the intensity of noise based on a plainly audible standard where the noise is audible at 100 feet from the building, structure, or premises in which or from which it is produced. The proposed ordinance comprehensively amends and updates Article III to: 1.Create definitions for noise regulations under Section 15-79; 2.Amend Section 15-82 of the Code to establish permitted decibel levels for noise which emanates from any building or premises, as measured from the real property line by a sound level meter and establish allowable hours for noise based on such standards, and exempting or limiting the application of the noise restrictions within the Town Center and Downtown SoMi district; 3.Repeal various outdated provisions and to relocate regulations relating to graffiti to a more appropriate section of the Code as Section 15-2; and 4.Amend existing Section 15-96 to update enforcement and penalty regulations and renumber such section as Section 15-85. The cost to implement the new noise standards will include the purchase of two sound level meters, approximately $500 each.
